AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND
ON BEHALF OF TEE CITY OF CORPUS CHRISTI TO EXECUTE
A CONTRACT AITH HELDENFEIS BROTHERS FOR THE PURPOSE
OF CONSTRUCTING STREET IMPROVEMENTS ON PORT AVENUE
FROM MORGAN AVENUE TO WEST BROAUTRY, BY CONSTRUCT -
ING CURBS AND SIDEWALKS THEREON AS MORE PARTICULARLY
DESCRIBED IN SUCH CONTRACT, MADE APART HEREOF BY
REFERENCE, ON FILE IN 9HE OITIVE OF ME CITY SECRETARY;
THE CONTRACT PRICE FOR SAID CONSTRUCTION BEING IN THE
AMOUNT OF 4432,119.43, SUCH AMOUNT TO BE PAID BY ASSESS-
MENT AGAINST THE ABUTTING PROPERTY OWNERS AND THE CITY
OF CORPUS CHRISTI AS PROVIDED IN SAID CONTRACT, THE
AMOUNT OF $29+161.90 BEING, ASSESSED AGAINST ABUTTING
PROPERTY OWNERS AND THE AMOUNT OF ;2,957.53 TO BE PAID
BY THE CITY; APPROPRIATING 'x~$,169.47, BEING THE AMGUNT
OF 42,957.53 FLUS 43,211.94, (BEING TEN PER CENT OF THE
CONTRACT PRICE, FOR ENGINEERING AND CONTINGENCIES)
FROM THE FOLLOWING FUNDS; 42,072.95 TO DE PAID FROM NO.
208 SIDETMLP. CONSTRUCTION FUND, $1,349.27 TO BE PAID
FROM NO. 220 STREET IMFP-OV&MWT CONSTRUCTION, AND
x`+2,947.25 TO BE PAID FROM 3110. 296 I'MPROVEMENT BONDS
1950 CONSTRUCTION FUND (STREET IMPROVEMENTS), AND DE-
CLARIBG AN EMERGENCY.
WHEREAS, The City Council of the City of Corpus Christi, Texas,
did on the 29th day of May, A. D., 1951s by duly enacted ordinance, deter-
mine the necessity for and ordered the improvement of portion of Port
Avenue from Morgan Avenue to West Broadway within the City of Corpus Christi
by the construction Of curbs and sidewalks along said streets, the im-
provements being more particularly described in said ordinanoe, which
descriptions are here referred to and made a part hereof; and that such
improvements were ordered to be made in the manner and according to
the plans and specifications heretofore approved; and
{idaRsEAS, The duly executed notice of said ordinance having
been filed in the name of said City with the Clerk of Nueoes County,
Texas, on the 29th day of May, A. D., 1951, and
YiHEREAS, Said City Council of the City of Corpus Christi,
Texas, having advertised for and received bids on the construction of
said improvements for the length of time and in the manner and form as
required by the Charter of said City and the laws of the State of Texas;
and

WHEREAS# the bid of Heldenfels Brothers was the lowest and
Est advantageous bid received; and
WHEREAS# The Director of Finance has advised this Council
that the City Treasurer of the City of Corpus Christi has on deposit
the necessary and proper funds which have not been appropriated for
any other purpose# and which are available for the payment of the City's
proportionate share of the cost of improvements of said portion of said
street and engineering costs and contingenciest
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHPSSTI, TEXAS:
SECTION I. That the City Manager for and on behalf of the
City of Carpus Christi be and he is hereby authorized and dLrected to
execute a contract for the construction of curbs and sidewalks on Port ,
Avenue from Morgan Avenue to West Broadway with Heldenfels Brothers#
which contract has been awarded said Heldenfels Brothers in accordance
With plans and specifications and contract documents# which are made
a part hereof and attached hereto and which documents are on file in
the office of the City Secretary of the City, and according to the bid
of said Heldenfels Brothers# opened on the 8th day of May, 19$1# said _
bid being the most advantageous# and lowest# to the City of Corpus
Christi; the contract price for said construction being in the amount
of $32,119.43# such amount to be paid by assessment against the abut-
ting property owners and the City of Corpus Christi as provided in said
contract, ,ftI61.90 to be assessed against property owners and the balance
Paid by the City.
< SECTION II. That there is hereby appropriated $6,169.4,
being the amount of $2 #957.53 as the City's proportionate part of the
contract price plus $3,211.94 (ten per cent (lwm) of the contract price)
for engineering and contingencies# from the following funds: $2,072.95
to be paid from No. 208 Sidewalk Construction Fund, $1,149.27 to be paid
from No. 220 Street Improvement Construction Fund, and $t.947.25 to be
Paid from No. 296 Improvement Bonds 1950 Construction Fund (Street Im.
provements).
SECTION III. The fact that the aforesaid portion of Port,
Avenue does not have sidewalks and the further fact that sidewalks along
said streets are necessary to the health and public welfare of the in-
habitants of said City because of the heavy traffic along said streets
creates a public emergency and an imperativepublic necessity requiring
the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction and that such
ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor, declaring such emergency and necessity,
haying requested the suspension of said Charter rule and that this ordi-
nance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS AC-
CORDD*iGLY SO ORDAINED.

I certify to the City Council that the money required
for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No. 9 In
Fund from which it is`groposed to be drawn, and such money is not
appropriated for any other purpose.
