HomeMy WebLinkAbout03001 ORD - 03/13/1951'3/13/51 (5) il AN ORDINANCE '3OC 1 RECEIPING AND ACCEPTING THE WORK CF CONSTRUCTION OF EN- I.ARGEMENT CF THE OSO SEWAGE TREATMENT PLANT PERFORMED BY BELDENFE S BROTHERS UNDER CONTRACT DATED AUGUST 11 195% AUTHORIZED BY ORDINANCE 110. 2832; AUTHORIZING FINAL PAYMENT IN THE AMOUNT OF $:9,430x31, BEING THE BALANCE OF THE CON- TRACT PRICE OF $37,888,06 AFTER DEDUCTIONS PAYABLE OUT OF NO. 299 IMPROVEMENT BONDS 1950 CONSTRUCTION FUND (SANITANY SEWERS),.IN ACCORDANCE VaTH THE FINAL ESTIMATE ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEBA3: SECTION 1. That the work of construction of enlargement of the Gan Sewage Treatment Plant in the City of Corpus Christi, Texas, per. formed by Heldenfels Brothers, under its contract with the City dated August 1, 1950, as authorized by Ordinance No, 28329 having been per- formed and completed in accordance with the terms and provisions of the contract, plans, and specifications, and the Director of Public Works having inspected the same and certified to the completion of such work in accordance with said plans and specifications, the work afore- said is hereby found to have been completed in accordance with the plans and specifications and is here and now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That the final payment due under the contract men- tioned in Section 1 and as set out in the final estimate dated March 5, 1951" prepared by Freese, Nichols, and Turner, Consulting Engineers, and recom- mended for payment by the Director of Public Works, being the amount of $20,400.31, balance due on the contract price, less deductions of $950 penalty for 38 days delay in construction time and $20 deduction for omission of sodding item, leaving a balance payable of $193430.312 to be made in accordance with the terms of such contract and said amount being payable out of No, 299 Improvement Bonds 1950 Construction Fund (Sanitary Sewers), a copy of such final estimate being attached hereto and made a part hereof. SECTION 3. That the necessity for completion of this project by such acceptance and by the approval of final payment as aforesaid immediate- ly creates a public emergency aid an imperative public necessity requiring -1- .8Oo/ t the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council and the Mayor, having declared such emergency and necessity to exist, re- questing the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
