WBEAEAS, it has been determined that it is desirable to have a
combination of City and County Welfare Departments and that such com-
bination would be more effective in the field of public welfare and more
economical in operation; and
WHEREAS, it is the desire of both the City of Corpus Christi x
acting through the City Council, and the County of Nueces acting through
its Commissioners' Court'to create such a-City- County Welfare Board and
to vest power of administration of public welfare matters in Welfare
Board and provide for the financing of expenses and activities of said
board: "Now therefore, be it ordained by the City Council of the City of
Corpus Christi ":
SECTION I: There is hereby created a Board composed of seven (7)
members to be known as the "City- County Board of Public Welfare" which said
Board shall be composed of two (2) members of the'City Council appointed by
the Council; two (2) members of the County Commissioners' Court appointed
by the Commissioners' Court; two (2) resident citizens of Nueces County,
one of whom shall be appointed by the City Council and one by the County
Commissioners' Court; and one (1) person to be selected by the majority vote
of the six appointed members. This seventh member shall be a resident
citizen of the City of Corpus Christi and Nueces County, Texas, who is not
thebDlder of any public office, and who upon selection shall act as Chairman
of the Board.
SECTION II: DEFINITIONS: Whenever the term "City" is used herein
then the term shall mean the City -of Corpus Christi acting by and through
its City Council, and whenever the term "County" is used the name shall mean
the County of Nueces acting by and through its County Commissioners' Court.
The term "members of the City Council" shall include the
Commissioners and the Mayor. And the term "County Commissioners' Court"
shall include the County Commissioners and the County Judge of Nueces County.
SECTION III: No compensation shall be paid to the members of the
Board for their services on the Board.
SECTION 17: The terms of office shall be for two (2) years and
until their successors shall have been appointed and du]y qualified except
that the terms of those appointed prior to May 1, 1953, shall expire
May 10 1953. Thereafter, the terms shall run from May 1 of each odd - numbered
year for two (2) years.
SECTION V. The members of said Board shall take an oath of office
such as is'r'equired of State Officers under the constitution. The Board
shall hold at least one meeting each month, to be designated by the Board,
and the failure of any member to attend three (3) consecutive regular meetings
shall cause a vacancy in his office unless said absence is excused by formal
action of the Board. Any member of said Board may be removed from office by
the joint action of the City Manager and County Judge: )Any board member so
removed by the City Manager and County Judge may, within five days after such
removal, request in writing a public hearing before a joint session of the
governing body and Commissioners' Court XAt such hearing a majority vote of
each governing body voting for oragainst the sustaining of 'said removal
shall be taken and in the event one body votes to sustain and the other
reject the action of the City Manager and the County Judge, then, in that
event, the removal as ordered by the City Manager and the County Judge shall
be deemed to be sustained.
SECTION VI: The City - County Welfare Board, upon appointment and
qualification, shall select from their own members a Vice - Chairman and
Secretary. The Board shall have the general supervision, management and
control over the administration of relief to the indigent and poor who are
residents of Nueces County, Texas, and subject to the terms of the City
Charter over all matters of public welfare. The Board shall have power to
make such rules end regulations as may be necessary or proper to carry out
the duties with reference to handling of public relief and administration of

public welfare in the City of Corpus Christi and County of Nueces; provided
that no rules shall be inconsistent with the laws of the State of Texas or
with the Charter or Ordinances of the City of Corpus Christi. /
SECTION VII: The Board shall have the power and authority to
provide for keeping of records and adopt such rules as may be deemed expedient,
c. subject, however, to the Charter and Ordinances of the City of Corpus Christi
and the applicable laws of the State of Texas and the United States.
SECTION VIII: The City- County Welfare Board shall recommend to the
governing body of the City of Corpus Christi and the Commissioners? Court of
Nueces County the probable amount of money necessary to administer needed
relief in the City of Corpus Christi and the County of Nuedes. Such recommen-
dation shall be made on or before the first (1st) day of June of each year, or
at such time as may be required by the budgetary officers of the City and of
the County of Nueces, and the amount actually allotted for this purpose shall
be agreed upon by the City and County of Nueces. The appropriation made by
the governing body and the Commissioners? Court shall be in the proportion as
may be agreed upon by the City and County covering the cost, conduct and
operation of the relief provided for under this Ordinance.
SECTION IX: The said City - County Welfare Board shall keep a record
of its official proceedings, a copy of which shall be furnished to the City
Manager of the City of Corpus Christi and another copy to the County Judge
of the County of Nueces. The Chairman of the Board shall be responsible for
the keeping of these minutes and the distribution thereof as hereinabove
set forth.
SECTION X: The City and County will provide in their respective
budgets proposed eipenditures in detail, and no expenditures shall be made
that are not provided for therein.
SECTION XIs This Ordinance shall become effective upon passage
thereof by the City Council as provided for by the City Charter and upon the
approval thereof by the Commissioners' Court of Nueces County by passing by
such County Commissioners' Court of a resolution approving the terms and
provisions of this ordinance by causing said resolution, together with a
copy of this Ordinance to be spread upon the minutes of the Commissioners
Court. ^

SECTION %II: The fact that closer cooperation between City - County
Public Welfare Agencies is needed and that such cooperation can be accomplished
by City- County Welfare Board creates a public emergency and imperative public
necessity requiring the suspension of the City Charter Rule or requirement
that no ordinance or resolution shall be passed finally on the date it is
introduced, and that such ordinance or resolution shall be read at three several
i meetins of the City Council, and the Mayor having declared that such public
emergency and imperative public necessity exist, and having requested that said
Charter rule be suspended andthat this ordinance be passed finally on the date
of its introduction, and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
hereby request that you suspend said Charter rule or requirement and pass this
ordinance finally on the date it is introduced, or at the present meeting of
the City Council,
