TO DEDICATE SAID PROPERTY AS A PUBLIC STREET AND TO MZ= ALL INSTRUMENTS REQUISITE TBCHETO; AND DECLARING AN EMERGENCY. WHEREAS, The City of Corpus Christi isthe owner of certain lands hereinafter described; and . WHEREAS, A portion of said property is being used as a public street, but has not been designated for such street purposes or dedicated as a public street; and WHEREAS, By Motion duly passed by the City Council of the City of Corpus Christi, on May 23, 1950, it was agreed to use such tight -o£ -way for street purposes upon the completion of certain im- ` provements by the developers of adjoining subdivisions and as set out in the proposal of H & M Engineering, acting for said subdividers, dated May 233 1950; and , wRzREAs' Said improvements having been made in accordance with the requirements of the Director of Public Works and it being recommended that this property be dedicated for street purposes, it is desired that the same be dedicated as a public street: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TAE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter described property, to -wit: TRACT ONE A Tract of land on the south side of Dellwood No. 2 Addition in the City of Corpus Christi, Texas, being a tract of land 38 feet in width andapproximately 1436.40 feet in length and being the northeast 38 feet of a 4.127 acre tract of land conveyed to the City of Corpus Christi by Herbert J. Jones and Kathryn Heaney Heymann by deed dated November 11, 1949, and recorded in Volume 451, page 312 of the Deed Records of Nueces County, Texas. Paisley's Subdivision of the Hoffman Tract, N 28 deg. 201 48" E 154.89 feet to a•point for the southwest corner of this tract; THENCE Continuing N 28 deg. 20t 48" E with the centerline of Kostoryz Road a distance -of 39.67 feet to a point for the northwest corner of this tract; THENCE S 44 deg. 581 36" E 796.73 feet to a point 138 feet distant from the northeast boundary of Newton Street for an interior comer of this .tract; THENCE southeasterly along a line parallel with and 138 feet distance from the northeast boundary of Newton Street, S 61 deg. 41, 05" E 1131.41 feet to a point for the northeast comer of this tract; THENCE southwesterly, S 28 deg. 18t 55" W 36.00 feet to a point for the southeast corner of this tract; THENCE northwesterly along a line that is parallel with and 100 feet distant from the northeast boundary line of Newton Street N 61 deg. 411 05" W 1136.99 feet a point for an interior comer of this tract, THENCE N 44 deg. 581 36" W 190.90 feet to the PLACE OF BEGINNING. _ TRACT TWO: A Tract of land on the south side of Olsen Addition Section 2 in the City of Corpus Christi, Texas, being a tract of land 38 feet in wdth and approximately 1,265 feet in length and being the northeast 38 feet of a 4.685 acre tract of land con- veyed to the City of Corpus Christi by C.M. Williamson and wife, Elizabeth T. Williamson, and recorded in Volume 440, pages 317, 318 and 319 of the heed Records of Nueces County, Texas. Said tract of land being more particularly described by metes and bounds as follows: BEGMJNG at a point in the center line of Carrol Lane, said point being the intersection of the centerline of Carroll Lane with the southeast extension of the south- west boundary line of Block "C ", Section 22 Olsen Addi- tion; THE=NCE N 63 deg. 281 30, W with the southwest boundary line of Block "Cu, Section 2, Olsen Addition and its extension, a distance of 1320.55 feet to a point in the centerline of Benton Street for the northwest corner of this tract; - THENCE S 28 deg. 101 20" W with the center line of Benton Street, a distance of 38 feet to a point for the southwest corner of this tract; THENCE S 63 deg. 281 36" E parallel to and 38 feet distant from the southwest boundary line of Block "C ", Section 2, Olsen Addition, a distance of 1320.55 feet to a point in the center line of Carroll Lane for the southeast corner of this tract; THENCE N 26 deg. 102 2CP E with the center line of Carroll Lane a distance.of 38 feet for the northeast cor- ner of this tract and POINT OF BEGINNING, -2- is hereby designated, and shall hereafter be known as, Brawner .- Parkway, and is hereby laid out and established as a public street, and is hereby dedicated to the Public for use as a public street in the City of Corpus Christi, Texas. SECTION 2. That the City Manager of the City of Corpus Christi is hereby authorized and directed for and on behalf of the City of Corpus Christi to dedicate..the above described property for street purposes and to execute all instruments requisite to such dedi- cation hereby made., such dedicating instrument being attached hereto and made a part hereof. SECTION 3. That the necessity of dedicating to the Public the above described property for use as a public street creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution Mall be passed finally on the date of its introduction and that such ordi- nance or resolution diall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and neces- sity to exist, requesting the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
