HomeMy WebLinkAbout02946 ORD - 12/12/1950ii/l/50 (5'T AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THERE- FOR; DEFINING THEIR POMW AND DUTIES; PRO- VIDING REGULATIONS FOR FIRE PREVENTION AND PROTECTION IN CONNECTION WITH HAZARDOUS MATERIAL AND PROCESSES; PROVIDING PENALTIES FOR THE VIOLATION THEREOF= PROVIDING THAT SAID ORDI- NANCE SHALL BE KNOW AS THE FIRE PREVENTION ORDINANCE; DECLARING AN EMERGENCY ", AND BEING ORDINANCE N0. 1713, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 8TH DAY OF AUGUST, 19 4, BY AMENDING SECTION 805 THEREOF BY LIMITING THE SIZE OF CONTAINERS; PROVIDING FOR MINIMUM HORIZONTAL DISTANCES OF LOCATION OF CONTAINERS FROM ANY ENCLOSED STORAGE OR PROPERTY LINE; EXCLUDING INSTALIATION WITHIN CERTAIN FIRE LIMITS; AND DECLARING AN EMERGENCY. WHEREAS, it has been determined that more detailed regula- tions should be provided for the installation of tanks and containers for the purposea of containing and storing compressed or liquefied petroleum or other inflammable gases and that the safety of the public requires the immediate adoption of such regulations; NON, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 805 of Ordinance No. 1713 entitled: "AN ORDINANCE PROVIDING FOR TEE ESTABLISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THEREFOR, DEFINING THEIR POPPERS AND DUTIES, PRO- VIDING REGULATIONS FOR FIRE PREVENTION AND PRO- TECTION IN CONNECTION WITH HAZARDOUS MATERIALS AND PROCESSES; PROVIDING PENALTIES FOR THE VIO- LATION THEREOF; PROVIDING THAT SAID ORDINANCE SHALL BE KNOWN AS THE FIRE PREVENTION ORDINANCE; DECLARING AN EMERGENCY." passed and approved by the City Council on the 8th day of August, 1914, be and the same is hereby amended to hereafter read as follows: "805. Tanks and storage. - a. All tanks, containers and appurtenant equipment installed for use within the corporate limits of the city for the purpose of providing Liquefied Petroleum Gas for industrial, commercial and domestic uses shall be designed, constructed, equipped and installed in a manner as required by the laws of the State of Texas and all special regulations of the Railroad Commission as now or here- after promulgated in conformity with the laws of the State. Such containers shall be equipped with suitable excess flow valves, necessary pressure regulator and shall be suitably protected against corrosion. _1_ "b. Tontainers shall not be placed closer than twenty -five (251) Feet from basements or other structures which extend to below ground level. " c. Containers larger than one thousand (1,000) water gallon capacity shall not be erected, installed or used unless a special permit, authorized by resolution of the City Council has been issued by the Building Inspector with the approval of the Fire Marshall after careful investigation of the proposed installa- tion considering possible hazards to life and contiguous property. 'H. Tanks and containers shall not be placed in service or filled upon the premises of the ultimate user or, when placed underground, tanks shall not be covered over, until the work of installation has been inspected by the Fire Marshall and the work approved and a label of such approval attached or affixed thereon by the Fire Marshall, nor shall such containers be re- filled thereafter unless they bear such label of approval dated not more then five (5) years prior to the time of said refilling, provided, however, that where Interstate Commerce Commission bottles are used the empty bottles may be replaced by full bottles if the system bears such a label of approval. The Fire Marshall is hereby authorized to reinspect any existing install- ation and if found to be reasonably safe attach thereto a label of approval dating from the date the container was installed and approved by the Fire Marshall. Containers which have not been approved shall not be labeled. "e. Underground tanks shall be emptied before being dug up or uncovered and shall be filled once with water before they are moved or worked on and this work shall not be done by persona other than those authorized by license. 'If. Adjustments, changes or alterations in the accessories, devices, regulators and safety devices of liquefied Petroleum Gas containers shall not be made except by persons licensed to do such work. 'IS. No liquefied Petroleum Gas shall be stored or retained inside of any structure within the city except that Interstate Commerce Commission approved containers in sizes of sixteen (16) pounds of gas or less may be used inside of buildings by obtain- ing written permission From the Fire Marshall and Interstate Commerce -2- Commission containers in sizes of one hundred (100) pounds of gas or less may be used for cutting metals when used inside buildings and under conditions by the Fire Marshall.)' SECTION 2. The necessity for the maintenance of a standard of rules and regulations for fire prevention in the City of Corpus Christi creates a public emergency and imperative public necessity requiring the suspension of that certain Charter rule that no Ordi- nance or resolution shall be passed finally on the day it is intro- duced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having de- clared such emergency and necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. HERS OF THG CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the preseat meeting of the City Council.
