MI— PREAS, The City Council of the City of Corpus Christi
heretofore has deemed it necessary for and approved plans and
specifications for the construction of an extension to the sani-
tary server system of the City of Corpus Christi, said extension
being a sanitary sewer rain in Carroll Lane from Uouston Street
to YcArdle Road in the City of Corpus Christi, Texas; and,
MP7,REAS, The Civy Council has determined that it is to the
best interest of the City of Corpus Christi, Texas, to finance
the said construction of said sewer main by the issuance of san-
itary sewer system revenue warrants; and,
`rMRPAS, On January 23, 1951, a contract was awarded to
Ifayne L. Rea for the construction of said sewer system extension
in accordance with the plans and specifications and the contract
documents on file in the office of the City Seorotary, and the
said Mayne L. Iise has performed said contract and the said work
has been accepted by tae Director of 'rublic .forics of the City of
Corpus Christi, who has issued his certificate of completion on
said work; and,
'..T =MA.S, By Ordinance, dated January 23, 1951, the City
Council of the City of Corpus Christi, Texas, authorized the exe-
cution of the above- desoribed contract with Wayne L. Rea as con-
tractor, and appropriated the actual cost of such extension to
be paid for by the issuance of warrants, as provided in said
Ordinance, and said Ordinance provided for the issuance of "City
of Corpus Christi, Texas, Second Lien Sanitary Sewer System
Revenue Vorrants, Series 1951," in the aggregate sum of $26,30LJ.10,
or the increase or decrease to such contract amount by the appli-
cation of the unit bid to the work actually done and as finally
determined by the Director of iublic ',*iorks of the City of Corpus
Christi, Texas, and provided that warrants would be issued in a
series of one to six, both inclusive, and of denominations as fol-
I—s: Fumbers 1, 2, 3, 4, and 5 to each be in the sum of 3,000.00
and Number 6 to be in the amount of ;1,304.10 or in such amount in
excess of 125,000.00, as the Director of Public Works shall find
the actual cost of such extension of the sanitary sewer system to
be; and,
'.7 MMS, Such work has been completed and accepted and the
Director of Public Works has determined the actual cost of such
extension to be in the amount of ,,2LI,L51.60, and that it is nec-
essary that the series of said warrants shall be changed so that
they shall be numbered one to five, both inclusive, and that they
shall be of denominations as follows: Numbers 1, 2, 3, and 4
s::all each be in the sum of ?5,000.00, and Plumber 5 shall be in
the amount of 04,451.60, that the maturity of said warrants s_iall
be as follows: Warrant 17o. 1, on or before one year from date of
issue; Narrant 11o. 2, on or before two years from date of issue;
Warrant No. 3, on or before three years after date of issue;

that except as changed in the amount and number of said warrants,
the said warrants shall be in all respects as the warrants author-
ised by Ordinance No. 2979, passed and approved by the City Council
of the City of Corpus Christi, Texas, on the 23rd day of January,

SECTION 1. That the work of constructing a sanitary sewer
main in Carroll Lane from rouston Street to YcArdle Road, to

serve South Park Subdivision to the City of Corpus Christi, and,
doing all the work incident thereto, all as provided for in the
plans and specifications for such sanitary sa}+er main, and having
been performed and completed in accordance with the terms and pro-
via ions of that certain contract, made end entered into on the
25th day of January, 1951, and the plans and specifications there-
in contained and a part thereof, said contract being between the
City of Corpus Christi, Texas, and 'Rayne L. Rea, Contractor, and
the Director of Public Works of the City of Corpus Christi having `
examined, measured, and caused to be tested the finished sanitary
sewer main, all as provided in the terms of said contract and the
plans and specifications contained therein, and said Diroctor of
Public works having found that such sanitary sewer main has been
constructed and completed in full compliance with the terms and
provisions of said contract, and the plans and specifications
therefor, and having approved and accepted said work and said san-
itary sewer main and 'having heretofore issued his Certificate of

mended that such City Council accept and receive said sanitary
sewer main and the work done thereon by the said Jayne L. Rea,
Contractor, the said work and sanitary setter main are hereby found
to have been performed and completed by Nay— L. Rea, Contractor,
in full compliance with the terms and provisions of said contract,
and the plans and specifications therefor, and the same are here
now accepted and received by the City Council of the City of
Corpus CAxisti, Texas.
SECTION 2. That the Mayor and City Secretary of said City
are hereby authorized and directed to issue to Wayne L. ilea, "City
of Corpus Christi, Texas, Second Lien Sanitary Sewer System
Revenue tIarrants, Series 1951," in the aggregate sum of 424,451.60,
which by the terms of said contract, the City of Corpus Christi,
' Texas, has agreed and obligated itself to issue to the said ilayne

L. Rea. it appearing to the City Council that such sum is the ,
actual amount due for the construction of said sanitary sewer main
and that said warrants shall be issued in a series to be numbered
one to five, both Linclusive, of denominations as fall —.: IRmibers

for and authorized by said ordinance other than as hereby changed

The City of Corpus Christi, in the County of Nueces, in the State of Texas, for
value received, hereby acknowledges itself indebted to and promises to pay to Wayne L. Rea,
of Nueces County, or his order, on or before years from date hereof, the sum of
funds as are, on said data, legal tender for debts due the U DOLLARS in such
Sates of America, with
interest thereon from date at the rate of four and one -half (4,M per cent per annum, pay-
able annually on the anniversary of the ,Iam date hereof until the principal a shall be paid,
both principal and interest being payable at the office of the City Treasurer, in the City
of Corpus Christi, Texas.
This warrant is subject to the condition and every holder hereof by accepting
the same agrees with obligor and every subsequent holder hereof that the obligor and any
agent of obligor may treat the holder of this warrant as the absolute owner hereof for all
purposes and shall not be affected by any notice to the contrary and that the surrender of
this warrant to the obligor or any agent of obligor shall be a good discharge to the obligor
for the same.
This warrant is one of a series of warrants of like tenor and effect except as to
denomination and maturity, numbered One (1) to Five (5) both incluaivel Nos. 1 through 4,
inclusive, being in the principal sum of $5,000.00 each and No. 5 being in the principal
sum of $4,451.60. The aggregate sum of said warrants of $243451.60 being in payment of the
actual cost of a sanitary sewer extension to the City of Corpus Christi, Texas, as author-
ized by Ordinance No. 2979, passed and approved January 23, 1951, as finally found and
determined by the Director of Public Works of the City of Corpus Christi,Texaei and all of
said warrants are issued by the City of Corpus Christi, Texas, for the purpose of securing
funds to construct an extension of the Sanitary Sewer System of the city.
This warrant and the series of which it is a part constitutes special obligations
of the City of Corpus Christi, Texas, payable only out of the revenues of the City of Corpus
Christi Sanitary Sewer System, after the deduction of reasonable operation and maintenance
expense and all other expense payments and deductions provided and allowed by the Statutes
of Texas in regard to the issuance of warrants and bonds pledging the revenues of Water and
Sewer Systems of cities, and the payment of the amounts required for the payment of the
following described bonds, the bond fund, the sinking fund and all other payments required
in- connection with "City of Corpus Christi, Texas Sanitary Sewer System Revenue Bonds,
Series 1935 ", and the deed of trust securing the same in accordance with the provisions of
Ordinance No. 559, passed and approved by the City Council of the City of Corpus Christi,
Texas on November 4. 19351 and this warrant, and all of the series of which it is a part,
is second and inferior to the said "City of Corpus Christi, Texas, Sanitary Sewer System
Revenue Bonds, Series 1935 ", and the lien securing this warrant, and the series of which
it is part is second and inferior to the liens securing the said *City of Corpus Christi
Sanitary Sewer Revenue Bonds, Series 1935 ". The holder hereof shall never have the right
to demand payment of this obligation out of any funds raised *or to be raised by taxation.
And it is hereby certified that the issuance of this warrant and the series of
which it is a part, is duly authorized by law; that all acts, conditions and things re-
-•: quired to exist and to be done precedent to and in the issuance of this warrant to render
i= the same lawful and valid have been done.
` IN TESTIMONY WHEREOF, The City Council of the City of Corpus Christi, Texas, has
caused -the seal of the said City to be impressed hereon and this warrant to be signed by

The said warrants shall be signed by the Keyor and attested
by the City Secretary and shall be payable and shall have all the
provisions, except as changed herein, as provided in the said
Ordinance No. 2979, passed and approved by the City Council of
the City of Corpus Christi, Texas, on the 23rd day of January,
1951, and after the said warrants have been executed in the name
of said City by the L•'ayor and City Secretary thereof and impressed
with the seal of said City and dated as of the date hereof, the
said officers are hereby authorized and &rected to deliver the
said warrants to the said Wayne L. Rea. -
SECTION 3. The fact that the sanitary sewer main is badly
needed to service and serve South Iark Subdivision and the area
adjacent to Carroll Lane and will aid in preserving the health
and will promote the public welfare of the inhabitants of the
area adjacent to said sanitary sewer main creates a public emer-
gency and an imperative public necessity, requirinZ the suspen-
sion of the Charter Rule or regiirement that no ordinance or reso-
lution shall be passed finally on the date of its introduction,
and that said ordinance or resolution shall be read at three sepa-
rate meetinCs of the City Council, and the Mayor having declared
that such emergency and public imperative necessity exist, and re-
quired that said Charter Rule be suspended and that this Ordinance
be passed finally on the date of its introduction, and take effect
and be in full force and effect From and after its passage, IT IS
ACCORDINGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at.three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
