HomeMy WebLinkAbout03104 ORD - 07/31/1951JleA AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO AC- QUM FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI A FIVE FOOT RIGHT OF WAY NEEDED FOR THE WIDENING OF IVEY LANE TO ESTABLISH A UNIFORM FIFTY FOOT WIDTH, BEING THE WEST FIVE FEET OF LOT 6N, AVA COOPER ADDI- TICH TO THE CITY, FROM J. E. HARTLE JR. FOR AND IN CONSIDERATION OF $100; AUTHORIZING AND DIRECTING THE CITY MANACER TO-DO ALL THINGS NECESSARY AND REQUISITE TO SUCH ACQUISITION; APPROPRIATING FROM N0. 220 STREET IMPROPE MTS THE SUM OF ONE HUNDRED ($100) DOLLARS TO COVER THE PURCHASE PRICE OF SAID M OHT-F-WAY; and DECLARCNG AN EKERMWr. HE IT ORDAINED BY THE CITY COUNCIL, OF THE CITY OF CORPUS CHRISTI, TEYAS: SECTION 1. That the City Manager he and he is hereby authorized and directed to acquire for and on behalf of the City of Corpus Christi, Texas, a five foot right of way needed for the widening of Ivey Lane to establish a uniform fifty foot width along said street, described as follows, to -wit= A strip of land 5 feet in width and 89.56 feet in length being the west 5 feet of Lot 6 N. Ave Cooper Addi- tion to the City of Corpus Christi, Texas, as shown by map recorded in Volume 10, page 25 of the Map Records of Nueces County, Texas, to which map reference is hereby made for more particular description, for and in consideration of $100 from,J. E. Hartle, Jr., by warranty deed in the fora attached hereto and made a part hereof. SECTION 2. That the City Manager be and he is hereby authorized and directed to do all things necessary and requisite to obtaining the title and possession of the land described in Section 1. SECTION 3. That there is hereby appropriated the sum of ONE HUNDRED DOLLARS ($100) from No. 220 Street Improvements to be paid as consideration for the conveyance to the City of Bach right- of-way described in Section 1. •' SECTION 4. That the public necessity of obtaining said right-Of-way for the purpose of having a uniform width of fifty feet on Ivy Lane for its entire length, and to thereby establish uniform building lines creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, declaring such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduc- tion and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED This tho_3 I d -y'of July, A.D. 1951. ffelr,G owl IpR %rnil Ts CITY OF CORPUS CHRISTI z ecre ary ' AP ROVED AS TO LEGAL FORK: " fi-t�oy y , �Corpu/s/ Christi, Texas 1950 TO THE )EEHS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons net forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be paused finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
