BE IT ORDAINED BY THE CITY COSP.'CIL OF THE CITY OF CORPUS CHRISTI, TETAS s SECTION 1. That the work of construction of Asphalt Surface , Treatment performed by Heldenfels Brothers, under their contract with the City, having been performed and completed in accordance with the terms and provisions of the contract and the plans and specifications therein contained, said contract having been entered - into on the 26th day of January, 1951, as authorized by Ordinance No. 2976, and the Director of Public Works having inspected the same and certified to the completion of said wort: in accordance with said plans and specifications, and said work aforesaid is - hereby found to have been completed in accordance with the plans - and specifications and is here now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract and as set out in the final estimate attached hereto and made a part here- ' ' of, prepared by the Director of Public 'corks, dated 13ly 10,- 1951, in the sum of $10,201.14, the balance of a total contract price of ,288,147.33, be made from No. 296 Improvement Bonds 1950 Construc- tion Fund (Street Improvement) in accordance with the appropriate ordinance. SECTION 3. That the necessity for completion of such project by said acceptance and final payment immediately creates a public emergency and an imperative public necessity requiring the euspen- sion of the Charter rule providing that no ordinance or resolution -1- shall be passed finally on the date it is introduced and that Wch ordinance or resolution shall be read at three several meetings of the City Council, and the layor, having declared that such emergency and necessity exist, requesting that such Charter rule be suspended and that this ordinance be passed,£inally on the date of its intro- duction and take effect and be in full force and effect from and after its passage, IT IS ACCORDII?GLY SO ORDAIIM. A ^EST: City Secretary APPROM AS TO "GAL PORE: City Attorney -2- r4YCLE je-w vt "- The City of Corpus Christi, Texas Corpus Christi, Texas 195 TO THE 7TMERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at.three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
