BY E. EISEXHAUER, CONTRACTOR, UNDER HIS CONTRACT MH THE
CITY DATED JULY 10, 1950, AS AUTHOR= BY ORDINANCE N0.
2806; APPROPRIATING FROM NO. 270 CITY HALL IMPROPEEEENTS
THE SUM OF $11, 379.46 TO BE TRANSFERRED TO NO. 296 IM-
PROVEMENT BONDS 1950 CONSTRUCTION FUND (POLICE BUILDING);
AUTHORIZING FINAL PAYMENT AS TO THE AMOUNT OF W,818.25
HERETOFORE APPRORRIATED OUT OF NO. 296 iMPROVELENT BONDS
1950 CGNSTRUCTION FUND (POLICE BUILDING) BE PAID IN AC-
CORDANCE WITH FINAL ESTIMATE DATED AUGUST 23, 1951, ON THE
AMOUNT OF $27,636.15; APPROPRIATING $12,198.29 OUT OF N0.
296 IMPROVAM BONDS 1950 CONSTRUCTION FUND (POLICE BUILD-
ING) ARD PAYMENT IS AUTHORIZED AS FOLLOWS: $10,817.90 To
BE PAID ON THE EISENHAUER CONSTRUCTION CONTRACT, $1,44.84
TO BE PAID ON THE MORRIS LEVY ARCHITECTURAL SERVICE CON-
TRACT, ANTL TO,BE PAID TO REIMSRUSE CURRENT FUND NO. 102

TINGENCIES; AND DECLARING AN EMERGENCY.
1MREAS, There is on hand unappropriated funds in No. 270 City '
Hall Improvements which are proceeds from the sale of bonds voted for
the renovation and improvement of the City Hall Building at a time when
the police department was housed in said building; and
WHEREAS, A separate building has been constructed for the hour-
, ing of said police department, and the said No. 270 City Hall Improve-
ment fund has in it funds heretofore unappropriated; and
WHEREAS, The construction of said police building has now been
completed in accordance with plans and specification and same has been
inspected and recommended for acceptance by the Director of Public Work.;
and
WHEREAS, Funds in No. 296 "p—ement Bonds .950 Construction
Fund (Police Building) are deficient by $112379.0 to ,peat the balance
of construction contracts and other expenses in connection with the
construction of said new police building; and
' n 1EAS, To meet this deficiency, it has been recommended by '
the City Controller that such amount be appropriated from No. 270 city _
Hall Improvements, payable to said Police Building fund to cover this
deficiency;

SECTION 1. That the work of construction of the Public
%afety Building located at Buffalo and Brownlee in the City of
Corpus Christi to serve the Police Department, performed by E,
Eisenhauer, Contractor, under his contract with the City dated
July 10, 1950, as authorized by Ordinance No. 2806, having been
performed and completed in accordance with the terms and provi-
sions of the contract, plans andspecifications, and the Director
of Public Works, having inspected the same and certified to the
completion of said work in accordance with said plans and speci-
fications, and the Architect, Morris L. Levy concurring in said
approval, the work aforesaid is hereby found to have been completed
in accordance with the plane and specifications and is here and now
accepted and received by the City Council of the City of Corpus
Christi, Texas.
SECTION 2. That there is hereby appropriated from No. ,
270 City Ball Improvements the summf $21,379.46, the same to be '
transferred to No, 296 Improvement Bonds 1950 Construction Fund
(Police Building).
, SECTION 3. That final payment due under the contract men-
tioned and set out in the final estimate attached hereto and made
a part hereof, prepared by the Director of Public Works, and dated
August 231 1950, in the sum of $16,818.252 on the total amount of
$27,636.15, be paid out of said No. 296 Improvement Bonds 1950 Con,

struction Fund (Police Building) in accordance with the appropria-
tion heretofore made; and the amount of $129198.29 is hereby appro.
priated and payment authorised out of said No, 296 Improvement Bonds
1950 Construction Fund (police Building) as follows, $10,817.90 to
be paid on the Eisenhauer Construction Contract; $1,0F,.84 to be paid
on the Morris Levy Architectural Service Contract; `and $305.55 to be
paid to reimburse Current Fund No. 102 Engineering Division Depart-
ment of Public Works for contingencies,
SECTION 4. That the necessity for the completion of said
project by the aforesaid acceptance, appropriations and payments'
immediately creates a public emergency and an imperative public neces-
sity requiring the euspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction
and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mawr, having declared such
emergency and necessity to exist, having requested the suspension
of said Charter rule and thatthis ordinance be passed finally on
the date of its introduction and that it take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY
PASSED AND APPROVED This the a2 Or day of August, 1951.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at -three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and-pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
