HomeMy WebLinkAbout02921 ORD - 10/31/195010/31/50 (5) AN ORDINANCE APPROPRIATING EIGHT HUNDRED DOLLARS, FOUR HUNDRED DOLLARS FROM NO. 295 IMPROVEMENT BONDS 1948 CON- STRUCTION FUND (STREET IMPROVEMENTS) AND FOUR HUNDRED DOLLARS FROM NO. 296 IMPROVEMENT BONDS 1950 CONSTRUCTION FUND (STREET IMPROVEMENTS) TO PURCHASE LOTS 1 AND 3, BLOCK 109, BROOKLYN ADDI- TION TO THE CITY OF CORPUS CHRISTI, TEXAS, TO BE USED FOR RIGHT -CF -WAY FOR U. S. HIGHWAY 181; AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY TO EXECUTE THE NECES- SARY CONTRACTS AND INSTRUMENTS FOR THE PURCHASE OF SAID RIGHT- OF-9PAY AND TO DO ALL THINGS REQUISITE TO OBTAINING SAME; REPEALING THE PROVISIONS CON- TAINED IN ORDINANCE NO. 2463 APPLYING TO THE AFORE- SAID RIGHT -OF -WAY; AND DECLARING AN EMERGENCY. WHEREAS, By Ordinance No. 2463, the City Manager of the City of Corpus Christi was authorized to purchase Lots Nos. 1 and 3 in Block No. 109, Brooklyn Addition to the City of Corpus Christi, for use as right- of-way for U. S. Highway No. 181; and WHER :AS, It has been found to be impossible to obtain conveyance of said lots from E. R. Kieberg for the consideration pre- viously authorized, but said owner has agreed to the purchase price of $800, an increase of $300; and WHEREAS, Said agreed price is reasonable and proper, bearing comparison with consideration paid for similar property in said area, it is deemed necessary and proper to provide for the neces- sary appropriation and authorization; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby appropriated the sum of Eight Hundred Dollars ($800), Four Hundred Dollars of which is hereby appropriated from No. 295 Improvement Bonds 1948 Construction Fund (Street Improvements) and the other Four Hundred Dollars of which is hereby appropriated from No. 296 improvement Bonds 1950 Construction Fund (Street Improvements) to purchase Lots 1 and 32 Block 1090 Brooklyn Addition to the City, from Edward R. KLeberg, for use as right -of -way for U.S. Highway 181 in the City of Corpus Christi. SECTION 2. That the City Manager is hereby authorized and directed to execute the necessary contracts and instruments for the purchase of said right of way described in Section 1 and to do all things instant to or requisite to obtaining said right-of -Wray. SECTION 3. That Ordinance No. 21463, passed and approved by the City Council of the City of Corpus Christi, on he lot day of February, 1949, as to the portions thereof pertaining to the pur- chase of Lots land 3 Block 109, Brooklyn Addition, be and the same is hereby repealed. SECTION 14. That the necessity for acquiring adequate right- of -ways for highways within the limits of the City creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or reso- lution shall be read at three several meetings of the City Council of the City, and the Mayor, declaring such emergency and necessity to exist, having requested that said Charter rule be suspended and that this ordinance be passed finally on the date it is introduced and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
