LEE IN ACCORDANCE WITH CONTRACT WITH CITY DATED DECEMBER 29, 195% AUTHORIZED BY ORDINANCE NO. 2957; AUTHORIZING PAYMENT OF FINAL ESTIMATE DATED JUNE 30, 1951, A COPY OF 14HICH IS ATTACHED HERETO AND *t°Tm' A PART HEREOF, IN THE AMOUNT OF $32,694.01 BEING THE BALANCE OF THE CONTRACT PRICE CF $160,20L.26 APPRO- PRIATED OUT OF NO. 296 IMPROVEMENT BONDS 1950 CON - STRUCTION FUND (STORM SEINER DEROVEMENTS), AND DECLAR- DIG AN EMERGENCY. HE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the work of constructing the Lipan Street ex- tension storm sewer in the City of Corpus Christi, Texas, performed by Slovak Brothers, Inc, under its contract with the City dated December 29, 1951, authorized by ordinance No. 2957, having been performed and completed in accordance with the terms and provisions of the contract, plans, and specifications, and the Director of Public Works having in- spected the same and certified to the completion of said work in accord- ance with said plans and specifications, the work aforesaid is hereby found to have been completed in accordance with the plans and specifica- tions and is here and now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract afore- mentioned and as set out in the final estimate dated June 30, 1951, at- tached hereto and made a part hereof, prepared by the Director of Public Works and in the sum of $32,694.01, being the balance of the contract price of $160,204.26 appropriated from No. 296 improvement Bonds 1950 Construction Fund ( (Storm Sewer Improvements), be made in accordance with the terms of said contracts and with said final estimate being attached hereto. SECTION 3. That the necessity for immediate completion of said project by the aforesaid acceptance and payment, said project pro- viding needed storm sewers to protect the health, safety, and general welfare of the general public creates a public emergency and an imperative -1- 30 gu i public necessity requiring the suspension of the Charter rule that, no ordinance or resolution shall be- passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayors having declared such emergency and necessity to exist, requesting the sus- pension of said Charter rule and that this ordinance be passed fin- ally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO PASSED AND APPROVED This the_//O day o July, 1951.
