AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER,
FOR AND ON BEHALF OF THE CITY, TO PURCHASE
45,3 ACRES MORE OR LESS, BEING A PART OF
THE LULA MAE NOAKES ESTATE, LYING AND SITUATED
IN NUECE_S COUNTY, TEXAS FROM NEW NOAKES, ET AL,
FOR THE SUM OF $9,060.00 CASH AND TITLE EXPENSES
NOT TO EXCEED $100.00; AUTHORIZING AND DIRECTING
THE SAID CITY MANAGER TO DO ALL THINGS INCIDENT
TO OR REQUISITE TO OBTAINING THE TITLE POSSESSION
OF SAID LAND; APPROPRIATING $9,060.00 AND SUCH
ADDITIONAL SUMS UP TO $100.00 AS MAY BE INCURRED
AS TITLE EXPENSE FROM NO. 298 CITY OF CORPUS
CHRISTI WATER WORKS CONSTRUCTION FUND; AND D&
CLARING AN EMERGENCY.
WHEREAS, on the date of August 14, 1951 the City Council
of the City of Corpus Christi, Texas, authorized by motion duly passed
the City Manager to negotiate with the owners of approximately 702'
acres of land lying between State Highway 9 and the Nueces River, which
tract is adjacent to city -owned property now occupied by the Calallen Fil-
tration Plant; and
WHEREAS, such negotiations have been completed and the
onwers, NEW NOAKES, ELLIE JAY NOAKES, A feme sole, FRED W. BOWERS and wife,
MARY BOWERS, WIUJI ESTHER MAGEE, individually and as agent and attorney -in-
fact for NEW GORDON NOAKES, joined by her husband W. M. MAGEE, all of Nueces
County, Texas, and WILMA ESTHER MAGEE acting as the guardian of the person
and estate of WILLIAM VIVIAN NOAKES, a minor, also of Nueces County, Texas,
agree to sell to the City of Corpus Christi for and in consideration of
Nine Thousand and Sixty Dollars ($9.060.00) cash in hand paid by the City,
the following described tract, piece, or parcel of land, to -wit:
Being a part of the Lula Mae Noakes Estate, lying
and situated in Nueces County, Texas, and described
as follows:
Beginning at a point, the North East corner of a
13.683 acre tract conveyed to the City of Corpus
Christi, Texas, by deed dated 'September 18, 1941,
and recorded in the Deed Records of Nueces County,
Texas, Volume 274, Pages 48-50, for a corner of
this tract;
Thence S 74 degrees 53' W with the North boundary
line of the aforesaid 13.683 acre tract a distance
of 414.0 feet to the East right bank of the Nueces
River for a corner of this tract;

Thence in a northerly direction with the meanders
of the Nueces River a distance of 6,220 feet,
more or less, to a point, the intersection of
the South right bank of the Nueces River and the West R.
0. IV. line of State Highway No. 9 for a corner of
this tract;
Thence S 17 deg. 32* E with the West R. 0. W. line
of State Highway No. 9 a distance of 5,356.7 feet
to a point, the P. C; of a circular curve to the
right of radius 2,779.9 feet and curvature 2 deg.;
Thence to the right with said circular curve a dis-
tance of 94.8 feet to the place of beginning, and
containing 45.3 acres, more or less,
all of said lands to be used to dispose of the sludge and washing from the
settling basins of the Calallen Plant of the Water Division of the Department
of Public Utilities, and other municipal purposes,
NOW, THEREFORE, BE IT ORDAINCD BY THE CITY COUNCIL Of TIC CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized and
directed, for and on behalf of the City to purchase the following described
land situated in Nueces County, Texas:
Being a part of the Lula Mae Noakes Estate, lying
and situated in Nueces County, Texas, and described
as follows:
Beginning at a point, the North East corner of a 13.663
acre tract conveyed to the City of Corpus Christi,
Texas, by deed dated September 18, 1941, and recorded
in the Deed Records of Nueces County, Texas, Volume
274, Pages 48-50, for a corner of this tract;

Thence to the right with said circular curve a

SECTION 2. That the City Manager is hereby authorized and
directed to do all things incident to or requisite to obtaining the title
and possession of said land.
SECTION 3. That the sum of Nine Thousand and Sixty Dollars
($9,060.00) and such additional sums up to $100.00 as may be incurred as
title expense incident to the acquisition of said land are to be appropriated
from No. 298 City of Corpus Christi Water Works Construction Fund.
SECTION 4. The necessity for acquiring additional land on
which to dispose of the sludge and washing from the settling basins of the
Calallen Plant, and other municipal purposes, creates a public emergency and
public imperative necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date it is
introduced and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared that
such public emergency and imperative necessity exist, and having requested
that such Charter rule be suspended, and that this ordinance be passed
finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going; ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at.three meetings of the
City Council; I. therefore,, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

for the contract, agreement, obligation, or expenditure contemplated
in the above and foregoing Ordinance is in the Treasury of the City
of Corpus Christi to the credit of No. 298 City of Corpus'Christi
Waterworks Construotion
Fund from which it is proposed to be drawn, and such money is not
appropriated for any other purpose.
