AN ORDINANCE
APPROPRIATING SEVEN THOUSAND FOUR HUNDRED
SIXTY EIGHT ($7,1168) DOLLARS FROM NO. 296
IMPROVEMENT BONDS 2950 CONSTRUCTION FUND
(STREET IMPROVEMENTS) TO BE PAID THE SAN
ANTONIO, UVALDE & GUIF RAILROAD FOR THE
ESTIMATED COST OF FIVE RAIL CROSSINGS &
ONE WARNING SIGNAL AS CONSIDERATION OF THE
SAID R ILROAT:S RIGHT- OF-WAY FOR THE EXTEN-
SION OF LIPAN STREET FOR STORM SEWER, DRAIN-
AGE, AND STREET CONSTRUCTION PURPOSES IN AC-
CORDANCE WITH THE EASEMENT FROM THE RAILROOD,
ESTIMATE AND MAP, COPIES OF WHICH ARE ATTACH-
ED HERETO AND MADE A PART HERETO; AUTHORIZING
AND DIRECTING THE CITY MANAGER FOR AND ON BE-
HALF OF THE CITY TO DO ALL THINGS NECESSARY
IN THE ACQUISITION OF SAID RIGHT-OF-WAY AND
TO EXECUTE THE NECESSARY INSTRUMENTS INCIDENT
THERETO; AND DECLARING AN EMERGENCY.
WHEREAS, There is needed an easement across the San
Antonio, Uvalde & Gulf Railroads property for the extension of
Lipan Street needed for drainage, storm sewer, and street purposes;
and
WHEREAS, There are sufficient funds available to pay
the cost of rearranging certain of the Railroadve tracts, install-
ing five rail crossings and one signal warning light as considera-
tion of the conveyance of such easement in No. 296 Improvement Bonds
1950 Construction Fund (Street Improvements):
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby appropriated the aum
of Seven Thousand Four Hundred Sixty -Eigbt ($7,1168) Dollars from
No. 296 Improvement Bonds 1950 Construction Fund (Street Improvements)
to be paid San Antonio, Uvalde, & Gulf Railroad for the estimated
cost of five rail crossings, one warning signal, and the rearranging
of certain of said Railroadts tracts, as consideration of the said
Railroad's Right-of-way for the extension of Lipan Street for Storm,
Sewer, drainage, and street construction purposes in accordance with
the easement from the Railroad, estimate and map, copies of which

are attached hereto and made a part hereof.
SECTION 2. That the City Manager is hereby authorized .
and directed for and on behalf of the City to acquire said land and
to execute the necessary instruments incident to said acquisition,
which land or right -of-r.V is fully described in the easement made
a part hereof.
SECTION 3. That the fact that the plans and specifica-
tions for a storm sever across the property described herein are
now ready and ouch agbt -of -way is needed for drainage and street
purposes as soon as possible to better serve the City of Corpus
Christi to the benefit and for the general welfare of its citizens,
creates an emergency and and imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date it is introduced and that such
ordinance or resolution shall be read at three several meetings of
the City Council, and the Mayor, having declared such public emergency
and necessity to exist, requesting that such Charter rule be suspend-
ed and that this ordinance be passed finally on the date of its in-
troduction and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council, I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF NUECES
That Guy A. Thompson, Trustee, San Antonio, Uvalde & Gulf
Railroad Company, Debtor, for and in consideration of One Dollar ($1.00)
and other good and valuable considerations, the receipt and sufficiency
of which is hereby acknowledged and confessed, has granted, sold and con-
veyed and does by these presents grant, sell' and convey unto the City of
Corpus Christi, a municipal corporation of the State of Texas, an ease-
ment for roadway purposes ever, across, and along the following tract or
parcel of land situated in Nueces County, Texas, more particularly described

as follows:
All that certain 60 -Foot stria across that certain 3.266
acre tract situated in Corpus Christi, Nueces County, Texas,
conveyed to San Antonio, Uvalde & Gulf Railroad Company by
Missouri Improvement Company under deed dated November 18,. 1931,
recorded in Volume 200, Pages 559 -560, of the Deed Records of
Nueces County, Texas, said 60 -foot strip being within the limits
of Lipan Street produced Easterly and being more fully described
as follows: -
Beginning at a point in the West line of said 3.266 -acre
tract which bears South 290 261 50" west along the West line of
said 3.266 -acre tract a distance of 922.46 feet from its Northwest
corner in the South line of Leopard Street, said point of begin-
ning being the point of intersection of the West line of said 3.266
acre tract and the North line of Lipan Street produced Easterlyp
Thence North 850 11' 30" East, along the North line of Lipan
Street'produced Easterly, a distance of 104 feet, more or less, to
a point in the East line of said 3.266 -acre tract;
Thence South 310 491 West, along the East line of said 3.266
acre tract, a distance of 22 feet, more or less to an exterior
corner in said tract;
Thence South 310 591 West, continuing along the East line of
said 3.266 -acre tract, a distance of 34.6 feet to an interior corner
in said tract;
Thence South 290 26' West, along the East line of said 3.266 -
acre tract, a distance of 20 feet, mgre or less, to a point in the
South line of Lipan Street produced Easterly;
Thence South 850 11f 30e vest along the South line d Lipan
"treet produced Easterly, a distance of 97 feet, more or less to
a point in the West line of said 3.266 -acre tract;
Thence North 290 26, 50" Best; along the West line of said
3.266 -acre tract, a distance of 72.59 feet to the point of beginning;
Containing 0.14 acres, more or less.
TO HAVE AND TO HOLD the above described easement for roadway
purposes unto the said City of Corpus Christi, its successors and assigns -
forever; upon and subject, however, to each and all of the following�con-
ditions, to -wit.
(a) That the Grantor herein, his successors and assigns, reserve
the right to lay, multiply and maintain railroad tracks over, along and
across the said premises;
(b) That the City of Corpus Christi nay to the Grantor herein,
in cash, such amount as shall be necessary (presently estimated at
$7,468..00)) to rearrange certain of Grantor's tracks now crossing the above
described premises, and to install five rail crossings and one signal warn-
, ing light.
In the event of the breach of any one or more of the conditions
hereinabove set forth, or in the event of the breach by the Grantee of any

of the conditions set cut in that certain deed from Missouri Improvement
Company to the City of Corpus Christi, of even date herewith, which is hereby
referred to for all purposes, or in the event the Grantee, its successors or
assigns, shall cease to use the premises above described for roadway purposes,
the easement hereby granted shall ex ?ire and terminate; whereupon Grantor,
his successors and assigns, shall have the same title to such oremises as
though these presents had never been executed, and shall have the right to
exclude therefrom Grantee its successors and assigns.
