AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A RE-
LEASE OF SPECIAL ASSESSMENT CERTIFICATE NO. 204 FOR
SIDEWALK IMPROVEMENTS AGAINST LOTS 5 AND 6, BLOCK 1102,
BAY TERRACE ADDITION NO. 2, AN ADDITION TO THE CITY OF
CORPUS CHRISTI, FRONTING FIFTY'(501) FEET ON BRONNtEE
BOULEVARD, AND THE OWNER THEREOF, W. E. NOBLES, IN -THE
AMOUNT OF $62, FOR AND IN. CONSIDERATION OF THE PAYMENT
OF $11.l6 AND THE PREMISES, A COPY OF WHICH RELEASE OF
LIEN IS ATTACHED HERETO AND MADE A PART HEREOF; AND DE-
CLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager of the City of Corpus Christi,
Texas, is hereby authorized and directed to execute a release of side-
stalk improvement lien against Lots 5 and 6, Block 1102, BAY TERRACE
ADDITION No. 2, and the real and true owner thereof, W. E. Nobles,
for and in consideration of $11.16 in lieu of the full payment of
$62 for the reason that there was in existence at the time of con-
struction of sidewalk improvements across and along said property,
forty -one linear feet of sidewalk on said property and said amount
of $11.16 representing the payment ofihe cost of the balance of nine
linear feet of sidewalk constructed at the cost of $1.24 per linear
foots a copy of which release is attached hereto and made a part hereof.
SECTION 2. That the necessity for clearing the title to said
property immediately creates a public emergency and an imperative public
necessity requiring the suspension of said Charter rule that no ordi-
ance or resolution shall be passed finally on the date of its introduc-
tion and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor, declaring such emergency and
necessity to exist, having requested the suspension of said Charter rule
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,

NIESEAS. By Ordinance No. 1969, passed and approved by the
City Council of the City of Corpus Christi, Texas, on the 29th day of
August, 1946, as amended on the 25th day of Karch, 1947. by Ordinance
No. 2049, there was levied an assessment in the sum of Sixty Two ($62)
Dollars against property situated in said City fronting 50 feet on
the west side of Brownlee Boulevard in the City of Corpus Christi,
described as followsr Lots 5 and 60 Block 1102, BAY TERRACE W. 2,
Addition to the City of Corpus Christi, Texas; and against the real
and true owner thereof. named as follows: N. E. Nobles, for the con-
struction of sidewalk improvements by M& 3 Construction Company under
contract with the City; and
WHEREAS,, Said Special Assessment was evidenced by Assessment
Certificate No. 204, issued by the City of Corpus Christi on the 1st
day of August, 1947; and
VMREAS, The files of the Department of Public #forks of the
City of Corpus Christi reflect that there was a place across and along
the above described property forty-one (41) linear feet of sidewalk
at the time of construction and prior to such construction by N & a
Construction Company of fifty feet of sidewalY-' and
VMMEAS, It has been recommended that in. conformity with the
practices of the City in constructing improvements, the cost of which
are assessed against the property and owner thereof, that such sidewalk
Iien be released upon the payment by 19. E. Nobles of $11.16, represent-
ing the cost of nine (9) linear fe #t of sidewalk at $1.24 per linear
foot, such nine feet being the difference between the fifty feet of
sidewalk constrncted-and the forty-Oa., feet of sidewalk already is
place,; and
WHEREAS, Said ,iP. iti. Nobles haying paid said.$11.16 for the
cost of said nine linear feet of sidewalk at $1.29 per linear coat, and '
at the time of such payment the City was the owner and holder of said
certificate and all liens securing its - payment:
NOW, TBEREFOW, The City of Corpus Christi,, a.Municipal
corporation, duly organized and existing under and by virtue of the
laws of the State of Texas, for and in consideration of the premises
and the payment of $11,16 cash, does hereby RELEASE AND QUITCLAIM
said property from all liens securing the payment of said assessment and
the owner of said property from all personal liability created by the
Issuance of such certificate and other proceedings of said City above
referred to, and declare said Special Assessment FOLLY SATISFIED AND
DISCOMD by sold payment of said $11.16,
EXECUTED This the day of October, A. D. 1951.

For the reasons set forth in the emergency clause of the £ore -
`':=' going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
• City Council, I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
