P. MCCORD. FOR THE CONSIDERATION AND UNDER THE TERMS AND CONDITIONS AS SET OUT IN THE LETTER FORM AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND D°EWRING AN EMERGENCY. BE IT ORDAINED BY ME CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Pity Manager of the City of Corpus Christi be, and he is hereby, authorized and directed for and on behalf of the City to execute a contract and to do all things neces- sary and requisite to the acquisition of a Twenty -five foot (251) Right -of -way on Baldwin Boulevard from Ayers Street to the Winston Property, as more particularly described hereinafter, from T. P. McCord, for the widenine of Baldwin Boulevard and for 4zaju gr purposes, for the consideration and under the terms and conditions as set out in the letter form agreement, a copy of which is attach- ed hereto and made a part hereof; and reading as follows, to wit: �9�a SECTION 2. The necessity of maintaining and improving . the streets and drainage of the City of Corpus Christi creates an emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall'be read at three several meet- ings of the City Council, and the Mayor$ declaring such public emergency and necessity to exist, having requested the suspension of the Charter role above mentioned and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and affect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, PASSED AND APPROVED, This the day of December, 1950. McCord 1537 Eunice Corpus Christi, Texas Dear Mr: McCords We are informed that,you are agreeable to conveying a strip 25 foot in width off the property abutting the south aide of Baldwin Boulevard ox- tending from Ayers Street to tho h"inston Property, in considoration for the City paying you for the Ayers Street end of this strip, facing 143 feet on Baldwin Boulevard and temporarily improving this widening of Baldwin Boulevard by moving the storm water drainage ditch to the western edge of this strip and surface treating the widening area of Baldwin Boulevard. The City is agreeable to this proposition upon the under- standing that the price to be paid for the property at the corner of Ayers and Baldwin Boulevard be fixed .by a Board of three appraisers composed of real estate men, one appointed by yourself, ono appointed by the City, and these two selecting the third. It is understood that their valuation will be binding on yourself and the City, and upon the fixing of the valuation, proper convoyancos will b© made with the City forces proceeding within a reasonable time to change the location of the Storm drainage ditch and to surface treat the street area. Your property from a point 143 feet west of Ayers Streot northward on Baldwin to the east side of Winston Plumbing Company property, 25 feet in depth, will be conveyed to the City for the consideration of One Dollar (1.00) and the further consideration that you will be held freq from cast to you of the paving, curb and gutter assessments for the first permanent typo improvements placed thereon or a payment to you of the present cash equivalent of the estimated cost of said improvemeuts.- I note from your communication that such a widening of Baldwin Boulevard will leavo you only a depth of 75 feet to your property reduced by a 5 foot casement on the rear and it seems that your request for re-zoning- probably should be givoa favorable consideration so as to oliminate the- necessity for set�-baok and to permit use of the property for business Purposes. ' Corpus Christi, Texas , 1950 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that suoh ordinance or resolution shall be read at.three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
