IMSINGER:GP -0 JUNE 23, 1952 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE A CANCELLATION OF GRANT AGREEMENT TO BE SUBMITTED TO THE ADMINISTRATOR OF CIVIL AERO- NAUTICS, U. S. DEPARTMENT OF COMMERCE TO OBTAIN FEDERAL AID IN THE DEVELOPMENT OF CLIFF MAUS MUNICIPAL AIRPORT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE A CANCELLATION OF GRANT AGREEMENT TO BE SUBMITTED TO THE AD- MINISTRATOR OF CIVIL AREONAUTICS, U. S. DEPARTMENT=OF COMMERCE, TO OBTAIN FEDERAL AID IN THE DEVELOPMENT OF CLIFF WAS MUNICIPAL AIRPORT, EXECUTION TO BE IN SIX (6) COPIES, AN UN- EXECUTED COPY OF WHICH AGREE- MENT IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. IT BEING NECESSARY TO CANCEL THE PREVIOUS GRANT AGREE -- MENT IN ORDER TO PURSUE THE OBTAINING OF A NEW GRANT AGREEMENT AND THE URGENCY OF IMMEDIATELY EXECUTING SUCH CANCELLATION OF SAID GRANT AGREE- MENT CREATES AN EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL , AND THE MAYOR, HAVING DECLARED SUCH PUBLIC EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVED, THIS THE 211TH DAY OF JUNE, 1952. Williamson_ en AMBIMIENT OF CANC&LATION OF GWNT AGRcBINT - C4ca -6397 Cliff Maus Municipal Airport Project go. 9-41-#19-801 '„`H'REAS, The City of Corpus Christi, Texas, is the Sponsor of a project for the development of the Cliff Maus Municipal Aii,rzp�port under a Grant Agree - ment, pursuant to Section 12 of the Federal Airport Act between the Adminis- trator of the Civil Aeronautics, acting for and on behalf of the United Steiiee, and the City of Corpus Christi, the said Grant Agreement, which is for land acquisition, having been executed and accepted by the City of Corpus Christi on June 17, 1951; and �t'10YEAS, no funds have been expended as the United Statest share of any project costs under said grant Agreement, and VIEREAS, Tho City of Corpus Christi, Texas, has requested the Administrator of Civil Aeronautics that such Grant Agreement be rescinded and cancelled provided a new Grant Agreement between the City of Corpus Christi, Texas,-on the one part, and'the United States of America, on the other part, is executed, which Grant Agreement is to include nscesaary airport construction and development, including extension of the Instrument landing runway and other landing area facilities, together with the acquisition of a tract or parcel of land of approximately 19.55 acres neceseary for the installation of instrument landing facilitieal and WHcWS, the City of Corpus Christi, Texas, has submitted a project Appli- cation dated April 25, 1952, relating to the above referred to airport con - struction and development) and MILRtEAS, The Administrator of Civil Aeronautics has determined that it is to the interest of the United States that the said existing Grant Agreement for subject project be terminated, provided the Grant Agreement based on the Project Application hersinabove referred to is exeoutedl NOW, 11,UARZ?n?X, , WITNESWT'd s That in consideration of the benefits to accrue to the parties hereto; the Administrator of Civil Aeronautics, on behalf of the United States of America, on the one part, and the City of Corpus Christi, Texas, on the other part, do hereby mutually agree that the Grant Agreement between the United States and the City of Corpus Christi, executed by the City of Corpus Christi on June 7, 1951, same being Grant Agreement No. 04ca -63970 CAA Project Ito. 9-a- 079 -801, is hereby cancelled and terminated without any liability thereunder by either party thereto and is of no force and effect as if the said Grant Agreement had not been issued by the Adminis- trator or accepted by the City of Corpus Christi, Texas.
