BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That the City Manager of the City of Corpus Christi be, and he is hereby authorised and directed for and on behalf of the City to execute a deed to Corpus Christi Chamber of Commerce, a corporation, of Nueces County, Texas, conveying the East 1/2 of Water Block 12, Beach Portion of the City of Corpus Christi, Texas, for and in consideration of Ten Dollaig($LO), and other good and valuable consideration, all of which is shown in the Deed attached hereto and made a part hereof, reading as follows: ' 9os THE STATE OF TEXAS Q COUNTY OF NUECES Q KN94 ALL WN BY THESE PRESENTS: That the City of Corpus Christi, Nueces County, Texas, a municipal corporation, for and in consideration of the sum of Ten Dollars 010.00) to it in hand paid by the Corpus Christi Chamber of Commerce, of Nueces County, Texas, a Texas Corporation, receipt of which is hereby acknowledged, and of the additional consideration herein- after set forth, to -wit: (a) Said Grantee, the Corpus Christi Chamber of Commerce, will erect upon the property herein con- veyed a permanent building, at an expense to it of not less than l,50,000.00, to house said Cramber of Commerce, and will staff and maintain such building without expense to the City of Corpus Christi, the construction of said building to be commenced within one year from the date hereof; (b) Said grantee will maintain as its sole expense a permanent all -year Tourist Information Bureau in said Building, and provide such literature as is customarily employed in such Information Bureaus extolling the benefits and advantages of the City of Corpus Christi; (c) Said grantee will provide in said building such space as it shall deem advantageous, for 'tile displaying of exhibits, depicting the commercial, industrial, agricultural, mineral and maritime assets of the City of Corpus Cnristi, does by these presents bargain, grant, sell and convey unto the said Corpus Christi Chamber of Commerce, and its successors, all right, title and interest in and to that certain tract or parcel of land lying in Nueces County, Texas, described as follows: Being the east 1/2 of Block 12, Water Beach Portion of the City of Corpus Christi, Texas, as shown by map of record in Volume 9, Pages 98 -41 of the ldap Records of nieces County, Texas, more particularly described by metes and bounds as follows: Beginning at the original northwest corner of Block 12, Water Beach Portion; Thence in an easterly direction with the north boundary line of said Block 12 a distance of 190 feet to a point, the present northwest corner of Lot 7, Block 12, Water Beach Portion for the northwest corner and beginning of tr.is description; Thence at right angles in a southerly direction with the present West boundary line of Lots 7, 8, 9, 10, 11 and 12, Block 12, Water Beach Portion, a distance of 300 feet to the present southwest corner of Lot 12, Water Beach Portion for the southwest corner of this tract; Thence at right angles in an easterly direction with the south boundary line of said Lot 12, Block 12, Water Beach Portion a distance of 150 feet to the present southeast corner of said Lot 12 for the south- east corner of this tract; Thence at right angles in a northerly direction with the present east boundary line of said Lots 12, 11, 10, 9, 8 and 7, Block 12, ?later Beach Portion a distance of 300 feet to the northeast corner of said lot 7 for the northeast corner of this tract; Thence at right angles in a westerly direction with the present north boundary line of said Lot 7 a distance of 150 feet to the northwest corner of said Lot 7 and place of beginning. TO HAVE AND TO HOLD the above described premises, to- gather with all and singular the rights, privileges and appurten- ances thereto in anywise belonging, unto the'said Corpus Christi Chamber of Commerce, its successors and assigns forever. PROVIDED, however, that in the event said grantee shall fail to erect and maintain said building and otherwise fail to carry out grantee's obligations set forth in subparagraphs (a), (b) and (c) above, or permit the use of said land or premises, or any part thereof, for any purpose other than herein provided without the written permission of the grantor, the property conveyed hereby together with all improvements thereon shall revert to the City of Corpus Christi, and it shall be and hereby is authorized to make re -entry upon the demised premises and take full possess- ion thereof and title thereto, provided further, however, that no default, failure or violation of the terms, conditions and provisions by the Grantee, its successors or assigns, shall in any manner affect or impair the validity of any then existing lien on said property, and that all rights of the City of Corpus Christi hereunder shall be in all respects subject, subordinate and inferior to such existing liens, and the rights of the holder or holders thereof to enforce such lien or liens in accordance with the,provisionS of the instrument or instruments creating same, and, thereby to terminate all rights of said Chamber of Commerce, its successors or assigns, and of the City of Corpus Christi. It is expressly agreed and understood that in case of default in the payment of any lien by Grantee created in accord- ance with the provision hereof that the City of Corpus Christi shall be authorized to make re -entry upon the demised premises and take full possession thereof and title thereto, which right can be exercised only by the assumption by the City, of the pay, ment of the outstanding indebtedness and the payment thereof,In the event of such assumption and payment by the city, the City shall be subrogated to the rights of the creditor. IN WITNESS WHEREOF, the City of Corpus Christi, a municipal corporation, has caused these presents to be exdcuted by its duly authorized City Manager, W. B. Collier, this day of December, 1950. The need for the promotion and develop- ment of trade and commerce in the City of Corpus Christi being to the general welfare and benefit of the citizens of Corpus Christi creates a public emergency and an imperative public neces- sity requiring the suspension of the Charter rule, that no ordi- nance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, declaring such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after the date of its passage, IT IS ACCOADNGLY SO ORDAINED.
