AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
SETTLE -AN AWARD MADE BY COMMISSIONERS IN TEE
CONDEMNATION OF CERTAIN PROPERTY OF SAM BRASLAU
AND•BARNEY COTT AND, APPROPRIATING THE SUM OF,
$29,865.35 FROM IMPROVEMENT BONDS 1911.8-CONSTRUC-
TION FUND, AIRPORT IMPRCUEMENTS NO. 295 TO PAY

WHEREAS, The City Council of the City of Corpus Christi
on the 7th day of August, 1951, by Ordinance No- 3106 authorized the
condemnation of certain real estate described in Ordinance No- 3106,
passed by the City Counoil of the City of Corpus Christi on the 7th day
of August, 1951; and,
WHEREAS, On the 13th day of August, 1951, the City of
Corpus Christi filed a statement with the County Judge of Nueces County
for the condemnation of certain land hereinafter described; and,
WHEREAS, On the 13th day of August, 1951, the County Judge
of Nueces County appointed three disinterested freeholders of Nueces
County as special commissioners to assess the damages occasioned by the
oondemnation of said land; and,
WHEREAS, On the 13th day of August, 1951, said commissioners
awarded to Barney Cott and Sam Braslau, owners of such condemned property,
the sum of 1$29,773.50 as damages for reason of said condemnation; and,
WHEREAS, On the 21st day of August, 1951, said award was
approved by and made a judgment of the County Court of Nueces County,
Texas;
NAY, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS-
SECTION 1. That the City Manager is hereby authorized and
directed to compromise and settle the award in condemnation proceedings
No. in the County Court of Nueces County, Texas, in favor of Sam Braslau
and Barney Cott in the sum of 1$29,773.50, together with appraisers fees
and court costs in the sum of $91.85, said property being the same property
described in Ordinance No- 3106 passed by the City Council of the City of
. I
Corpus Christi on the 7th day of August, 1951, and recorded in Volume 19,
Page 514, said amounts to be in full settlement of said award.
SECTION 2. That there is hereby appropriated from the
unappropriated monies in Improvement Bonds 1948 Construction Fund,
Airport Improvements No. 295 the sun of $29,865.35, which amount is to
be used for paying said award, appraisers fees and court costs as set
out in Section 1 of this ordinance.
SECTION 3. The fact that the payment of this award is
necessary in that award has been made by the County Court of Nueoes County
and said award remains unsatisfied creates a public emergency and imperative
necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction and
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor, declaring such emergency and public
necessity to exist, having requested the suspension of said Charter rule
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY PASSED AND APPROVED, This the day of September, A. D.
1951.

I certify to the City Council that the money required
' for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No. 295 Airport Improvement,
Improvement Bonds 1948 Construction F=d. ($29,865.35)
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
y� that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
