HomeMy WebLinkAbout03148 ORD - 10/16/1951AN ORDINANCE AUTHORIZING AIM DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CONTRACT WITH HELDENFEIS BROTHERS FOR THE PURPOSE OF CONSTRUCTING STREET IMPROVEMENTS ON SANTA FE STREET FROM LOUISIANA AVENUE TO ROSSTTER STREET, BY THE CON- STRUCTION OF PAVING, CURBS, AND GUTTERS THEREON, AS MORE PARTICULARLY DESCRIBED IN.SUCH CONTRACT, MADE A PART 19REOF BY REFERENCE, ON FILE IN aTHE OFFICE OF THE CITY SECRETARY OF THE CITY OF CORPUS CHRISTI, TEAS, AT A CONTRACT PRICE OF $158,887.15, SUCH AMOUNT TO BE PAID BY ASSESSMENT AGAINST THE ABUTTING, PROPERTY OME R AND.BY THE CITY OF CORPUS CHRISSTI AS PROVIDED IN SAID CONTRACT, THE AMOUNT OF $77,732.31 BEING ASSESSED AGAINST ABUTTING PROPERTY OWNERS AND $81,154.84 TO BE PAID BY THE CITY; APPROPRIATING FROM NO. 296 IMPROVEMENT BONDS 1950 CONSTRUCTION FUND (STREET ImpROVEDU;NTS) THE SUM OF $98,438.57, BEING THE AMOUNT OF $81,154.84 PLUS THE SUM, OF $1,394.58 TO BE PAID BY CITY. AS PROPERTY OWNER., AND $15,888.72 FcR ENGINEERING AND CONTINGENCIES (10% OF THE CONTRACT PRICE); AND DECLARING AN EMERGENCY WHEREAS, The City Council of the City of Corpus Christi, Texas, did Dn the 16th day of October, A.D. 1951, by duly enacted ordinance, de- termined the necessity for and ordered the improvement of a portion of Santa Fe Street from Louisiana Avenue to Rossiter Street in the City of Corpus Christi, Texas, by the construction of paving, curbs and gutters thereon, such improvements being more particularly described in said ordi- nance, which descriptions are here referred to and made a part hereof; and that such improvements were ordered to be made in the manner and accord- ing to the plans and specifications heretofore approved; and WHEREAS, The duly executed notice of said ordinance having been filed in the name of said City with the Clerk of Nueces County, Texas, on the 16th day of October, A.D. 1951; and WHEREAS, Said Council of the City of Corpus Christi, Texas, having advertised for and received bids on the construction of said im- provements for the length of time and in the manner and form as required by the Charter of said City and the laws of the State of Texas; and WHEREAS, The bid of Heldenfels Brothers was the lowest and most advantageous bid received; and -1- �,r YJBMW, The Director of Finance has advised this Council that the City Treasurer of the City of Corpus Christi has on deposit the necessary and proper funds which have not been appropriated for any other purpose, and which are available for the payment of the City's proportionate share of the cost of improvements of said portion of said street and engineering costs and contingenciesz NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That the City Manager for and on behalf of the City of Corpus Christi be and he is hereby authorized and directed to execute a contract Tor the construction of paving, curbs and gutters on Santa Fe Street from Louisiana Avenue to Rossiter Street in the City of Corpus Christi with Heldenfels Brothers, which contract has been awarded said Heldenfels Brothers in accordance with plans and specifications and contract documents, which are made a part hereof end incorporated herein by reference and on file in the Office of the City Secretary of the City of Corpus Christi, Texas, and according to the bid of said Heldenfels Brothers, opened on the 11th day of September, 1951, said bid being the lowest and most advantageous to the City of Corpus Christi; the contract price for said construction being in the amount of $158,887.15, such amount to be paid by assessment against the abutting property owners and the City of Corpus Christi as pro- vided in said contract, $77,732.31 to be assessed against property owners and the balance to be paid by the City. SECTION II. That there is hereby appropriated from No: 296 Improvement Bonds 1950 Construction Fund (Street Improvements) the sum of $98,438.14, being the amount of $81,154.84 as the City's proportionate part of the contract price, the amount of $1,394.58 as the cost to the City as a property owner, and the amount of $15,888.72 (10% of the con- tract price) for engineering and contingencies, to be paid in accordance with said contract terms for the improvements'deseribed in Section I hereof. SECTION III. That the fact that the aforesaid improvements -2- and the construction of same immediately are necessary to the health, safety and general welfare of the Public because of the heavy traffic along said street creates a public emergency and an imperative public necessity requiring the suspension o£-be Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution &all be read at three several meetings of the City Council, and the Mayor, declaring such emergency and necessity to exist, having requested the suspension of the said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED This the 1� day of October.
