APPROPRIATING $98,794.52 TO COVER THE COST OF ASPHALT
SURFACE TREATMENT ON 34 NILES CF STREETS SHOWN ON AT-
TACHED LIST IN THE CITY FROM NO. 296 iemvEMENT BONDS
1950 CONSTRUCTION FUND (STREET 111PROVEMENTS); AUTHOR -
TLING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF
OF THE CITY TO EXECUTE A CONTRACT WITH HELDENFELS BROS.
FOR SUCH STREET IMPROVEMENTS; MOM SUCH CONTRACT DDCU-
MENTS, PLANS AND SPECIFICATIONS A PART HEREOF BY REFER-
ENCE; AND DECLARING AN EMERGENCY
WHEREAS, Certain improvements to existing streets have been
determined to be necessary; and
WHEREAS, There are sufficient fund available and unappropri-
ated in No. 296 Improvement Bonds 1950 Construction Fund (Street Im-
provements) from which appropriation for the payment of said costs
may be made; and
WHEREAS, Bids have been received, consirleredp and an award
made for the moat advantageous bid to the City of Corpus Christi,
it is noer necessary to appropriate said money and to authorize the
execution of a contract for such work:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI: TEXAS:
SECTION 1. That there is hereby appropriated out of Fund No.
296 Improvement Bonds 1950 Construction Fund (Street Improvements)
the sum of $98,794.52, out of which there is to be paid according to
the terms of the contract described in Section 2 hereof, the sum of
$89,813.20 as the contract price therefor, and the balance of said
appropriation being the amount equivalent to ten per cent (10%) of
said contract price, $8,981.32j is hereby appropriated to cover the
cost of engineering and contingent costs of said improvements describ-
ed in said Section 2.
SECTION 2. That the City Manager is hereby authorized and
directed to execute for and on behalf of the City a contract for as-
phalt treatment of 34 miles of streets shown on the attached list in
the City with Heldenfels Bros. of Corpus Christi, Texas, which con-
tract has been awarded said Heldenfels Bros, in accordance with the
contract documents, plans and specification on file in the Office of
the City Secretarys incorporated herein and made a part hereof by re-

ference, according to the bid of said Heldenfels Bros, opended on the
36th day of January, 1951, said bid being the lowest and most advan-
tageous bid to the City of Corpus Christi, Texas.
SECTION 3. That the necessity for providing for the maintenn
ance of existing streets in the City to protect the general welfare
and safety of the public creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its
introduction and that such ordinance or resolution shall be read at
three several meetings of the City Council, and the Mayor, declaring
such emergency and necessity to exist, having requested the said Charter
rule be suspended and that this ordinance be passed finally on the
date of its introduction and take affect and be in full force and ef-
fect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.

resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at.three meetings of the
City Council, I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

I certify to the City Council that the money required
for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No. 296 Improvement Bonds 1950
Construction Fund (Street Imrpovements)
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.
