HomeMy WebLinkAbout03044 ORD - 05/22/1951AN ORDINANCE AUTHORI71N0 AND DIRECTING THE CITY MANAGER AND TIE CITY ATTORNEY OF TIE CITY OF CORPUS CHRISTI ' FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO MARE APPLICATION TO THE BOARD OF WATER ENGINEERS OF TIE STATE OF TEXAS FOR PERMIT TO APPROPRIATE THE WATERS DISCHARGED FROM WELLS OF THE LONER NUECES RISER WATER SUPPLY DISTRICT INTO TRIBUTARIES OF THE NUECES RISER FOR ACCOUNT OF TIE CITY OF CORPUS CHRISTI AND TO USE THE BED AND BANKS OF SUCH STREAMS FOR THE PURPOSE OF TRANSPORTING AND D=VERING SAID WATER INTO TIE RESERVOIR OF TEE CITY CREATED BY MATHIS DAM, SUCH APPLICATION TO HE IN THE FORM ATTACHED HERETO AND MADE A PART HEREOF; AND DE- CLARING AN EMERGENCY. BE IT ORDAINED BY TIE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEAS: SECTION 1, That the City manager and the City Attorney of the City of Corpus Christi for and on behalf of the City of Corpus Christi be, and they are hereby authorized and directed to make application to the Board of Water Engineers of the State of Texas for permit to appropriate the waters discharged from wells of the Lower Nueces River Water Supply District into tributaries of the Nueces River for account of the City of Corpus Christi and to use the bed and banks of such streams for the purpose of trans- porting and delivering said water into the reservoir of the City created by Matins Dam, such application to be in the form attach- ed hereto and made a part hereof; and _' SECTION 2. That the necessity cfmaking the aforesaid application in order to assure the delivery of water to the City of Corpus Christi from the wells of said Lower Nueces River Water Supply District, being of the greatest public importance to the health,safety, and general welfare of the General Public, creates a public emergency and an imperative public necessity requiring the auspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meet- ings of the City Council, and the Mayor, having declared such em- ergency and necessity to exist, having requested the suspension ice'.+ sue' of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in fall force and effect from and after its passage$ IT IS ACCORDINGLY SO ORDAD:ED. Lowman —�� TEE STATE OF TEXAS p COUNTY OF NUDGES TO THE BOARD OF WATER EM31 RS FOR THE STATE OF TEXAS: The CITY OF CORPUS CHRISTI, a Home Rule city and municipal corporation organized under the Home Rule Amendment to the Constitution and the enabling statutes thereunder of the State of Texas, acting by and through its City Manager, and , its City Attorney, whose post office address is Municipal Building, Corpus Christi, Texas, being hereunto duly authorized by the governing body of said city, makes this application to appropriate and divert not exceeding acre - feet of water per annum delivered into the Atascosa River, a tributary of the Nueces River, from wells adjacent to the Atascbsa River and Borregos River, a tributary thereof, by LQ•ICR NUECES RIVER WATER SUPPLY DISTRICT, a munici- pal corporation with all the powers of a Water Supply and Control District, which District was duly created by Act of the Legislature of the State of Texas (Acts 51st Legislature, Ch. 159), under contract between applicant and said District dated November 16, 1950, a copy of which is filed herewith; and to use the bed and banks of the above -named streams for the purpose of trans- porting and delivering said water into the reservoir of the City created by the Mathis Dam. Applicant has the right to take and appropriate in excess of 500,000 acre -feet of water per annum from said source of supply by virtue of certified filing No. 64 filed with this Board on April 221 1914 and Permit No. 51 issued February 19, 1915, Permit No. 933 dated October 31, 19271 as amended by Permit No. 1463 dated August 19, 1945, and Permit No. 1177 dated October 20, 1931, and has perfected its right of appropriation under said permits and by means of the impounding and diversion works therein described for the purpose of domestic and municipal, manufacturing, mining, recreation and irrigation purposes. The purpose for which the water herein applied for is to be used is domestic and municipal purposes. The location of the proposed wells is as follows: (Here give the location of each well by number by reference to a line of an original survey bordering on the named stream; also give name and address of the owners of land upon which the proposed wells and points of discharge will be located) The respective points of delivery will be at the points on the stream opposite each well. J The water will, in accordance with the terms of the aforesaid contract, be and become the property of applicant upon delivery into the respective water courses. The water will be stored in the applicant's dam and diverted therefrom by gravity to the City filtration plant, and from thence by pumping to the City's system by means of the works described in the aforesaid Permits. All construction work has been completed for the taking and diversion of said water. Wells Nos. _, _, and have been com- pleted, and Wells Noe. and will be completed within 90 days from this date, and application of the appropriated water to the proposed use Will be made immediately upon completion. The accompanying maps and plate show the location of the respective wells and the location of the diversion works are shown on the maps accompanying the applications upon uhich said Per - wits were granted.
