J AN ORDINANCE APPROPP.IATING FROM N0. 296 IMPROVEMENT BONDS 3.950 CONSTRUCTION FUND (PARK IMPROVEMENTS) $5,255.58 FOR THE INSTALLATION COSTS OF CURBS AND PARIMIG AREA IN COLE PARK ON OCEAN DRIVE IN THE CITY OF CORPUS CHRISTI, TEXAS; AUTHORIZING ANDDIRECTING THE CITY MANAGER FOR AND ON BEHAIF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CONTRACT WITH SLOVAKS BROTHERS, LOA BIDDERS, FOR THE CONSTRUCTION OF SAID IMPEOVEIMTS, SUCH CONTRACT DOCU- MENTS, PLANS AND SPECIFICATION BEING MADE A PART HERE- OF BY REFERENCE; AND DECLARING AN EMERGENCY. ;IV,// WHEREAS, Certain improvements have been determined to be neces- sary and there are sufficient funds available in No. 296 Improvement Bonds 1950 Construction Fund (Park Improvements) to appropriate to cover the cost of such improv em= nts; and WHEREAS, Bids have been received, considered, and an award made for the lowest and most advantageous bid to the City of Corpus Christi, and it is now necessary to make such appropriation and to enter into a contract in accordance with said award; NOT, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That there is hereby appropriated out of No. 296 Improvement Bonds 1950 Construction Fund (Park Improvements) $5,255.58, out of which amount there is to be paid $4,777.80 as con- tract price for construction of improvements described in section II hereof, the balance of $477.78, being equivalent to ten percent of said contract price, being appropriated to cover the cost of engineer- ing and contingencies in connection with such project. SECTION 11. That the City Manager is hereby authorized and directed for and on behalf of the City to execute a contract for the construction of curbs and parking areas in Cole Park on Ocean Drive in the City of Corpus Christi with Slovak Brothers, which contract has been awarded said Slovak Brothers in accordance with bid opened on the 3rd day of July, 1951, said bid being the 10wes and most advantag- eous bid to the City of Corpus Christi, Texas, and in accordance with the plans and specifications and contract documents on file in the of- fice of the City Secretary, made a part hereof by reference. -1- SECTION III. That the necessity for entering into such contract and making such appropriation immediately for the construction of such curbs and parking area in cider to provide need- ed access for the use of said park as a part of the permanent park and recreation areas of the City of Corpus creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and that the Mayor, declaring such emergency and necessity to erdstp re- questing the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORD- INGLY PASSED AND APPROVED This the day of July, 1951, MAYOR TEST.
