AN ORDINANCE
APPROPRIATING $5,002.09 FROM N0. 299 IMPROVEMENT '
BONDS 1950 CONSTRUCTION FUND (SANITARY SMiER IM-
PROVEMENTS) TO COVER THE COST OF CONSTRUCTION OF
SANITARY SE57ER LATERALS TO SERVE NEW C1 TY HALL, AM
CIVILIAN DEFENSE CENTER ($4,551.90 as CONTRACT
PRICE PLUS TEN PERCENT, $455.79, FOR ENGINEERING
AND CONTINGENCIES); AUTHORIZING AND DIRECTING THE
CITY MANAGER FOR AND ON BEHALF OF THE CITY 1D EXECUTE
A CONTRACT WITH T. H. LEE, CONTRACTOR, FOR THE CON-
STRUCTION OF SAID IMPROVEMENTS, A COPY OF SAID CON-
TRACT BEING ON FILE IN THE OFFICE OF THE CITY SECRE-
TARY AND MADE A PART HEREOF BY REFERENCE, AND IECLAR-
AN EMERGENCY.
WHEREAS, Certain improvements have been determined to be neces-
sary; and
WHEREAS, There are sufficient unappropriated funds available
in No, 299 Improvement Bonds 1950 Construction Fund (Sanitary Sewer Im-
provements) to pay the cost of construction thereof; and
WHHEREAS# Bids have been received, considered and an award made
for the most advantageous bid to the City of Corpus Christi, and it is now
necessary to enter into a contract in accordance with said award.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. That there is hereby appropriated out of No. 299
Improvement Bonds 1950 Construction Fund (Sanitary Sewer Improvements)
$5,002.09, out of which amount $4,551.90 is to be paid for the cost of
construction and according to the terns of the contract described in Sec-
tion 2 hereof, the balance of which amount, $455.19, the equivalent to

ten per cent of said contract price, being appropriated to cover the cost

of engineering and contingencies in connection with such construction,
SECTICN 2, That the City Manager be, and he is hereby, author-
ized and directed for and on behalf of the City to, execute a contract for
the construction of sanitary sewer laterals to serve the new City Hall and
Civilian Defense Center with T. H. Lee, Contractor, which contract has been
awarded in accordance with the plans and specification and contract docu-
ments on file in the office of the City Secretarq, made a part hereof by
reference, and in accordance with the bid of said T. H. Lee opened on the
79th of June, 1951, such bid being the lowest and most advantageous bid
to the City of Corpus Christi, Texas.
SECTION 3. That the necessity of contracting for the con-
struction of sanitary sewer laterals to serve the new City Hall and
the Civilian Defense Center immediately so that the completion of such
project will coincide with the completion of said buildings said build-
ings being necessary to the health, safety, and general welfare of the
general Public, creates a public emergency and an imperative public neces-
sity requiring the suspension of the Charter rule providing that no ordi-
nance or resolution shall be'passed finally on the 'date 'of its introduc-
tion and that such ordinance or resolution shall be read at three several -
meetings of the City Council, and the Mayor, declaring such emergency and
necessity to exist, having requested the suspension of said Charter rule
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council, I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

I certify to the City Council that the money required
for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No. 299 Improvement Bonds 1950
Construction Fund (Sanitary Sewer Improvements)
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.
