CITY TO EXECUTE A CONTRACT WITH HELDENFEL BROTHERS, A PARTNERSHIP, FOR THE CONSTRUC IONS TO EXISTING IMPROVEMENTS, SUCH CONTRACT DOCUMENTS, PLANS, AND SPECIFICATIONS BEING MADE A PART HEREOF BY REFERr- ENCES;.AND.DECLAR NG AN.EMERGENCY. YMR&S, Certain improvements have been determined to be necessary; and WHEREAS, Bids have been received, considered, and an award made for the most advantageous bid to the City of Corpus Christi, Texas; and WHEREAS, It is now necessary to make appropriation out of the proper fund for the cost of such improvements and to enter into a contract for said improvements:: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF T'EM CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby appropriated out of Fund No, 299 Improvement Bonds 1950 Construction Fund (Sanitary Sewer Improvements) the sum of $581,123.95, out of which amount there is to be paid according to the terms of the contract descri,& ed in Section 2 hereof the sum of $528,294.50 as contract price, and the balance of said appropriation, $52,829.45, being equivalent to ten per cent of said contract price, is appropriated for the payment of engineering and contingent costs of said project, SECTION 2. That the City Manager is hereby authorized and directed to execute for and on behalf of the City of Corpus Christi a contract for Construction of Sewage Treatment Plant Additions at the Oso and Broadway Plants with Heldenfels Brothers, a partnership, which contract has been awarded said Heldenfels - - - - -- ro ers- ill-accordance with planst specifications and contract documents on file in the office of the City Secretary, all in- corporated herein and made a part hereof by reference, and accord- ing to the bid of said Heldenfels Brothers, opened on the 5th day NO of December, A.D. 1950, the'said bid of Heldenfela Brothers being the lowest and most advantageous to the City of Corpus Christi, SECTION 9, That the necessity for execution of said contract immediately in order that said improvements may be comet» enced and in order to increase the capacity of said plants by the enlargement of the Oso Plant and construction of additions to the Broadway Plant, such improvements being urgently needed, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meet- ings of the City Council, and the Mayor, having declared such emergency and necessity to exist, requesting that said Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAIN• ed, PASSED AND APPROVED, December, 1950, MAIOR The City of Corpus Christi, Texas T T: y Secretary APPROVED AS TO LEGAL FOIN: UIZY Attorney Corpus Christi., Texas !la _!_�F 1954 TO THE NMERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen- For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at .three meetings of the .City Council, I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
