ACCEPTING A GRANT OFFER AND AUTHORIZING THE -
EXECUTION OF ME GRANT AGREE NT TO BE SUB-
MITTED TO TEE ADMINISTRATOR OF CIVIL AERONAU-
TICS, UNITED STATES DEPARTMENT OF COMMERCE,
TO OBTAIN FEDERAL AID IN THE DEVELOPMENT OF
CLIFF MAUS MUNICIPAL AIRPORT OF THE CITY OF'
CORPUS CHRISTI, TEXAS, A COPY OF SAID AGREE -
MENT BEING ATTACHED HERETO AND MADE A PART
HEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY TBE CITY COUNCIL OF THE CITY OF CORPUS '
CHRISTI, TEXAS:
` SECTION 1. That the City of Corpus Christi, Texas, shall
enter into the Grant Agreement for the purpose of obtaining Federal Aid
in the develcpment of the Cliff Maus Municipal Airport and that such
agreement shall be as set forth hereinbelow.
SECTION 2. That the City of Corpus Christi, Texas, is
hereby authorised and directed to execute said Grant Agreement in six
copies on behalf of the City of Corpus Christi, Texas, and the Sao re- "
tary is hereby authorized and directed to impress the official seal '
of this City of CorpusChristi and to attest said execution.
SECTION 3. That the Grant Agreement referred to hereinabove
.hall be as follows:

SECTION 4. That the fact that it is necessary to have
mediate action on the part of the City of Corpus Christi to
complete its application for Federal Aid in the development of its
Municipal Airport creates a public emergenoy and an imperative
public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the
date of its introduction and that such ordinance or resolution
shall be read at three several meetings of the City Council,
and the Mayor, declaring such emergency and necessity to exists
having requested the suspension of said Charter rule and that
this ordinance be passed finally on the date of its introduction -
and talm effect and be in full force and effect from and after its
passage, IT IS SO ORDAINED.

to accrue to the United States and the public from the accomplishment of the

2. The Sponsor -shall
(a) begin accomplishment of the Project within a reasonable time
!after acceptance of this Offer, and .
(b) carryout and complete the Project in accordance with the terms
of this bffer; "and -the 'Federal• Airport Act and the- Regulations
promulgated thereunder by the Administrator in effect on the
date of this ,Offer, which Act and Regulations are incorporated
herein and made a part hereof, and
(c) carry out and complete the Project in accordance with the plans
- and specifications and property map incorporated herein as they
may be revised or modified with the approval of the Administra-
tor or his duly authorized representatives.
3. The Sponsor shall operate and maintain the Airport as provided in
the Project Application incorporated herein.

5. Any misrepresentation or omission of a material fact by the Sponsor
concerning the Project or the Sponsor's authority or ability to carry
out the obligations assumed by the Sponsor in accepting this Offer
shall terminate the obligation of the United States, and it is understood
and agreed by the Sponsor in accepting this Offer that if a material
fact has been misrepresented or omitted by the Sponsor, the Adminis-
trator on behalf of the United States may recover all grant payments
made.
6. The Administrator reserves the right to amend or withdraw this Offer
at any time prior to its acceptance by the Sponsor.

7. This Offer shall expire and the United States shall not be obligated
to pay any of the allowable costs of thp,Proj"ect unless this Offer
has been accepted by the Sponsor within 60 days from'the above date
of Offer or such longer time as may be prescribed by the Administrator
in writing. ( `

The Sponsor's acceptance of this Offer and fatification and adoption of the Proj-
ect Application incorporated herein shall be evidenced by execution of this in-
strument by the Sponsor, as hereinafter provided, and said Offer and acceptance
shall comprise a Grant Agreement, as provided by the Federal Airport Act, consti-
tuting the obligations and rights of the United States and the Sponsor with respect
to the accomplishment of the Project and the operation and maintenance of the
Airport. Such Grant Agreement shall become effective upon the Sponsor's accept-
ance or trii"s offer and shall remain in full force and effect throughout the useful
life of the facilities developed under the Project but in any event not to exceed
twenty years from the date of said acceptance.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
