HomeMy WebLinkAbout03132 ORD - 09/11/1951E API ORDINANCE RECEIVING AND AOCEPTING THE WORK OF CONSTRUCTION OF CURBS AND PARKING AREA IN COLE PARK PERFORMED BY SLOVAK BROS., INC., CONTRACTORS, UNDER ITS CON- TRACT DATED JULY 20, 1951, AS AUTHORIZED BY ORDI- NANCE NO. 3085, WITH THE CITY OF CORPUS CHRISTI, TEXAS; AUTHORIZING FINAL PAYMENT IN ACCORDANCE WITH FINAL, ESTIMATE PREPARED BY DIRECTOR OF PUBLIC WORKS AND, DATED AUGUST 31, 1951, IN THE AMOUNT OF 65,406.30 TO BE PAID OUT OF NG. 296 IMPROVEMENT BONDS 1950 CON- STRUCTION FUND (PARK IMPROVEMENTS) IN ACCORDANCE WITH THE APPROPRIATION SET OUT IN ORDINANCE NO. 3067 APPRO- PRIATING FUNDS FOR SAID PARK IMPROVEMENTS FROM SAID N0. 296 IMPROVEMENT BONDS 1950 CONSTRUCTION FUND (PARK IMPROVEMENTS), WHICH FINAL ESTIMATE IS ATTACHED HERETO AND MADE A PART HERECF; APPROVING THE ALTERATION OF PLANS AND AUTHORIZING PAYMENT OF THE EXCESS COST OF SAID PROJECT BY REASON OF ALTERATION OF PLANS AND SPECIFICA- TIONS BY THE DIRECTOR OF PUBLIC WORKS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. That the work of construction of curbs and parking area in Cole Park in the City of Corpus Christi, Texas as permanent park improvements of the City of Corpus Christi, performed by Slovak Bros., Inc. under its contract with the City dated July 20, 1951, as authorized by Ordinance No. 3085, having been performed and completed in accordance with the terms and provisions of the contract, plans, and specifications, in- cluding the alterations and changes authorized by the Director of Public Works and approved by the City Manager, and the Director of Public Works having inspected the same and certified to the completion of said work in accordance with the said revised plans and specifications, the work afore- said is hereby found to have been completed in accordance with the plans and specifications and is here and now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract mentioned in Section 1 hereof and as set out in the final estimate attached hereto and made a part hereof, prepared by the Director of Public Works, dated August 31, 1951, in the amount of $5,406.30, be paid out of No. 296 Im- provement Bonds 1950 Construction Fund (Park Improvements) out of the funds already appropriated by Ordinance No. 3067. SECTION 3. That the necessity of malting the aforesaid accept- ance and final payment immediately to complete said project in compli- ance with said contract and as a part of the permanent park improvements of the City of Corpus Christi, Texas, creates a public emergency and an im- perative public necessity requiring the suspension of the Charter role that no ordinance or resolution shall be passed finally on the date of its introduction and such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its intro- duction and take effect and be in full force and effect from and after the date of its passage, IT IS ACCORDINGLY PASSED AND APPROVED This the Aec day of September, A.D. 1951.
