ABANDONING THE UTILITY EASEMENT RUNNING IN A NORTHERLY
SOUTHERLY DIRECTION ACROSS BLOCK ONE (1) OF NEMEC SUB -
DIVISION AS MORE PARTICULARLY DESCRIBED HEREIN„ ORDER-
ING THE DEDICATION THEREOF VACATED AND ALL HE CHT, Tza
AND INTEREST THEREIN RETURNED TO OWNERS ENTITLED THERE-
TO; AND DECLARING AN EMERGENCY.
WHEREAS, The ten (10) foot utility easement running in a
Northerly- Southerly direction through Block One (1) in Nemec Subdi-
vision within the City of Corpus Christi, Texas, same being parallel
to the center line of Chapman Ranch Road (Ayers Street), as ehown on
the plat of such subdivision recorded in Volume 12, at page 17 of the
Map Records of Nueces County, Texas, and as shown on the revised plat
of said Nemec Subdivision recorded in Volume 12, at page 38 of the Map
Records of said County, is no longer necessary to the lots located
within said Block One (1) of said subdivision, the existing utility
lines now located in said easement having been or are about to be re-
moved and relocated at the expense of the abutting property owners to
easements designated, granted and dedicated by the parties interested
in the relocation of said line, to the satisfaction of the Director
of Public Works and the Director of Public Utilities of the City of '
Corpus Christi, to better serve the said Nemec Subdivision and the
lots therein; and
WHEREAS, the public welfare, convenience and necessity will
better be served by the abandonment of said easement:
NOW, THEREFORE, BE IT ORDAINED BY-THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the utility easement running in a Northerly -
Southerly direction through Block One (1) of the Nemec Subidivision
within the City of Corpus Christi, Texas, same being parallel to the
center line of Chapman Ranch Road (Ayers Street) as same is drown on
the plat of said subdivision recorded in Volume 12, at page 17 of the
Map Records of Nueces County, Texas and as is shown on the revised plat
thereof, recorded in Volume 12, at page 38 of the Map Records of said
County, be and the same is hereby abandoned for public use, and the
dedication thereof is hereby vacated.
SECTION 2. That the City of Corpus Christi hereby relinquishes
any right, title or interest it may have in and to such utility ease-
ment crossing Block One (1) of the Nemec Subdivision as described in
` Section 1 hereof, which is herein abandoned, and it is hereby ORDERED
AND DIRECTED That such right, title and interest thereto heretofore
held by the City of Corpus Christi shall revert to the abutting property-
owners entitled to the same.
SECTION 3. That the fact that public convenience and neces-
sity will be better served by the abandonment of said utility easement
and the relocation thereof and that the immediate relinquishment by
the City of any rights therein is of the greates public importance creates
a public emergency and an imperative public necessity requiring the sus-
pension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction and that such ordinance
or resolution shall be read at three several meetings of the City coun-
cil, and the Mayor, having declared such emergency and necessity to
exist, requesting the suspension of said Charter rule and that this
ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passages IT
IS ACCORDINLY PASSED AND APPROVED This iheday of September,

For the reasons set forth in the emergency clause of the fore-
' going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I. therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
