HomeMy WebLinkAbout03166 ORD - 11/20/1951AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A LEASE BY AND BETWEEN THE CITY OF CORPUS CHRISTI AND THE KIWANIS CLUB OF CORPUS CHRISTI, TEXAS OF THE BUILDING AND PREMISES SITUATED ON LOT 12 and the S 1/2 - OF LOT 11, ALL IN BLOCK 23, MEADOW PARK ADDITION TO THE CITY OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized and directed to execute for and on behalf of the City of Corpus Christi, a lease of the building and premises as follows: The building and premises situated on Lot 12 and the S 1/2 of Lot 11, all in Block 23, Meadow Park Addition to the City of Corpus Christi, Texas which lease has been awarded to the KIWANIS CLUB OF CORPUS CHRISTI; a copy of which is attached hereto and made a part hereof. SECTION 2. The fact that it is necessary for the KIWANIS CLUB OF CORPUS CHRISTI, as sponsors of a troop of Boy Scouts, to secure said property for the immediate use and in the interest of said Boy Scout Troop, creates a public emergency and public imperative necessity requiring the suspension of the Charter rule and that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative public necessity exist, and having requested that said Charter rule be suspended and that this ordinance be passed finally on the date of its introduction, and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. 6i(,00 PASSED AND APPROVED thisvU day of November. WITNESSAT.H s The City of Corpus Christi, Texas, for valuable consideration, does by these presents lease and demise unto the said Lessee, the following described premises, to -wit: The building and premises situated on Lot 12 and the 5 1/2 of Cot 11, all in Block 23s Readow Paris Addition to the City of Corpus Christi, Texas for the term of five (5) years, said lease beginning on the date hereof and ending fire (5) years from the date hereof, subject to the following conditions and coveraots: 1. The Kiwanis Club of Corpus Christi, Texas hereby and by these presents agrees to accept said premises as completed, to maintain said premises during the tow of this instrument is a clean and sanitary condi- tion, and at the expiration thereof to return said premises to City in as good condition as received, reasonable use, wear, sots of God, fire aid flood excepted. 2. Ito additions or alterations shall be made to the premises without the consent of the City, in writings and any and all improvements placed on said premises which are unattached to the building may be moved by than Lessee at the expiration of this lease. 3. It is the intention of the Kiwants Club of Corpus Christi, Texas that the premises shall be for the use of the Boy Scout Troop sponsored by said Niwanis Club of Corpus Christi, for the use of the Kiwants Club with its projects of collecting and distributing used clothing and other Kirmnis Club projects of said club and for no other purpose.
