RECEIVING AND ACCEPTING THE M K OF ASPHALT SUR-
FACE TREATMENT ON 8.9 MIIF -" OF STREETS AND SHELL
BASE COURSE ON 111.2 MILES OF STREETS BY HELDENFEIS
BROTHERS AS AUTHORIZED BY CRDINANCE NO. 2834 UNDER
CONTRACT DATED AUGUST 7, 1950; AUTHORIZING FINAL
PAYMENT OF CONTRACT RICE IN ACCORDANCE WITH FINAL
ESTIMATE DATED NOVEMBER 22, 1950 in THE AMOUNT OF
$18,906.66, A COPY OF WHICH IS ATTACHED HERETO AND
MADE A PART HEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF W CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the work of Asphalt Surface Treatment on
8.9 miles of streets and Shell Base Course on 14.2 miles of street,
in the City of Corpus Christis performed by Heldenfels Brotherso under
their contract with the City dated August 7. 1950, as authorized by
ordinance No. 2834, having been performed and completed in accordance
with the terns and provisions of the contract, plans, and specifica-
tions, and the Director of Public Works having inspected the same and
certified to the completion of said work in accordance with said plans
and specifications, the work aforesaid is hereby found to have been
completed in accordance with the plans and specifications and is here
and now accepted and received by the City Council of the City of Corpus
Christi, Texas.
SECTION 2. That final payment due under the contract men-. y,
tioned and as set out in the final estimate, a copy of which is attach-
ed hereto and made a part hereof, prepared by the Director of Public
Works and dated November 22, 1950, in the amount of $18,905.66 be made
in accordance with the terms of such contract and ordinance out of
Fund No. 296 Improvement Bonds 1950 Construction Fund (Street improve-
ments).
SECTION 3. The necessity of the repair and maintenances
of the Public Streets of the City of Corpus Christi, and the comple-
tion of said contract work for such purpose, creates a public emergency
and an imperative public necessity requiring the suspension of the
Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction and that such ordinance and resolution
shall be read at three several meetings of the City Council, and the

Mayor, having declared such emergency and necessity to exists request_
ing the suspension of said Charter rule and that this ordinance be pass-
ed finally on the date of its introduction and that it take effect and
be in full force and effect from and after its passages IT IS ACCORDING-
LY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fare -
going ordinance, a public emergency and imperative necessity exist for
the suspension or the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
