HomeMy WebLinkAbout02965 ORD - 01/02/1951AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON MEW OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CONTRACT WITH INTERNATIONAL BUS- INESS MACHINES CORPORATION OR OUNT- MU-MINE SERVICE 6AMh; IN E USE OF CERTAIN MACHINES, FOR A MONTHLY RENTAL OF $895 FOR THE TERM AND UNDER THE CONDITIONS AS SET OUT IN SAID LEASE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING THREE THOUSAND ($3,000) DOLLARS FOR INSTALLATION CHARGES, SPECIAL DEVICES AND STATIONERY SUPPLIES INCIDENTAL TO M OPERATION OF THE IBM SYSTEM; SAID AMOUNT TO RE PAID FROM FUND NO. 141 WATER OPERATIONS, AND DECLARING AN EMERGENCY. That the City Manager for and on behalf of the City of Corpus Christi be authorized and directed to execute a contract with International Business Machines Corporation for , electric accounting machine service for a monthly rental of $895 for the term and under the conditions as set out in said lease r contract, a copy of which is attached hereto and made a part here- of. SECTION 2. That for such professional service there is hereby appropriated Three Thousand Dollars for installation charges, special devices and stationery supplies incidental to the operation of such IM system, from Fund No. 141 Water Opera- tions, to be paid in accordance with the contract which is describ- ed in Section 1 hereof. SECTION 3. That the necessity for entering into such contract immediately to insure delivery as soon as possible in order to make finger -tip statistics available and to provide a more effective accounting system in the Water and Gas Department of the City of Corpus Christi, Texas, creates a public emergency and an imperative public necessity requiring the suspension of , the Charter rule providing that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency ,:29G8 and necessity to exist, having requested that such Charter role be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passagep IT IS ACCORDINGLY SO OR- _ DAINED. Term of This agreement is effective from the date it is approved and shall remain in force Agreement for one year from the date the first machine is installed ready for your use, and may be terminated by either party then, provided written notice is received three months prior, other- wise this agreement shall remain in full force and effect. Thereafter it may be terminated or any of the machines or devices may be discontinued by either party at the end of any calendar month provided three months' prior written notice is received. Monthly The monthly charges include the use of machines and devices by only one shift of Charge.* clerks, and commence in each case the day following that on which each machine or de- vice is installed ready for your use. When a machine or device is used by more than one shift of clerks, an extra charge for each such shift shall be made at the rate of 50% of the stated charges for the period that any machine or device is so used. There shall be added to the charges amounts equal to any taxes however designated, levied or based on such charges or upon this agreement or the machines and devices or their use, or any taxes or amounts in lieu thereof paid or payable by us in respect of the foregoing, exclusive of ordinary personal property taxes assessed against us and taxes based upon net income. Cards Cards manufactured by us or by others may be used to operate the machines provided they meet the necessary specifications. The necessary card specifications are set forth in our card price list. Maintenance We will keep our machines and devices in good working order and will make all neces- sary adjustments and repairs. However, charges for any repairs or replacements due to your negligence will be borne by you. The required suitable electric current to operate the machines or devices will be furnished by you. During the period that the machines and devices are installed on your premises, you are relieved of the responsibility for loss or damage thereto caused by fire, lightning, sprinkler leakage, tornado and wind storm, water damage, explosion, smoke and smudge, aircraft and motor vehicle damage, earthquake, collapse of buildings or structures, and strikes, riots and civil commotion. When the distance from the point of installation to our nearest service location is greater than fifteen miles, all travelling expenses of our representatives for maintenance and repair of the machines and devices are to be paid by you. General This agreement supersedes all previous agreements between us with respect to Electric Accounting Machine Service, and such service hereafter is to be subject to this agreement, without, however, changing the existing monthly charges. Either party may terminate this agreement for failure of the other to comply with any of its terms. All machines and devices remain our property and may be removed by us at any time after termination of this agreement. Terms Thirty days net from date of invoice. Monthly charges will be invoiced on the first of each month.
