EISENHAUER, CONTRACTOR, UNDER HIS CONTRACT WITH THE CITY DATED JANUARY 19, 1951, AS AUTHORIZED BY ORDINANCE NO. 2968; AUTHORIZING FINAL PAYMENT AS TO THE AC40UNT OF $12,907.80 HERETOFORE APRROPRIATED OUT OF NO. 296 IMPROVEMENT BONDS 1950 CONSTRUCTION (FIRE STATION) BE PAID IN ACCORDANCE WITH FINAL ESTIMATE DATED NOVEMBER 6, 1951, A COPY OF WHICH IS ATTACHED HERETO AND t1ADE A PART HEREOF, SAID FINAL PAYMENT BEING THE 13ALANCE OF THE TOTAL CONTRACT PRICE OF $70,627.50; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the work of construction of the Fire Station located at Doddrige and South Staples Streets in the City of Corpus Christi, performed by E. Eisenhauer, Contractor, under his contract with the City dated January 19, 1951, as authorized by Ordinance No. 2968, having been performed and completed in accordance with the terms and provisions of the contract, plans and specifications, and the Director of Public Works, having inspected the same and certified to the completion of said work in accordance with said plans and specifications, and the Architects, Glade, Gibson and Martin, con- curring in said approval, the work aforesaid is hereby found to have been completed in accordance with the plans and specifications and is here and now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract and as set out in the final estimate attached hereto and made a part hereof, pre- pared by the Director of Public Works, dated November 6, 1951, in the sum of $12,907.80, the balance of a total contract price of $70,627.50, be made from No. 296 Improvement Bonds 1950 Construction Fund (Fire Station) in accordance with the appropriation ordinance. SECTION 3. That the necessity for completion of such project by said acceptance and final payment immediately creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on 3155 ; the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having de- clared that such emergency and necessity exist, requesting that such Charter rule be suspended and that this ordinance be passed finally on the dateof its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
