AUTHORIZING AND DIRECTING THE CITY MANAGER TO
ACQUIRE THE WEST 25 FEET CF LOT 1-A, APA COOPER
SUBDIVISION OF THE CITY OF CORPUS CHRISTI, FOR
THE PURPOSE OF LOCATING AND OPENING IVEY LANE
TO CONNECT GOLLIHAR AND HORNE ROADS, FROM HAROLD
G. BAILEY BY DEED.-.:7 FOR $387.50; AUTHORIZING
AND DIRECTING THE CITY MANAGER TO EXECUTE THE
INSTRUMENTS NECESSARY TO COMPLETE THE PURCHASE
OF SAID LAND; APPROPRIATING FROM NO. 295 IMPROVE-
MENT BONDS 1.948 CONSTRUCTION FUND (STREET IMPROVE-
MENTS) $387.50 TO COVER THE COST OF SUCH PURCHASE;
AND DECLARING AN EMERGENCY. \\
WHEREAS, It has been deemed desirable to open Ivey Lane to con-
_ nett Gollihar Road and Horne Road to better provide street drainage and
utility service to the areas lying on both sides of said Ivey Lane; and
IMBEAS, Said street has now been dedicated for street purposes
except for the West 25? off of Lot L-A, Ave Cooper Subdivision of the City,
and many dwellings now exists on both sides of the street, such 25 foot
strip being needed to locate said street; and
WHEREAS, The owner of said strip has submitted a proposal to the
City expressing his desire to cooperate in the opening of said Ivey Lane,
and agreeing to a sale price at the actual cost to him for said right-of-
way;
NOW, MPPFCHE, BE IT ORDAINED BY THE CITY COUNCIL OF TIE CITY
OF CORPUS CHRISTI, TEXAS;
SECTIQi 1. That the City Manager be and he is hereby authorized
and directed to acquire, that certain right -o£ -way needed for the opening
Of Ivey Lane to connect Gol.l.iber and Horne Road from Harold G. Bailey for
and in consideration of $387.50, such right-of-way being described as fol-
lows:
A strip of land 25 feet in width and 100 feet in length, being
the west 25 feet of Lot 1-A of the Ava Cooper Subdivision, an
Addition to the City, of Corpus Christi, lying and being situat-
ed in the County of Nueces, State of Texas, as shown by Plat
recorded in volume 10, page 25 of the Map Records of Nuecea
County, Texas, to which reference is hereby made for more pares
titular description.,
SECTION 2. That said City Manager is authorized and directed to
execute the necessary instruments and to do all things requisite to such ac-
quisition.

SECTION 34 That Three Hundred Eighty -6even Dollars and Fifty
Cents ($367.50) is hereby appropriated out of No. 295 improvement Bonds
1946 Construction Fund (Street improvements) to be paid w oonsiderAtion
for said right -ofd described in Section 1 hereof upon delivery to the
City of Corpus Christi of (atiponveying said property to the City.
Id SECTION 4. That the urgent need for the immediate opening of
Ivey Lane to the benefit of the street drainage and utility systems of the
City of Corpus Christi, protecting the health, safety, end general welfare
of the general public, creates a public emergency and an imperative public
necessity requiring. the suspension of the Charter rule that no ordinance
or resolution shall bepassed fully on the date of its introduction and
that such ordinance or resolution shall be read at three several meetings
Of the City Council, and the Mayor, declaring such emergencyand necessity
to exist, having requested the suspension of said Charter rule and that
this ordinance be passed finally on the data of its introduction and that
It take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY PASSED AND APPROVED, This the_2&_day of June, 1951.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

I certify to the City Council that the money required
for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No.295 Improvement Bonds 198
Construction Fund (Street Improvements)
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.
