AUTHORIZING CONDEMNATION PROCEEDINGS BY THE
CTTY OF CORPUS CHRISTI TO CONDEM CERTAIN REAL
ESTATE WITHIN THE CITY CF CORPUS CHRISTI, TEXAS,
SITUATED WITHIN THE CITY OF CORPUS CHRISTI AD-
JACENT TO THE PRESENT MUNICIPAL AIRPORT OF THE
CITY OF CORPUS CHRISTI, TEXAS, AND MORE PARTICU-
LARLY DESCRIBED HEREIN, AND DIRECTING THE CITY
ATTORNEY TO INSTITUTE PROCEEDINGS IN ORDER TO
CARRY OUT THE MENTIONS OF THIS ORDINANCE; AND
DECLARING AN EMERGENCY.
WHEREAS, The City of Corpus Christi intends to enlarge and

improve its present municipal airport by the acquisition of additional
]end and the malting of certain improvements, and in order to do so
it is necessary that certain real property be acquired by said City,
a part of which is more particularly described as follows:
A triangular tract of land out of the,north-
east corner of a tract of ]and conveyed to Sam
Breslau and Barney Cott by deed dated February 12,
1944, recorded in volume 298, Page 59 of the Deed
Records of Nueces County, Texas, said tract of
land being more particularly described by metes
and bounds as follows:
Beginning at a point in the centerline of
Rabbit Run Road, said point bears N 290 27t E,
1049.46 feet from the intersection of the center-
line of Rabbit Run Road with the centerline of the
road along the southwest boundary of Section F.
which point is the south corner of the south 1/4
of the south 1/4 of said Section F.
Thence S 890 571 W with the southern boun-
dary line of a 40.451 acre tract conveyed to the
,. City of Corpus Christi by deed dated March 12, 1941
and recorded in Vol. 267, Page 381 of the Deed Re-
cords of Nueces County, Texas, a distance of 574.83
feet to a point for a corner of this tract.
Thence S 370 O1l E a distance of 545.70 feet
to a point in the centerline of Rabbit Run Road for
a corner of this tract;
Thence N 290 27' F. with the centerline of
Rabbit Run Road, a distance of 500.95 feet to the
place of beginning.
Containing 2.877 acres of land of which 0.225
acres are in Rabbit Run Road.
WHEREAS, The record title of said property appears to be
held by Sam Breslau and Barney Cott, and the said Barney Cott now being

a member of the City Council or the City of Corpus Christi, and it being
forbidden by the provisions of the City Charter to contract with a
City Comnissioner regarding the purchase of property by City of Corpus
Christi; therefore, it is impossible that an agreement be reached be-
tween the City of Corpus Christi and the said owners of said property;
and
WHEREAS, It in expedient that said property be acquired by
the City o£ Corpus Christi, Texas, by condemnation proceedings, for the
purpose of enlarging and improving said Municipal Airport for airport
purposes and related uses, and it is necessary to acquire the fee
simple title to the said land for said purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE 01TY COUNCIL OF THE
CITY OF CCRPSS CHRISTI, TEAS:
SECTION I. In conformity with the premise, and in accordance
with certain provisions of the City Charter, the said City ofCorpus
Christi, Texas, does hereby order the condemnation of certain real es-
tate in Nueces County, Texas, and described as follows:

east corner of a tract of land conveyed to Sam
Breslau and Barney Cott by deed dated February 12,
1944, recorded in Volume 298, Page 59 of the Deed
Records of Nueces County, Texas, said tract of
land being more particularly described by metes
and bounds as follows;
Beginning at a point in the centerline of
Rabbit Bun Road, said point bears N 290 271 E,
1049.46 foot from the intersection of the center-
line of Rabbit Run Road with the centerline of the
road along the southwest boundary of Section F,
which point is the south corner of the south 1/4
of the south 1/4 of said Section F.
Thence S 890 571 W with the southern boun-
dary line of a 40.451 acre tract conveyed to the
City of Corpus Christi by deed dated March 12, 1941
and recorded, in vole 267, Page 381 of the Deed Re-
cords of Nueces County, Texas, a distance of 574.83
feet to a point for a corner of this tract.

and the City Attorney is here authorized and directed to institute con-
demnation proceedings against said property and all the persona who
might have an interest therein, and to proceed with said condemnation
suit to its conclusion, with the intention in mind of obtaining fee
simple title in and to said property for the purpose of using the same
for airport enlargement and improvement.
SECTION II. That the prompt institution of condemnation pro-
ceedings and immediate acquisition of'said land so that the contemplated ,
airport enlargement and improvement may be prosecuted with all diligence
and dispatch creates a public emergency and public imperative necessity
requiring the suspension of the Charter Rule providing that no ordinance
or resolution be passed finally on the date it is introduced and that
such ordinance or resolution shall be read at three several meetings of
the City Council, and the Mayor, having declared such public emergency
and such imperative public necessity to exist, requests that said Charter
Rule be suspended, and that this Ordinance take affect and be in full
force and effect, from and after its passage, IT IS ACCORDINGLY OR-

For the reasons net forth in the emergency olause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the auspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at.three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council,
