LEE FOR THE PURPOSE OF CO SMi ILON OF NW . ' SEWER IMPROVEMENTS ON THE LIPAN STREET MEN, SION TO PROVIDE DRAINAGE AND CONTRACT DOCMISNT, MADE A REFERENCE; APPROPRIATING OUT OF CONTRACT CONSTRUCTION COSTS AND THE SUM OF $9,358.12 ENGINEERING AND CONTINGENCY COSTS; AND DECIARING AN EMERGENCY, WHEREAS, Certain improvements have been determined to be necessary; and, WHEREAS, There are sufficient funds available and un- appropriated in to. 296 Improvement Bonds 1950 Construction Fund (Storm Sewer Improvements) to cover the cost of said improvemontej and, WHEREAS, Bide have been received, considered, and an award made for the lowest and most advantageous bid to the City of Corpus Christi, Taxes, and it is now necessary to authorize the execution of a contract and to make such appropriation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CCRF68 CHRISTI, TEXAS; SECTION 1. That the City Manager is hereby authorized and directed to execute for and on behalf of the City of Corpus Christi a contract with T. H. Lee for the construction of storm sewer improve- ments on the Lipan Street Extension to provide atom drainage for the area of Lipan Street Extension between 19th Street and Palm Drive by the construction of reinforced concrete boa and reinforced concrete pipe storm sewer, with appurtenant structures as set out in plane and specifications, which contract has been awarded in accordance with plane, specifications and contract dooumeats on file in the office of the City Secretary, all of which are made a part hereof by reference, and according to the bid of said T. H. Lee opened a9�7 on the 19th day of December, 1950, the said bid of T. H. Lee being the lowest and most advantageous to the City of Corpus Christi, Texas. , SECTION 2. There is hereby appropriated out of No. 296 Improvement Bonds 1950 Construction Fund (Storm Sewer Improvements) the sum of $165,326.83, out of which sum there is to be paid, according to the terms of the contract described in Section 1 hereof, the sum of $155,968.71 to cover. oontract construction casts and the balance of $9058.12 to cover the amount of engineering and contingency costa of said project. SECTION 3. The necessity for the construotion of muchly needed storm &ewers to some the area of Lipan Street Extension between 19th Street and Palm Drive to provide more ddequate drainage for such area creates a public emergency and imperative public necessity requiring the suspension of that certain Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that suoh emergency and necessity exist, requesting that such Charter rule be suspended and that this ordinance be passed finally on the date it is introduced and take effect and be in full force and effect from and after its passage, IT IS ACCORD- INGLY SO ORDAINED. Lowman Q„s� ,?, 957 12 -26-50 I certify to the City Council that the money required for the pontract, agreement, obligation, or expenditure contemplated in the above and foregoing Ordinance is in the Treasury of the City of Corpus Christi to the credit of No. 296 IMPROVEMENT BONDS 1950 CONSTRUCTION FUND (STORM SEWER IMPROVEMENTS) Fund from which it is proposed to be drawn, and such money is not appropriated for any other purpose. ME
