AUMJOP.IZING AND DIRECTING THE CITY MANAGER FOR AND
ON BEHALF OF THE CITY TO EXECUTE A CONTRACT WITH
GUY A. THOMPSON, TRUSTEE, SAN ANTONIO, UVALDE & GULF
RAILROAD COMPANY, DEBTOR (MISSOURI PACIFIC LINES)
FOR A PIPELINE CROSSING LICENSE GIVING THE CITY PER-
MISSION TO INSTALL 71 x 41 CONCRETE STORM SEPiER UNDER
RAILROAD RIGHT -OF-WAY ON LIPAN STREET EXTENSION AS
SHOWN ON THE MAP WHICH IS A PART OF SAID LICENSE,
A COPY OF WHICH CONTRACT AND LICENSE IS MADE A PART
HEREOF AND ATTACHED HERETO; AND DECLARING AN EMEIMJCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS;
SECTION 1, That the City Manager is hereby authorized and di-
rected for and on behalf of the City of Corpus Cha.sti to execute a
contract with Guy A. THOMPSON, TRUSTEE, SAN ANTONIO, UVAIDE & GULF RAIIr
ROAD COMPANY, DEBTOR (Missouri Pacific Lines) for a pipeline crossing
license giving the City permission to install 71 x 4' concrete storm
sewer under the railroad right-of -way on Lipan Street extension in the
City of Corpus Christi as shown on the map attached to the contract,
a copy of which is attached hereto and made a part hereof.
SECTION 2. That the necessity for providing adequate right -
of -way for the placing of said storm sewer lines within the City creates
a public emergency and an imperative public necessity requiring thesus-
pension of the Charter rule that no ordinance or resolution shall be
passed finally on the date it is introduced and that such ordinance or
resolution shall be read at three several meetings of the City Council,
and the Mayor, having declared such emergency and necessity to exist, re-
questing the suspension of said Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in ,
full force and effect from and after its passage, IT IS ACCORDINGLY PASS-
ED AND APPROVED, This the /0 day of July, A.D. 1951.

2. Licensee agrees to indemnify and hold harmless the Carrier from all liability, damage and expense, including
attorney's fees and costs, which the Carrier may incur or suffer, caused by the intaflation, maintenance, existence
of Pipe Line (or canal and/or flume). or use

days following serving by Licensee on Carrier of written notice of intention to end term hereof. Any notice of Carrier shall
be deemed served when posted conspiciously on Pipe Line (or canal and/or flume) or when deposited, postage prepaid in
U. S. mail addressed'as aforesaid, not later than last day of term hereof Licensee shall remove P1 Line (or canal ant /or flume) and restore premises. Any of Pipe Line (or canal and/or flume) not so removed shall at Pipe election without
notice be deemed abandoned. Covenants herein shall inure to or bind each party's heirs, legal representatives, successors
and assigns; provided, no right of Licensee shall be transferred or assigned either voluntarily or involuntarily except by ex-
press agreement acceptable to Carrier. Carrier or Licensee may waive any default at any time of the other without affecting
or impairing any right arising from, any subsequent default.

For the reasons net forth in the emergency clause at the fore-
