HomeMy WebLinkAbout03187 ORD - 12/26/1951AN ORDINANCE AMENDING ORDINANCE NO. 760, KNOWN AS THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGE 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, AS AMENDED FROM TIME TO TIME THEREAFTER, AND IN PARTICULAR, AS AMENDED BY ORDINANCE NO. 2266, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 4TH DAY OF MAY, 1948, AND APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF SAID CITY, BY AMENDING THE ZONING ORDINANCE AND MAP APPROVED BY THE CITY COUNCIL ON MAY 4, 1948, BY CHANGING THE PRESENT ZONING OF: A TRACT OF LAND 160 FEET ALONG GOLLIHAR ROAD AND 237 FEET ALONG WEBER ROAD AT THE SOUTHWEST CORNER OF THE INTERSECTION OF GOLLIHAR ROAD AND WEBER ROAD TO B- I,'NEIGHBORHOOD BUSINESS DISTRICT USE: LOTS 1, 2, 3 AND 4, BLOCK 3, NELSON ADDITION NO. 2 TO B -3; SECONDARY BUSINESS DISTRICT USE; LOT 25, BLOCK I, LOMA ALTA ADDITION TO L -I, LIGHT INDUSTRIAL DISTRICT USE; ALL OF BLOCK 3, GENEVA HEIGHTS ADDITION TO B -3, SECONDARY BUSINESS DISTRICT USE; A TRIANGULAR PIECE OF PROPERTY 119.89 FEET ON BUFFALO, 149.91 FEET ON LAWRENCE AND 83.73 FEET ON ROSE STREET TO B -1, NEIGHBORHOOD BUSINESS DISTRICT USE; AND A PORTION OF BLOCK 10 BARTHLOME ADDITION, BEGINNING AT THE SOUTHWEST CORNER OF BLOCK 10 EXTENDING 105.38 FEET ALONG THE NE LINE OF BARTHLOME STREET AND 136.39 FEET ALONG THE E LINE OF LILY STREET, TO B -4, PRIMARY BUSINESS DISTRICT USE; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ZONING ORDINANCE AS AMENDED; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION OF THE CITY OF CORPUS CHRISTI, HAS, AFTER DUE NTOICE, HEARING AND CONSIDERATION BY IT, FORWARDED . THE FOLLOWING ZONING AMENDMENTS TO SAID COUNCIL FOR ACTION; AND WHEREAS, THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, AT ITS REGULAR MEETING HELD ON THE 25TH DAY OF SEPTEMBER, 1951, ORDERED A PUBLIC HEARING TO BE HELD ON THE IST DAY OF NOVEMBER, 1951, AT 4:00 O'CLOCK P. M. IN THE COUNCIL CHAMBER AT THE CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, AFTER DUE NOTICE, THE COUNCIL DID HOLD SUCH PUBLIC HEARING AND AN EXECUTIVE SESSION THEREON, AT WHICH PUBLIC HEARING ALL INTERESTED CITIZENS, PROPERTY OWNERS, AND OTHER PARTIES HAD THE OPPORTUNITY OF BEING HEARD ON SAID PROPOSALS, AND AT SUCH HEARING ALL PARTIES INTERESTED AND WISH- ING TO APPEAR WERE HEARD; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS 3�� iJBq SECT'I'ON 1. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI PASSED ON THE 27TH-DAY OF AUGUST, 1937, APPEAR- ING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, TEXAS, AND AS AMENDED FROM TIME TO TIME THEREAFTER, AND IN PARTICULAR, AS AMEND - .1'• ED BY ORDINANCE No. 2266, PASSED AND APPROVED BY THE CITY COUNCIL OF THE SAID CITY ON THE 4TH DAY OF MAYS 1948, AND APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF SAID ORDINANCE AND RESOLUTION RECORDS , OF SAID CITY, BE AND THE SAME IS HEREBY AMENDED IN THOSE PARTICULARS HEREIN SET FORTH: SECTION 2. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS A TRACT OF LAND 160 FEET ALONG GOLLIHAR ROAD AND 237 FEET _ ALONG WEBER ROAD AT THE SOUTHWEST CORNER OF THE INTERSECTION OF GOLLIHAR ROAD AND WEBER ROAD IN THE CITY OF CORPUS CHRISTI, TEXAS, BE CHANGED FROM PRESENT ZONING FOR R -1, ONE FAMILY DWELLING DISTRICT USE TO B -1, NEIGHBORHOOD BUSINESS DISTRICT USE, AND THE SAME IS HEREBY REZONED. SECTION 3. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS No. 2 LOTS 1, 2, 3, AND 4, BLOCK 31 NELSON ADDITION /TO THE CITY OF CORPUS CHRISTI TEXAS BE CHANGED FROM PRESENT ZONING FOR A -1, FIRST APARTMENT HOUSE DISTRICT USE TO B -3, SECONDARY BUSINESS DISTRICT USE, AND THE SAME IS HEREBY REZONED. SECTION 4. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS LOT 25, BLOCK 1, LOMA ALTA ADDITIONS BEING GENERALLY THAT PROPERTY LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF CHICO AND COMANCHE STREETS, IN THE CITY OF CORPUS CHRISTI TEXAS, BE CHANGED FROM PRESENT ZONING FOR A -2 SECOND APARTMENT HOUSE DISTRICT USE TO L -1, LIGHT INDUSTRIAL DISTRICT USE, AND THE SAME IS HEREBY REZONED. SECTION 5. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS, ALL OF BLOCK 3, GENEVA HEIGHTS ADDITION TO THE CITY OF CORPUS CHRISTI, TEXAS, BE CHANGED FROM PRESENT ZONING FOR A -2, SECOND APARTMENT HOUSE DISTRICT USE TO B -3, SECONDARY BUSINESS DISTRICT USE, AND THE SAME IS HEREBY REZONED. -2- 4 ' SECTION 6. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS: A TRIANGULAR PIECE OF PROPERTY 118.89 FEET ON BUFFALO STREET, 149.91 FEET ON LAWRENCE DRIVE AND 83.73 FEET ON ROSE STREET IN THE CITY OF CORPUS CHRISTI, TEXAS BE CHANGED FROM PRESENT ZONING FOR A -I, FIRST APARTMENT HOUSE DISTRICT USE TO B -1, NEIGHBORHOOD BUSINESS DISTRICT USE, AND THE SAME IS HEREBY REZONED. SECTION 7.• THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS: A PORTION OF BLOCK IO, BARTHLOME ADDITIONy BEGINNING AT THE SOUTHWEST CORNER OF BLOCK IO AND EXTENDING 105.38 FEET ALONG THE NORTHEAST LINE OF BARTHLOME STREET, AND 136.39 FEET ALONG THE EAST LINE OF LILY STREET, IN THE CITY OF CORPUS CHRISTI, TEXAS, BE CHANGED FROM PRESENT ZONING FOR A -2, SECOND APARTMENT HOUSE DISTRICT USE TO B -4, PRIMARY BUSINESS DISTRICT USE, AND THE SAME IS HEREBY REZONED. SECTION 8. THAT THE ZONING MAP OF THE CITY OF CORPUS CHRISTI BED AND THE SAME IS HEREBY, AMENDED AS HEREINBEFORE ORDAINED. _ SECTION 9. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED. SECTION 10. THAT THE SAID ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, APPROVED ON THE 4TH DAY OF MAYS 1948, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION II. THAT THE FACT IT IS NECESSARY TO PUT IN FORCE IMMEDI- ATELY THE CHANGES IN THE SAID ZONING ORDINANCE AND MAP AS HEREIN PROVIDED SUCH ZONING BEING OF THE GREATES PUBLIC IMPORTANCE IN THE ORDER, GROWTH AND DEVELOPMENT OF THE CITY OF CORPUS CHRISTI, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE -3- MAYOR, DECLARING SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUEST- ED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT�IS ACCORDING - LY PASSED AND'APPROVED, THIS TH a44 bAY OF DECEMBER, A.D. 1951• OR 20 4 TP HE CITY OF C US CHRISTI, TEXAS TESTED: CITY SECRETARY APPROVED AS TO EGAL FORM: CITY AT40RNEY Corpus Christi, Texas TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas „ Gentlemen: .`', a •.« For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council, Respectfully, 6JYOR Pte - City of Co s Christi, Texas The Charter rule was suspended by the following vote: Leslie Wasserman Jack DeForrest Sydney E.
