HomeMy WebLinkAbout03297 ORD - 07/29/195213'�Z y AN ORDINANCE PRESCRIBING TEE TAXES TO BE LEVIED, ASSESSED AND COL- LECTED BY THE CITY OF CORPUS CHRISTI, TEXAS, FOR THE YEAR 1952 AND FOR EACH SUCCEEDING YEAR THEREAFTER UN—° TIL OTHERWISE PROVIDED AND ORDAINED; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby levied, to be assessed and collected in current money of the United States of America, for the use of the City of Corpus Christi, Texas, for the year 1952, and for each succeeding year there- after, until otherwise provided and ordained, an annual direct ad valorem tax of One Dollar ($1) on each One Hundred Dollars ($100) value thereof, on all property, real, personal, and mixed, located within the said City of Corpus Christi, Texas, upon which a tax is authorized to be levied by law, and upon all franchises of all individuals, partners, and corporations holding franchises in the City from said City of Corpus Christi, Texas, said tax to be appropri- ated to the payment and defrayment of current expenses of the government of said City; and $0.02 of the $1 mentioned above is hereby appropriated to the interest and sinking fund of the following: (a) General Funding Warrants, Series 1929, dated November 1, 1929 (b) General Fund Refunding Bonds, Series 1936, dated April l,"1936.. SECTION 2. That there is hereby levied to be assessed and collected in current money of the United States of America, for the use of the City of Corpus Christi, for the Year 1952, and for each succeeding year thereafter un- til otherwise provided and ordaine4, an annual direct ad valorem tax of $0.25 on each One Hundred Dollars ($100) of value thereof, upon all property and franchises described in Section 1 of this ordinance, said tax to be appropriat- ed and used in making payments for general street improvements and building,- bridges in the City of Corpus Christi, Texas. SECTION 3. That for the purpose of paying interest and providing the necessary sinking funds for the payment of outstanding bonds and bonded indebt- edness of the City of Corpus Christi, and for paying interest and making provisions for the sinking fund of such future issues as may be authorized, there is hereby —1— levied for the year 1952, and for each succeeding year thereafter, unless other- wise provided and ordained, to be assessed and collected in current money of the United States of America, upon all property and franchises described in Section 1 of this Ordinance, an annual direct ad valorem tax of $0.75 on each One Hundred Dollars ($100) of value thereof, which said taxes as and when the same shall be collected, shall be appropriated and credited.to the following bond interest and sinking funds of the City of Corpus Christi, Texas: (1) Out of said amount of,$0.75 there is hereby appropriated $0.1640 for the purpose of paying interest and creating the necessary sinking fund to pay Refunding Bonds, Series 1936, dated February 1, 1936; (2) Out of said amount of $0.75 there is hereby appropriated $0.0058 for the purpose of paying interest and creating the necessary sinking fund to pay Municipal Auditorium Bonds, Series 1950, dated January 15, 1950; (3) Out of said amount of $0.75 there is hereby appropriated $0.0327 for the purpose of paying interest and creating the necessary sinking fund to pay Municipal Auditorium Bonds, Series 1950 —A, dated November 1, 1950; (4) Out of said amount of $0.75 there is hereby appropriated $0.0104 for the purpose of paying interest and creating the necessary sinking fund to pay Police Building Bonds, Series 1950, dated January 15, 1950; (5) Out of said amount of $0.75 there is hereby appropriated $0.0214 for the purpose of paying interest and creating the necessary sinking fund to pay Storm Sewer Bonds, Series 1950, dated January 15, 1950; (6) Out of said amount of $0.75 there is hereby appropriated $0.0204 for the purpose of paying interest and creating the necessary sinking fund to pay Storm Sewer Bonds, Series 1950 —A, dated November 1, 1950; (7) Out of said amount of $0.75 there is hereby appropriated $0.0065 for the purpose of paying interest and creating the necessary sinking fund to pay Street Traffic Control System Bonds, Series 1950, dated January 15, 1950; (8) Out of said amount of $0.75 there is hereby appropriated $0.0161 for the purpose of paying interest and creating the necessary sinking fund to pay Public Library Bonds, Series I950, dated November 1, 1950; (9) Out of said amount of $0.75 there is hereby appropriated $0.0435 for the purpose of paying interest and creating the necessary sinking fund to pay Sanitary Sewer Improvement and Extension Bonds, Series 1940, dated June 1, 1940; (10) Out of said amount of $0.75 there is hereby appropriated $00320 for the purpose of paying interest and creating the necessary sinking fund to pay Street Improvements Bonds, Series 1940, dated June 1, 1940; —2— (11) Out of said amount of $0.75 there is hereby appropriated $0.0350 for the purpose of paying interest and creating the necessary sinking fund to pay Street Improvement Bonds, Series 1941, dated December 1, 1941; (12) Out of said amount of $0.75 there is hereby appropriated $0.0130 for the purpose of paying interest and creating the necessary sinking fund to pay City Hall Bonds, Series 1950, dated January 15, 1950; (13) Out of said amount of $0.75 there is herebyappropriated $0.0320 for the purpose of paying interest and creating the necessary sinking fund to pay Street Improvement Bonds, Series 1946, dated December 1, 1946; (14) Out of said amount of $0.75 there is hereby appropriated $0.0065 fbr =the purpose of paying interest and creating the necessary sinking fund to pay Street Improvement Bonds, Series 1950, dated January 15, 1950; (15) Out of said amount of $0.75 there.is hereby appropriated $0.01I9 for the purpose of paying interest and creating the necessary sinking fund to pay Street Improvement Bonds, Series 1950 -A, dated November 1, 1950; (18) Out of said amount of $0.75 there is hereby appropriated $0.0057 for the purpose of paying interest and creating the necessary sinking fund to pay Public Park Bonds, Series 1950vAdated January 15, 1950; (32) Out of the amount of $0.75 there is hereby appropriated $0.0397 for the purpose of paying interest and creating the necessary sinking fund to pay Sanitary Sewer Improve- ment Bonds, Series 1948, dated June 1, 1948; (33) Out of the amount of $0.75 there is hereby appropriated $0.0249 for the purpose of paying interest and creating . the necessary sinking fund to pay Street Improvement Bonds, Series 1948; dated June 1, 1948; (35) Out of the said amount of $0.75 there is hereby appropriated $0.0134 for the purpose of paying interest and creating the necessary sinking fund to pay Street Improvement Bonds, Series 1951, dated September 1, 1951; (36) Out of said amount of $0.75 there is hereby appropriated $0.0015'for the purpose of paying interest and creating oofo the ncessary sinking fund to pay Airport Improvement Bonds, Series 1951, dated September 1, 1951; —4- (37) Out of the said amount of $0.75 there is hereby appropriated $0.0051 for the purpose of paying interest and creating the necessary sinking fund to pay Sanitary Sewer Improvement Bonds, Series, 1951, dated September 1, 1951; (38) Out of said amount of $0.75 there is hereby appropriated $0.0065 for the purpose of paying interest and creating the necessary sinking fund to pay Storm Sewer Improvement Bonds, Series 1951, dated September 1, 1951; (39) Out of said amount of $0.75 there is hereby appropriated $0.0107 for the purpose of paying interest and creating the necessary sinking fund to pay Fire Station Bonds, Series 1951, dated September 1, 1951; and (40) Out of said amount of $0.75 there is hereby appropriated $0:0051 for the purpose of paying interest and creating the ncessary sinking fund to pay Public Park Bonds, Series 1951 (in process of issuance); SECTION 4. All taxes for the year 1952 hereby levied shall become due and payable at the office of the Tax Assessor — Collector of the City of Corpus Christi, Texas,on or after the first day of October, 1952, and if the taxes levied for said year are not paid on or before January 31st next after becoming due, in- terest shall be charged upon the gross amount of the taxes due and penalty due until paid at the rate of one halt of one per cent (1/2 of 1%) for each month or fraction thereof thereafter. Said interest shall be in addition to such penalties as may be hereafter provided for delinquent taxes. SECTION 5. That the fact that the passage of an ordinance for the levy- ing of taxes for the City of Corpus Christi for the year 1952, is necessary and important to the people of the City and the further fact that the preparation and completion of the tax rolls of the City for the year 1952 is dependent upon the passage of this ordinance, and in order that said tax roll may be completed and ready for the collection of said taxes when the same become due and payable as aforesaid, creates an emergency and an imperative public necessity requiring the suspension of the Charter rule providing that no resolution or ordinance shall be passed finally on the date of its introduction and that such ordinance or reso- lution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the sus- pension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and —5— 11 after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, This the 29th day of July, A.D. 1952. ` Gi�pp 11VIOR HE CITY OF CORPUS CHRISTI, TEXAS EST: City Secretary APPROVED AS TO fEGAL FORM: City A tot ey t -6- Corpus Christi, Texas 19 �•Z, TO ME MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council, Respectfully, 60YOR f o City of Corpus Christi, Texas The Charter rule was suspended by the following vote: 'i':eslie Wasserman Jack DeForrest i Sydney E.
