AN ORDINANCE
APPROPRIATING x$4,840.44 TO BE PAID AS CONSIDER- '
ATION IN THE CONSTRUCTION OF CERTAIN SIDENALK
AND PARKING AREA IMPROVEMENTS FROM FDND,NO. 296
' IMPROVEMENT BONDS 1950 CONSTRUCTION FOND (PARS
s IMPROVEMENTS); AUTHORIZING AND DIRECTING THE
CITY MANAGER FOR AND ON BEHALF OF THE CITY TO '
EXECUTE A CONTRACT WITH C. L. CASTOR FOR THE
CONSTRUCTION OF SAID SIDEffALS AND PARSING AREA
n1PROVEMENTS AT LINDALE PARK; SUCH CONTRACT
DOCCMENTS, PLANS, AND SPECIFICATIONS ARE MADE
A PART HEREOF BY REFERENCE; AND DECLARING AN
EMERGENCY.
WHEREAS, Certain improvements have been determined to be
necessary; and,
ITHEREAS, there are sufficient funds unappropriated in Fund
No. 296 Improvement Bonds 1950 Construction Fund (Park Improvements)
from which to appropriate the amount to be paid for such improvements;
and,
YIBEREAS, Bids have been received, considered, and an award
made for the most advantageous bid to the City of Corpus Christi,
Texas; and, it is now necessary to make appropriations out of the
proper fund for such payment, and to authorize the execution of a
contract in accordance with said award;
NOW. THEREFORE, BE IT ORDAINED BY TEE CITY COUNCIL OF TEE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION.1. That there is hereby appropriated out of Fund
No. 296 Improvement Bonds 1950 Construction Fund (Park Improvements)
the' sum of $4,84044, out of which fund there is to be paid according
to the terms of the contract described in Section 2 hereof the sum
of $4,400.40, and the balance of said appropriation is $440.04, the
amount equivalent to ten per cent (10%) of maid contract price, which
amount is hereby appropriated for the payment of engineering and
contingent costs of said project.
SECTION 2.' That the City Manager is hereby authorized and
directed to execute for and on behalf of the City of Corpus Christi
a contract for the construction of s Sidewalk and Parking Area at
Lindale Park in the City of Corpus Christi with C. L. Castor of Corpus

Christi, Texas, which contract has been awarded said C. L. Castor
in accordance with plans and specifications and contract documents
an file in the office of the City Secretary, all incorporated herein
and made a part hereby by reference, and according to the bid of
said C. L. Castor opened on the 12th day of December, 1950, the
said bid of C. L. Castor being the lowest and most advantageous
bid to the City of Corpus Christi, Texas.
SECTION 3. The necessity for the construction of Sidewalk
and Parking Area at Lindale Park creates a public emergency and
imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on
the date of its introduction and that such ordinance shall be
read at three several meetings of the City Council, and the Mayor,
having declared that such emergency and necessity exist, requesting
that such Charter rule be suspended and that this ordinance be
passed finally on the date it is introduced and take effect and
be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution Shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at.three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

I certify to the City Council that the money required
for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No.. 296 Improvement Bonds 1950
Construction Fund (Park Improvements)
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.
