SPECIAL, COUNCIL MEETING
MARCH 17, 1976

Mayor Luby called the meeting to order in the Council Chambers of City Hall.
City Secretary Read noted that there was a quorum of the Council and the
necessary Charter Officers present to have a legally constituted meeting.
City Manager Townsend presented Application #176-7, Robert Campbell, for
change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business
District, on Lots 42 thru,45, Block "S", Don Patricio Addition, located on the east
side of Flour Bluff Drive approximately 295' south of its intersection with Don
Patricio Road. He stated that the recommendation of the Planning Commission is that
it be denied, but in lieu thereof a special permit be approved for an air conditioning
sales and repair service on Lots 44 and 45 only, according to the site plan approved
by the Commission on February 17, 1976 which met minimum requirements of the ordinance.
City Manager Townsend'added that Mr. Campbell had submitted a letter to the Council
asking them to waive the screening fence requirement, also; and that in response to
notification of'the hearing, three letters had been received in'favor of the application,
and none in opposition.
No one from the audience spoke regarding the matter.
Motion by Tipton,' seconded by Lozano and passed, that the hearing be closed.
Motion by Gill, seconded by Tipton and passed, that'Application #176-7, Robert
Campbell, for change of zoning from "R -1B" to "B-4" be denied, but in lieu thereof a
special permit be approved for an air conditioning sales and repair service on Lots
44 and 45 only, according to the site plan approved by the Planning Commission on
February 17, 1976 which met minimum requirements of the ordinance, and as amended to
include the requirement that a fence be built along the appropriate property lines if
an adjacent residential structure is'built.
City Manager Townsend next presented the Text Amendment to Zoning Ordinance
No. 6106, to amend Article 13, "B-1" Neighborhood Business District Regulations, Section
13-2, Use Regulations, paragraphs (4), (7), and (12) as follows:

(4) Dressmaking, tailoring, shoe repairing, repair of household
appliances and bicycles, dry cleaning and pressing, upholstery
'shop, bakeries with sale of bakery products on the premises,
and other uses of a similar character,provided that no use
permitted in this item shall be operated outside a building or
occupy more than 2,500 square feet of floor area.

(7) Add the words "On -premise" at the beginning of the paragraph,
prior to the word "advertising".
(12) Striking the period and adding the words "customarily inci-
dental to the uses permitted in the district."
Recommendation of Planning Commission: That Article 13, Section 13-2
Use Regulations be amended by adding "upholstery shop" as a permitted
use, but that the use not be restricted to inside a building; and
that Paragraphs (7) and (12) be amended as proposed by the staff.
Mr. Ramon Castaneda spoke relative to the text amendment; that he was fearful
its approval would limit expansion of his upholstery shop business.

of the Planning Commission on the text amendment. •
Motion by Gill, seconded by de Ases and passed, that the Special Council Meeting
be recessed until 4:00 p.m., March 24, 1976.
