SAID PROPERTY CR IN SAID PROCEEDINGS CONCERNING SAID
ASSESSMENTS AND PROCEEDINGS; DIRECTING THE CITY SECRETARY
OF THE CITY OF CORPUS CHRISTI, TEXAS, TO GIVE NOTICE OF
SAID HEARING AS REQUIRID BY THE IALNS OF THE STAM OF TEXAS
AND THE CHARTER OF THE CITY OF CORPUS CHRISTI; AND FURTHER
DIRECTING THE SAID CITY SECRETARY, IN ADDITION TO THE
NOTICE OF SAID HEARINM AS REQUIRED BY LAW, WHICH SHALL BE
VALID AND SUFFICIENT IN ITSELF, TO INCLUDE THEREIN A LIST
OF THE APPARENT OWNERS AND DESCRIPTIONS OF SAID ABUTTING
PROPERTY SET OUT IN SAID DIRECTOR OF PUBLIC NORKS' RFPCRT,

WF1MAS, The City Council of Corpus Christi, Texas, heretofore
on the 29th day of May , 1951, by duly enacted Ordinance, deter-
mined the necessity for and'ordered the improvement of a portion of Port
Avenue within the City of Corpus Christi by the constructing of sidewalks,
curbs and gutters along same, within certain limits as fully described in
said Ordinance in the manner and according to the plans and specifications
heretofore approved and adopted by the City Council thereof, and a duly
executed Notice of said Ordinance having been filed in the name of said
City with the County Clerk of Nueces County, Texas, on the 29th day
of mm; , A. D., 1951; and

WEREAS, Said City Council of the City of Corpus Christi,.hav-
ing advertised for and received bids on the construction of said improve-
ment for the length of time and in the manner and form as required by the
Charter of said City and the laws of the State of Texas, and also having
duly and regularly made appropriation of funds available for such purpose
to cover the estimated cost to said City of said improvements, all as
provided by the Corpus Christi City Charter and by law, and having awarded
a contract for the construction of said improvements to Heldenfels Brothers,
on their lowest and most advantageous bid and said contract having hereto-
fore been duly executed by said City of Corpus Christi, Texas, and Heldenfels
Brothers, and is dated May 29, 1951, and the performance bond required by
said contract having been properly furnished and posted by said Heldenfele
Brothers and accepted by said City Council of said City as to form and
amount 'as required by the Charter of said City and the laws of the State of
Texas, and ,
WHEREAS, The said City Council has caused the said Director of
Public Works to prepare and file estimates of the cost of such improvements
and estimates of the amounts per front foot proposed to be assessed against
the property abutting upon said street to be improved and against any rail-
ways, street railways, and interurbans using, occupying or crossing same,
and the real and true owners thereof, and said Director of Public Works
has heretofore filed said estimates and a statement of other matters relat-
ing thereto with said City Council, and the same have been received and
examined by said City Council; and
WHEREAS, In accordance with said statement of estimates and other
matters prepared and filed by said Director of Public Works which concern
and are directed to those certain portions of said street described in said
Ordinance No. 3051 , which are herein approved by said City Council,
the estimated total cost of the whole improvement on portions of said street
within the limits described in said Ordinance No. 3051 is $32,119.43;
the estimated amount per front foot proposed to be assessed against each
abutting property between West Broadway and Comanche Street and the real
true owner thereof for 41 wide sidewalks is $1.52 per lineal foot; the
estimated amount per front foot proposed to be assessed against each
abutting property between Comanche Street and Agnea:Street and the real and
true owner thereof for 5' wide combined sidewalk and curb is $2.175 per
lineal foot, the estimated amount per front foot proposed to be assessed
against each abutting property between Agnes Street and Ruth Street and the
real and true owner thereof for S' combined sidewalk and curb is $3.36
per lineal foot; the estimated amount per front foot proposed to be assessed
against each abutting property between Ruth Street and Morgan Street and
the real and true owner thereof for 41 wide sidewalk and separate curb is
$2.57 per lineal foot; the estimated total cost of said improvements to be
assessed against said abutting property and the real and true owner thereof
is the amount of $a9.14L.90; the estimated total cost of said improvements
to be constructed between rails, turnouts and switches and two feet on each
aide thereof of any railways, street railway or interurban using, occupying,
or crossing said street proposed to be assessed against said railways,
street railways or interurban and the real and true owners thereof is
$2.926.01 ; and the estimated total cost of said improvements to
be paid by the City of Corpus Christi, including cost as a property owner,
is $2,957.53; and
WHEREAS, According to said written statement of said Director of
Public Works, the names of the apparent owners of said abutting property
and number of front feet owned by each, the description of their property,
and the amount proposed to be assessed against each abutting property and
the real and true owners thereof and other matters contained in said state-
ment are as set forth therein, all of which is incorporated herein and made
a part hereof by reference and are on file in the office of the City
Secretary of the City of Corpus Christi:
NON, THEREFORE, BE IT ORDAINED Br THE CITY COUNCIL OF THE CITY
OF CO3PCS CHRISTI, TEXAS:
SECTION 1. That the written statement and report of the Director
of Public Works, heretofore filed with the City Council, and showing the
estimated total cost of the whole improvement of a portion of Port Avenue
within certain limits as described in Ordinance No. 3051 , passed
on May 29th 1951, which declared the necessity for such improvements,
are hereby accepted and approved; the estimated amount per front foot pro-
posed to be assessed against the abutting property and the real and true
owners thereof on said street for construction of sidewalks, the estimated
amount per front foot proposed to be assessed against the abutting property
and the real and true owners thereof on said street for construction of
combined sidewalk and curb, the estimated amount per front foot proposed to
be assessed against the abutting property and the real and true owners
thereof on said street for construction of sidewalks and separate curbs;
the estimated total amount to be assessed against the abutting property and
the real and true owners thereof on said street for improvements; the total
estimated amount to be paid,by'the City of Corpus�Christi, Texas, including
cost as a property owner; the names of the apparent owners of the property
abutting on said street within the limits above defined, with the number of
front feet owned by each and the description of their property, having been
received and examined by the City Council, said report is hereby in all
things approved and adopted.
SECTION 2. That it is hereby found and determined that the esti-
mated total cost of the whole improvement on a portion of said street with-
in the limits of said description as set forth in said Ordinance No. 3051
is $32,114.43; the estimated amount per front foot proposed to be assessed
against each abutting property between West Broadway and Comanche Street
and the real and true owner thereof for 41 wide sidewalks is $1,52 per
lineal Poet; the estinated amount per front foot proposed to be assessed
against each abutting property between Comanche Street and Agnes Street and
the real and true owner thereof for 51 wide combined sidewalk and curb is
$2.175 per lineal foot; the estimated amount per front foot proposed to be
assessed against each abutting property between Aghes Street and Ruth Street
and the reel and true owner thereof for 81 combined sidewalk and curb is
$3.36 per lineal foot; the estimated amount per front foot proposed to be
assessed against each abutting property between Ruth Street and Morgan
Street and the real and true owner thereof for 41 wide sidewalk and separate
curb is $2.57 per lineal foot; the estimated total cost of said improvements
to be assessed against said abutting property and the real and true owner
thereof is the amount of $29,161.90; the estimated total cost of said
improvements to be constructed between rails, tumouts and switches and
two feet on each side thereof of any railways, street railway or inter-
urban using, occupying, or crossing said street proposed to be assessed
against said railways, street railways or interurbans and the real and
true owners thereof is 02,926.01 ; and the estimated total cost of
said improvements to be paid by the City of Corpus 6hristi, including coat
as a property owner is $2,957.53;
SECTION 3. That the costa of said improvements shall be paid
and assessed against the property abutting upon said street within the
limits above defined, and any railways, street railways or interurban,
using, occupying or crossing same, and against the real and true owners
thereof in accordance with, and in the manner provided by the Charter of
the City of Corpus Christi, Texas, and by the Acts of the 40th Legislature
of the State of Texas, First Called Session, Chapter 106, and known and
shown as Article 1105 -b of Vernon's Annotated Civil Statutes of Texas, and
that a portion of the costs of said improvements shall be paid and defrayed
by the City of Corpus Christi, Texas, in accordance with Ordinance No.
3051 , the laws of the State of Terms, and as stated above, and that
the total cost of said improvements shall be and are hereby apportioned
between said parties and shall be paid and defrayed as follows:
(a) The cost of constructing sidewalks, curbs and gutters within
the area between and under rails, tracks, double tracks, turnouts, and
switches, and two feet on each side thereof, of any railroad, street rail-
road, or interurban using, occupying or crossing such street or portion
thereof hereby ordered improved, stall be paid by the respective owners
thereof, and assessed against such railroad, street railroad, or interurban,
and its road bed, ties, rails, fixtures, rights and franchises, and the
real and true owners thereof, in the manner provided by the terms of the
City Charter of the City of Corpus Christi, Texas, and by said Acts of the
40th Legislature of the State of Texas (1927) above identified.
(b) The City of Corpus Christi will pay all engineering costs
incurred in establishing the line and grade of all sidewalks, curbs and
gutters to be constructed pursuant to this ordinance, and shall pay not
more than the balance of the total remaining cost of such improvements
over and above that amount assessed against the property abutting upon
said street within the limits ae above defined, and the real'and true
owners thereof. The City shall also pay the cost of such improvements
on comer lots between the intersection of easement lines and the curb
to which they are immediately adjacent. The City as a property owner
shall pay the cost of improvements for which it may be assessed by
reason of City property abutting said improvements.
(c) The property abutting upon said street within the limits
above defined and the real and true avers thereof, shall be assessed and
pay not to exceed the total cost of constructing of the sidewalks, curbs
and gutters along a portion of said street to be improved, as described
and designated in said ordinance No. 3051 , exclusive of the amount
thereof herein specified to be paid by any railway, street railway, or
interurban, as set out in sub- section (a) above, and by the City of Corpus
Christi as set out in sub- section (b) above.
The amounts payable by the abutting property and the real and
true owners thereof shall be assessed against such property and the real
and true owners thereof and shall constitute a first and prior lien upon
such abutting property and a personal liability of the real and true owners
thereof, and shall be payable as follows, to-wit: The amounts of said
assessments shall be due and payable in five (5) equal annual installments,
the first of which shall be due and payable twenty (20) days after the date
of said improvements are completed and accepted by the City Council, and
the remaining four (4) installments to be due and payable, respectively,
one (1), two (2), three (3) and four (4) years from and after the date of
acceptance, together with interest thereon from said date of acceptance at
the rate of five percent (5 %) per annum, payable annually; provided, howh
ever, that the owners of said property shall have the privilege of paying
any one of, or all of, such installments at any time before maturity there-
of by paying the total amount of principal due, together witlh interest
accrued, to the date of payment; further, that if default be made in payment
of 'any of said installments of principal or interest, promptly as same
matures, than at the option of the - contractor, or assigns, the entire
amount of the assessment upon which such default is made shall be and
become immediately due and payable, together with reasonable attorney's
fees and collection on sts, if incurred; however, it is specifically
stipulated and provided that no assessment shall in arty case be made
against any property or the real and true owners thereof in excess of the
special benefits to accrue to such property in the enhanced value thereof
resulting from said improvements. .
SECTION 4. That a hearing be given to the real and true owners
and all owning or claiming any interest in any property abutting upon said
portion of said street as defined heretofore, and in any railway, street
railway, or interurban occupyin or crossing same, and to all others owning,
claiming or interested in sroperty, railway, street railways, or inter-
. urbane, or any of said matters as to the assessments and to the amount to
be assessed against each parcel of property and the real and true owners
thereof, and as to the special benefits to said property to be received
from said improvements, if any, or concerning any error, invalidity, irregu-
larity or deficiency in any proceedings or contract with reference thereto,
or concerning any matter or thing connected therewith, which hearing shall
be held by the City Council of said City in the Council Chamber of the City
Hall in the City of Corpus Christi, Texas, at 4 or clock P.M, on the 26th
day of June A, D„ 1951, at which time all persons, firms, corporations,
or estates, owning or claiming any ouch abutting property, railways, street
railways or interurbans, or any interest therein, and their agents or
attorneys, or persons interested in said proceedings are notified to appear
and to be heard in person or by counsel and may offer evidence, and said
hearing shall be adjourned from day to day and from time to time and kept
open and reopened until all protests have been duly heard; and the City
Secretary of the City of Corpus Christi, Texas, is hereby directed to give
notice of said hearing by publication in the Corpus Christi Caller Times,
the official newspaper of the City of Corpus Christi, which is a daily news-
paper of general circulation in the City of Corpus Christi, Texas, and said

notice shall be published at least three times in said newspaper before
the date set for said hearing, the first of which publications shall be
at least ten days prior to the date of said hearing, and such notice of
publication shall be valid and sufficient without further form of notice,
as provided for and in accordance with the terms and provisions of said
City Charter and of Chapter 106 of the Acts of the First Called Session
of the 40th Legislature of the State of Teas, known and shown as Article
1105 -b of Vemonts Annotated Civil Statutes of Texas, and said City
Secretary is flrrther directed, in addition to the notice of said hearing
as required by law, which shall be for all'parposes valid and sufficient
in itself, to include therein the list of the names of the apparent owners
` of said abutting property as set out in said City Engineerws report,
provided, however, the said list of apparent owners so included in said
notice, shall merely be cumulative of and in addition to the requirements
of said notice as provided by the laws of the State of Terms, and the
Charter of the City of Corpus Christi, Texas, and shall not in any manner
be conclusive of the real and true owners of said abutting property nor
limit said notice to such apparent owners named therein, but said notice
shall nevertheless be directed to the real and true owners of said abutting
property, whether named or correctly named therein or not, and to all others
claiming, owning, or interested in any manner in any ,of said abutting
property on said street within the limits described.
SE:T_ION 5. That following such hearing as above provided, assess-
ments will be levied against said abutting property and the real and true
owners thereof for that portion of the cost of said improvements determined
to be payable by said abutting property and the real and true owners thereof
as hereinabove set out, and shall be a first and prior lien upon said
abutting property. In levying said assessments, if the name of the owner
be unknown, it shall be sufficient to so state the fact, and if said abutting
property be owned by an estate or by any firm or corporation, it shall be
sufficient to so state the fact, and it shall not be necessary to give the
correct name of any suds owner, and no error or mistake in attempting to
name any such owner or in describing any of said property shall invalidate
any assessment or certificate issued in evidence thereof, but nevertheless
the real and true owner of said abutting property shall be liable anA the
assessment against said property shall be valid whether or not such owner
be named or correctly named.
SECTION 6. The fact that portions of certain streets within the
City of Corpus Christi, as above described, do not have sidewalks, curbs and
gutters, and the further fact that sidewalks, curbs and gutters along said
street are necessary to the health and public welfare of the inhabitants
of said City because of the increased traffic along said street, creates a
public emergency and public imperative necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally
on the date it is introduced and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor, having
declared such emergency and necessity to exist, requesting that such Charter
rule be suspended, and that this ordinance be passed finally on the date
of its introduction and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen;
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at.three meetings of the
City Council, I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

owners of the abutting property on Port Avomu from the south boundary line
of west Broadway to the north boundary line of Morgan Avenue, showing the number
of front feet owned by each, tba description of their properly, and the amount
proposed to be assessed against each abutting property and the real and true
owners thereof. The cost of a four foot sidewalk abutting the property between
West Broadway, and Comanche Street is assessed against each abutting property.
The cost of a five foot combined sidewalk and curb abutting the property is
assessed against each abutting property between Comanche Street and Agnes Street.
The cost of an eight foot combined sidewalk and curb abutting the property is
assessed against each abutting property between Agnes Street and Ruth Street.
The cost of a four foot sidewalk and separate curb abutting the property is

COUNTY OF NUECFS Q KNOW ALL ZEN BY THWE PRESENTS: .
WHEREAS, by Ordinance No. 3051 adopted on the 29th day of May,
1951, by its City Council, the City of Corpus Christi, Texas, hereinafter
called tlUtVii determined the necessity for, and ordered the improvement
of Port Avenue by constructing sidewalks, curbs and gutters along that
portion of Port Avenue from the south boundary line of West Broadway to
the horth boundary line of Morgan Avenue in said City between 19m;i.ts in
said Ordinance defined, and provided that a part of the cost of such
improvement be assessed and made a lien upon property abutting thereon;
WHEREAS, a Notice of such action on the part of said City was duly
filed in the office of the County Clerk of Nueces County on the 29th day
of May, 1951, and recorded in Volume. 517 Page 171 , of the Deed Records
of said County; and
WHEREAS, by Ordinance No. 3056, passed by said City on the 29th day
of May, 1951, and other proceedings of said City Council, there was levied
an assessment against property abutting along certain streets within limits
therein defined and against the real and true owners thereof, said sections
of said streets being defined as follows, to wit:
That portion of Port Avenue extending from the south boundary
line of West Broadway to the north boundary line of Morgan
Avenue.
WHEREAS, the improvements on said streets were not constructed by
Heldenfels Brothers and the said contract has been duly terminated, and no
valid lien is in fact in existence;
NOW, THEREFORE, The said City in consideration of the premises
does hereby RELEASE said property and each and all of the said lots and
blocks fromrtrhe said purported liens securing the payment of said
assessments and the respective owners of said property from all personal

liability created by the issuance of said ordinances and the other pro-
ceedings of said city above referred to, and declaring said special
assessments of no force and effect.
