TO OPERATE A TRAIN AT CERTAIN PLACES AT A GREATER RATE OF SPEED THAN 18 MILES PER HOUR, PRESCRIB- ING A PENALTY NOT TO EXCEED A FINE OF MORE TRHM T70 HUNDRED DOLLARS (Nv`200.00); REPEALING ALL ORDINANCES OR FARTS OF ORDII;ANCES IN CONFLICT HERWIITH; CONTAINING A SAVINGS CLAUSE; PRO- VIDING CANNER OF PUBLICATION AND EFFECTIVE DATE OF SAID ORDINANCE; AIM DECLARING AN EME.RGENGY. WHEREAS, the blmving of train whistles, home, sirens, and similar devices in the City of Corpus Christi her caused a detrimental effect on the health and general welfare of the citizens of Corpus Christi: BE IT ORDAIIED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI; Section 1. It shall be unlawful to blow the railroad engine whistle, horn, siren or other noise making device other than that described in Section 2 hereof, or cause the same to be blown on any railroad engine within the corporate limits of the City of Corpus Christi, provided that the air whistle on the rear of a train shall not be included within the above prohibition and provided further that railroad engines or trains approaching the Bascule Bridge over the Corpus Christi ship channel may blow or sound a whistle or horn for not exceeding five seconds. Section 2. All locomotives, steam, diesel or other, shall ring their engine bells when starting to move and also when approaching a public crossing within the corporate limits of the City of Corpus _ Christi no as to warn motorists and pedestrians of their approach. Section 3. It shall hereafter be unlawful to operate or run or cause to be operated or rue when entering and until fully ocoupying any public crossing within the corporate limits of the City of Corpus Christi any railroad engine, car, or train of cars at a greater rate of speed than 18 miles per hour. section 4. Any person, firm, or corporation who shall violate or fail to comply with any provisions of the three preceding articles shall be deemed guilty of a misdemeanor and .upon conviction, thereto, shall be fined not more than 0200.00. Section 5. In case a corporation is the operator of any equipment used in violation of any provision of this ordinance, the president, vice - president, secretary, treasurer, manager, and the agent or employee operating such equipment shall be severally liable for the penalties herein prescribed. Section 6. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed. section 'j. If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this Ordinance shall be held invalid, it shall not affect any valid provisions of this or any other ordinance of the City of Corpus Christi to which these rules and regulations relate. Section B. This Ordinance shall take effect from and after its publication ono time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in summary the purpose of the Ordinance and penalty for • violation thereof. Section 9. The necessity for regulating the blowing of railroad engine whistles, horns and sirens and the sounding of train bells and the movement of trains within the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three several meetings of the City Council, and the lnyor, -2- having declared an emergency and necessity to exist, requesting the suspension of said charter rule and that this ordinaneo be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, this .e a of July, 1951- lul OR CITY OF CORPUS CHRISTI, TEXAS ATTESTS City Secretary APPROVED AS TO LEGAL FORK- Ci y At•orney -3- orpuss Christi, Texas Q-4e / / % . 3.950 TO THE 18EEMS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at.throo meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
