City Manager R. Marvin Townsend Assistant City Attorney Bill Monkres City Secretary Bill G.,Read //,(17 - Mayor /„,Q. - Mayor Luby called the meeting to order. City Secretary Read noted that, there was a quorum of the Council and the necessary Charter Officers present to have a legally constituted meeting. City Manager Townsend presented the scheduled public hearing on Application 111075-3, W. G. Bates, Trustee, for change of zoning from "F -R” Farm -Rural District to "B-4" General ,Business District, on a,1.22 acre tract out of Lot 17, Section 12, Flour Bluff and Encinal Farm and Garden Tracts and Application #C1075-4, City of Corpus Christi, for change of zoning from "F -R" Farm -Rural District to "B -4" -General Business District, on an approximate 90''x 180' portion*of Lot 17; Section -12, Flour Bluff and Encinal Farm and Garden Tracts, which he said could be heard together. He stated that the Planning Commission and the Staff recommended approval of the applications; and that no written responses had been . received with regards to the change`of zoning and the hearing. Chief Planner. Larry Wenger presented a land use and zoning map and slides of the area,tand summarized the requested zoning changes. 'No one from the audience spoke relative to the applications. Motion by de Ases, seconded by Lozano and passed, that the hearing be closed. Motion by de Ases, seconded by Sample and passed, that the recommendation of the Planning Commission be concurred in, and Application 111075-3, W. G. Bates, Trustee, for change of zoning from "F -R" Farm -Rural District to "B-4" General Business District, and Application #C1075-4, City of Corpus Christi, for change of zoning from "F -R" Farm -Rural r Disttict to "B-4" General Business District, be approved. City Manager Townsend presented the scheduled public hearing on Application 111075-5, Imelda Garcia, for change of zoning from 6R -1B" One -family Dwelling District to "B-1" Neighborhood Business District, on Lot 1, Block 1, Surrey Place Unit 111, and reviewed that the recommendation.of the Planning Commission was that "8-1" be denied but in lieu thereof "AB" be approved on the basis that it would be more restrictive and would still accomplish the proposal of the applicant. He stated that the Staff's recommendation was rtes bpecial Council Meeting December 17, 1975 Page 2 against the change of zoning and also against a special permit because it is a very new residential area, not designed for business uses, and approval of the change of zoning would have a detrimental effect on neighboring lots; that there would be a substantial increase in traffic in the immediate vicinity; and also a parking problem on the lot. Chief Planner Larry Wenger presented a land use and zoning map and slides of the area, and explained that the parking requirements for the requested zoning are one parking space for every 200 feet of office space; that there would not be adequate parking for the present structure. No one addressed the Council in opposition to the request. Motion by de Ases, seconded by Tipton and passed, that the hearing be closed. Motion by Sample, seconded by Gulley and passed, with Commissioner Lozano disquali- fying himself from voting on the issue, that the recommendation of the Planning Commission be concurred in, and Application #1075-5, Imelda Garcia, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District be denied, but in lieu thereof "AB" zoning be approved. City Manager Townsend presented Application #1075-6, Fred Raible, Jr., Trustee, for change of zoning from "A-1" Apartment House District to "B-4" General Business District, on approximately 6.6 acres out of Lots 31 and 32, Section 18, Flour Bluff and Encinal Farm and Garden Tracts, and stated that the Planning Commission and the Staff recommended denial; that four letters had been received in favor of the request. Chief Planner Larry Wenger presented•a land use and zoning map of the area. Mr. Tom Swantner, realtor representing Mr. Raible, explained their request and stated that there would be about 600 units in the complex. He stated that "B-1" zoning rather than "B-4" would be adequate for their purposes. Motion by de Ases, seconded by Gulley and passed, that the hearing be closed. Motion by Gulley, seconded by de Ases and passed, with Mayor Luby voting "Nay", that Application #1075-6, Fred Raible, Jr., Trustee, for change of zoning from "A-1" Apartment House District to "B-4" General Business District be denied, but in lieu thereof "B-1" be approved. City Manager Townsend asked reconsideration of Applications #1075-3 and #C1075-4 due to the fact that a letter in opposition from the owner of the property had been received on the case, but had been misfiled in error. utes Special Council Meeting December 17, 1975 Page 3 Motion by Lozano, s?conded by de Ases and passed, that the hearing on Applications 111075-3 and 11C1075-4 be reopened. City Manager Townsend explained that the letter was from Mr. Ed Hunt, 631 South Staples, who opposed the request of Application #C1075-4, change of zoning from "F -R" to "B-4" because he was the owner of the property, and did not want the zoning changed. He also opposed Application #C1075-4for change of zoning from "F -R" Farm -Rural District to "B-4" General Business District because it is adjacent to his property. Motion by Gulley, seconded by de Ases and passed, that the two Applications be voted upon separately. Motion by Gulley, seconded by Lozano and passed, that the recommendation of the Planning Commission be concurred in, and Application 111075-3, W. G. Bates, Trujtee, for change of zoning from "F -R" Farm -Rural District to "B-4" General Business District be approved. Regarding Application #C1075-4, Chief Planner Larry Wenger stated Mr. Hiint had been contacted and was opposed to the change of zoning to "B-4". City Manager Townsend added that approval of the request would require six affirmative votes. Motion by Gulley, seconded by de Ases and passed, that Application #C1075-4, City of Corpus Christi, for change of zoning from "F -R" Farm -Rural District to "B-4" General Business District be denied. City Manager Townsend presented the scheduled public hearing on the Text Amendment, Amendment to Article 4, General Provisions, Districts and District Maps--deletCon of Section 4-5, Buildings for Telephone Service Excepted, in its entirety from the Zoning Ordinance, and stated that the Planning Commission and Staff recommended approval. No one from the audience spoke regarding the request. Motion by Sample, seconded by de Ases and passed, that the hearing be closed. Motion by de Ases, seconded by Sample and passed, that the recommendation of the Planning Commission be concurred in, and the Text Amendment be approved. There being no further business to come before the Council at this Special Meeting, the Meeting was adjourned and the Council reconvened the Regular Meeting.
