AN ORDINANCE
APPROPRIATING $97,460.00 ($88,600, AS CONTRACT PRICE
AND 10% THEREOF, $8,860, AS ENGINEERING AND CONTINGENCIES)
TO BE PAID CUT OF NO. 297 Itfl�ROVEMENT BONDS 1951 CONSTHUC-
TION FUND (STREET IMPROVEMENTS)AS CONSIDERATION FOR IM-
PFU EVENTS TO AND RESURFACING OF STREETS IN THE CENTRAL
BUSINESS AREA OF CORPUS CHRISTI, TEXAS; AUTHORIZING AND
DIRECTING THE CITY MANAGER FOR AiD ON BEHALF OF THE CITY
TO EXECUTE A CONTRACT WITH J. M. DELLINGER, INC., FOR
CONSTRUCTION CF SAID IMPROVEMENTS, WHICH CONTRACT DOCU-
VENTS ARE MADE A PART HEREOF BY REFERENCE; AND DECLAR-
ING AN EMERGENCY.
WHEREAS, Certain improvements have been determined to be
necessary, and
WHEREAS, There are sufficient fund available andunappro-
priated in No. 297 Improvement Bonds 1951 Construction Fund (Street
Improvements) from which appropriation for such project may be made;
and
WHEREAS, Bids have been received, considered, and an award
made for the lowest and most advantageous bid to the City of Corpus
Christi, and it is now necessary to make such appropriation and enter
into a contract in accordance with said award;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby appropriated out of No. 297
Improvement Bonds 1951 Construction Fund (Street Improvements) the
sum of $97,460.00, out of which there is to be paid in accordance
with the terms of the contract described in Section 2 hereof the'sum
of $88,600 as contract price and the sum of $8,8609 equivalent to
ten per cent of said contract price, to cover the cost of contingencies
and engineering.
SECTION 2. That the City Manager be and he is hereby author-
ized and directed to execute for and on behalf of the City a contract
for the improvement and resurfacing of streets in the central business
area of the City of Corpus Christi with J. M. Dellinger, Inc., which
contract has been awarded said J. M. Dellinger, Inc. in accordance
with the plans and specifications and contract documents on file in
the office of the City Secretary, made a part hereof by reference,

and according to the bid of said J: M. Dellingers incos opened
on the 4th day of Septemberx 19519 said bid being the lowest and
most advantageous bid to the City.
SECTION 3- That the necessity for providing for the main-
tenance of our City streets to protect the safety, health and gen-
eral welfare of the Public creates a public emergency and an impera-
tive necessity requiring the suspension of the Charter iu]e that
no ordinance or resolution shall be passed finally on the date of
its introduction and that such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor, de-
claring such emergency and public necessity to exist, having re-
quested the suspension of said Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS
ACCORDINGLY PASSED AND APPROVED, This the ay of Septembers

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

' for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No. 297 Improvement Bonds 1951
Construction Fund (Street Improvements)
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.
