DUTIES, PROVIDING FOR THE ENFORCEMENT OF ALL RULES AND REGULATIONS GOVERNING THE CORPUS__ CHRISTI YACHT BASIN, PROVIDING PROCEDURE FOR COLLECTION OF ALL RENTALS DUE THE CITY, PRO- VIDING FOR A.FIDELITY.BOND FOR THE HARBORMASTER; AND DECLARING.AN EMERGENCY., BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager of the City of Corpus Christi be, and -he is hereby, authorized and directed to employ the harbormaster of the Corpus Christi Yacht Basin at such salary and upon such conditions as such City Manager may find to be for the best interest of the City. SECTION 2. The duties of the harbormaster of the City of Corpus Christi shall be as followss (a) The harbormaster shall be in charge of and shall have the supervision of the Corpus Christi Yacht Basin and all T -Heads and L -Heads therein situated and as such shall perform all of the duties and responsibilities as are required of him by the laws of the State of Texas, the United States, and the ordinances of the City of Corpus Christi, Texas, and particularly Ordinance No. 1506 of the City of Corpus Christi, Texas, passed and approved by the City Council of the City of Corpus Christi on October 23, 19142, and such other functions, duties, and powers as may be assigned to him by the City Manager. (b) The harbormaster shall be the executive and admini- strative head of the Corpus Christi Yacht Basin and shall exercise and perform all of the duties usually exercised and performed as such and shall have control, supervision and authority over all officers and employees of the said Corpus Christi Yacht Basin. (c) The harbormaster shall have control over the operation of said Corpus Christi Yacht Basin and shall be charged with the duty of keeping the T- Heads, L- Heads, all wharves and equipment and property of said Corpus Christi Yacht Basin in good repair and shall supervise aRy and all work done on said Yacht Basin. (d) The harbormaster shall enforce or caus* to be enforced all rules and regulations governing the Corpus Christi Yacht Basin that may now be in force or may hereafter be promulgated by the City Council and /or the City Manager of the City of Corpus Christi, Texas. (e) The harbormaster shall collect all rentals due for the use of berths or slips in advance and shall not permit any water craft to use, occupy, or utilize any berth or slip until the rental provided for said berth or slip has been paid or allow any water craft to occupy any berth or slip after the period for which rental has been paid has expired. In the event aW slip shall be occupied without the rental being paid therefore, the harbormaster shall immediately notify the City Manager in writing of such fact and shall take all necessary and proper steps in order to provide for the securing of the lien of the City of Corpus Christi on such water craft. He shall keep careful watch over the vessels in said Yacht Basin and shall use his best efforts to prevent any trespassors from going thereon and shall make periodical inspections to determine whether or not any vessels or water craft are moored or tied up within the Corpus Christi Yacht Basin which are in a badly deteriorated condition or which might become a menace to navigation and take proper steps to remove such menaces to navigation.' He shall make inspections of the said T -Heads and L -Heads to ascertain if there are any fire hazards present. He shall make periodical checks to ascertain if an excessive amount of water is being used by the boats tied up at the T -Heads and L -Heads and in the event he finds an excessive amount of water is being used he shall revoke the privileges of free use of City water and cause water meters to be installed for such boats. He shall prevent refuse or trash or material to be thrown at any time into the Yacht Basin. He shall prevent any fish, trash, bait, refuse, or material of any kind from being left upon any of the wharves, docks, T- Heads, sea walls, sidewalks, streets or breakwater. He shall prevent the bilge of any water craft from being pumped into the water of the Basin formed by the Peoples Street and Lawrence Street T -Heads and the Municipal Wharf L -Head, v ; and prevent any oil being deposited in the Corpus Christi Yacht Basin. He shall see that all of the equipment, material or supplies on the docks or on the L -Heads or T -Heads are placed in lockers. He shall check to ascertain if any persons have injured or damaged the docks, slips, or wharves within the Corpus Christi Yacht Basin and shall take steps to see that the City is immediately reimbursed in an amount equal to the cost of repairing such damage or injury to such docks, slips or wharves. He shall check and ascertain the position of the permanent anchors in said Yacht Basin and keep a record of all permits granted by him for such permanent anchorages. He shall prevent all unauthorized persons from soliciting business and /or selling any articles whatsoever from the sidewalks, streets and parkways in, on, or adjacent to the Corpus Christi Yacht Basin or docks. He shall not permit any person to fish or crab from the catwalks. He shall enforce all other rules and regulations relative to the Corpus Christi Yacht Basin as hereinbefore provided. (f) The harbormaster shall collect all rentals and charges now in force in regard to the Corpus Christi Yacht Basin or may hereafter be established by the City Manager, and/or City Council for the City of Corpus Christi. He shall give to each:and every person paying avy such rentals or charges a receipt and shall permit no person to occupy, use or enjoy any of the facilities provided by the City of Corpus Christi in the said Yacht Basin without such person having in his or her possession such receipt, unless specifically authorized by the City Manager. He shall keep such records and accounts of all rentals and other charges collected by him as required by the City Controller and shall deposit all such fees, rates and charges with the City Controller at such intervals, and accompanied by a report in such form, as required by the City Controller. He shall likewise make a monthly itemized report to the City Manager and /or City Controller of such collections. SECTION 3- 'The harbormaster shall furnish a good and sufficient bond in the sum of not less than twenty -five hundred and no/100 dollars, ($2,500.00), with the surety thereon a corporate surety duly licensed ,A t m under the laws of the State of Texas to write fidelity bonds, con- ditioned that harbormaster shall pay over to the City of Corpus Christi all rentals and other charges due the City of Corpus Christi collected by him. SECTION 4. That the necessity for providing for the employment of a harbormaster for the Corpus Christi Yacht Basin immediately and defining his duties and the necessity of providing adequate facilities for and deriving revenue from the use of said Bay Front improvements for their upkeep, creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed final]y on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. Corpus Christi, Texas TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore -, going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at -three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
