RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION OF
ADDITIONS AND ENLARGEMENTS TO THE SEWAGE TREATMENT
PLANTS AT THE OSO ANDBROADWAY PLANTS BY HELDENFELS
BROTHERS UNDER THEIR CONTRA W TH THE CITY DATED
JANUARY 4, 1951, A5 AUTHORIZED BY ORDINANCE NO. 2952;
GRANTING AN EXTENSION OF TIME ON SAID CONTRACT AS
RECOMMENDED; AUTHORIZING FINAL PAYMENT IN THE AMOUNT
OF TWELVE THOUSAND SIX HUNDRED TWENTY -SEVEN DOLLARS
AND THIRTY -ONE CENTS ($12,627.31), AS REFLECTED BY
THE FINAL ESTIMATE PREPARED BY THE DIRECTOR OF PUBLIC
WORKS ATTACHED HERETO AND DATED AUGUST 4, 1952, SUCH
AMOUNT TO BE PAID OUT OF THE FUNDS HERETOFORE APPROPRIAT-
ED AND SET ASIDE OUT OF NO. 299 IMPROVEMENT BONDS 1
CONSTRUCTION FUND (SANITARY SEWER IMPROVEMENTS ; AND
DECLARING AN EMERGENT
WHEREAS, THE WORK OF CONSTRUCTING ENLARGEMENTS AT THE OSO SEWAGE TREAT-
MENT PLANT AND STRUCTURES AT THE BROADWAY SEWAGE TREATMENT PLANT IN THE CITY
OF CORPUS CHRISTI, TEXAS, HAVING BEEN COMPLETED IN ACCORDANCE WITH THE PLANS
AND SPECIFICATIONS, AND THE SAME HAVING BEEN INSPECTED AND RECOMMENDED FOR AC-
CEPTANCE BY THE DIRECTOR OF PUBLIC WORKS, AND FREESE, . NICHOLS, AND TURNER,
CONSULTING ENGINEERS FOR THIS PROJECT CONCURRING IN SAID RECOMMENDATION, AND
AN EXTENSION OF TIME OF SAID CONTRACT HAVING BEEN RECOMMENDED, AND REQUEST
FOR FINAL PAYMENT HAVING BEEN MADE:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE WORK OF CONSTRUCTION OF ENLARGEMENTS AT THE OSO
TREATMENT PLANT AND STRUCTURES AT THE BROADWAY SEWAGE TREATMENT PLANT OF THE
CITY OF CORPUS CHRISTI, TEXAS, BY HELDENFELS BROTHERS UNDER THEIR CONTRACT
WITH THE CITY DATED JANUARY 4, 1951, AS AUTHORIZED BY ORDINANCE NO. 2952, HAV-
ING BEEN PERFORMED AND COMPLETED IN ACCORDANCE WITH THE PLANS.,AND SPECIFICATIONS
AND CONTRACT DOCUMENTS, AND THE REQUEST FOR EXTENSION OF TIME WAS DULY MADE BY
THE CONTRACTOR AND SUCH REQUEST IS GRANTED AND SUCH CONTRACT EXTENSION HEREBY
AGREED TO.
SECTION 2. THAT THE DIRECTOR OF PUBLIC WORKS HAVING INSPECTED AND CERTI-
FIED TO THE COMPLETION OF SAID WORK IN ACCORDANCE WITH SUCH CONTRACT DOCUMENTS,
PLANS AND SPECIFICATIONS, AND THE CONSULTING ENGINEERS CONCURRING IN SAID RE-
COMMENDATION, THE CONSTRUCTION WORK OF ADDITIONS TO SAID SEWAGE PLANTS PERFORM-
ED BY HELDENFELS BROTHERS AS AFORESAID IS HEREBY FOUND TO HAVE BEEN COMPLETED
IN ACCORDANCE WITH SAID PLANS AND SPECIFICATIONS, AND 1S HERE NOW ACCEPTED AND
RECEIVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS.

SECTION 3. THAT FINAL PAYMENT DUE UNDER THE CONTRACT DESCRIBED IN
SECTION 1 HEREOF BE MADE IN ACCORDANCE WITH THE FINAL ESTIMATE ATTACHED
HERETO PREPARED BY THE DIRECTOR OF PUBLIC WORKS AND DATED AUGUST 4, 1952,
IN THE SUM OF TWELVE THOUSAND SIX HUNDRED TWENTY -SEVEN DOLLARS AND THIRTY-
' ONE CENTS 1$12,627.302 SUCH AMOUNT TO BE PAID OUT OF THE FUNDS HERETOFORE
APPROPRIATED AND SET ASIDE OUT OF NO. 299 IMPROVEMENT BONDS 1950 CONSTRUC-
TION FUND (SANITARY SEWER IMPROVEMENTS), AND SAID AMOUNT 13 HEREBY AUTHORIZED
TO BE PAID SAID CONTRACTOR.
SECTION 4. THAT THE NECESSITY OF COMPLETING SAID PROJECT BY ACCEPTING
THE SAME AND MAKING THE FINAL PAYMENT THEREFOR IMMEDIATELY, SAID PROJECT
BEING OF THE GREATEST IMPORTANCE AND BENEFIT TO THE PUBLIC HEALTH, SAFETY,
AND GENERAL WELFARE, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC
NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
• RESOLUTt ON SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE'OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE
CITY COUNCIL, AND THE MAYOR, DECLARING SUCH EMERGENCY AND NECESSITY TO EXIST,
HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN
FULL FORCE AND EFFECT FROM AND AFTER ITS PA E, IT IS ACCORDINGLY PASSED

Gentlemen:
For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
hereby request that you suspend said Charter rule or requirement and pass this
ordinance finally on the date it is introduced, or at the present meeting of
the City Council.

With rsfsreme to the contract between the City of Corpus Christi, Texas and
Fo2dentels Brothers for the enlargement of the Oso Treatment Plant and con-
struction of concrete atreotires at the $nadeq Swage Treatment Plant, this
contract overran the time{ and on September 6, 1951, the contractor advised
Freese, lachols and Turner, Consulting Engineera, that an extension of time
would be in order because they were unable to gat delivesq on equipment that
was to oo inoorporated in tho structures.
The writer verifies tho dolq► in shlpmw& of equlpmant, %nick has been difficult
to obtain, and as late as April and MW of thin yeas now of the elsotrioal
