SOUTH STAPLES STREET AND WEBER ROAD AS DESCRIBED HEREIN TO "B -1 ", NEIGHBORHOOD BUSINESS DIS- TRICT USE; AND LOT 16, BLOCK 2, BAYVIEW ADDITION TO "B -3 ", SECONDARY BUSINESS DISTRICT USE; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCES AS AMENDED; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL FOR ITS CONSIDERATION ITS REPORT CONCERNING CERTAIN APPLICATIONS FOR AMENDMENT TO THE PRESENT ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, THE CITY'COUNCIL, AFTER DUE NOTICE, HELD A PUBLIC HEARING ON . AUGUST 28, 1952, AT 2:00 O'CLOCK P.M. IN THE CITY COUNCIL CHAMBER OF THE CITY HALL IN THE CITY OF CORPUS CHRISTI, AT WHICH HEARING ALL INTERESTED CITIZENS, PROPERTY OWNERS AND OTHER PARTIES HAD THE OEPORTUNITY TO BE HEARD AND WERE HEARD ON SUCH CHANGES; AND WHEREAS, PRIOR TO THAT TIME CERTAIN OF THE HEREINAFTER CHANGES, AS SET OUT IN SECTIONS 2, .3, 4, WERE CONSIDERED AT A PUBLIC HEARING HELD ON THE 24TH DAY OF JULY, n.D. 1952; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE No. 2266, PASSED AND APPROVED ON THEp4TH X31-7 DAY OF MAY, 1948, ARPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF THE SAID ORDINANCE AND RESOLUTION RECORDS, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGES IN ZONING AS HEREINAFTER SET OUT. SECTION 2. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS LOTS 41 THROUGH 58, INCLUSIVE, BLOCK 10032 FITCHUE PLACE ADDITION BEING GENERALLY THAT PROPERTY LOCATED ALONG THE EAST SIDE OF BROWNLEE BOULEVARD AND EXTENDING 400 FEET NORTHWARD FROM A POINT 200 FEET NORTH OF AYERS STREET, SUBJECT TO AND PROVIDING THAT ONE SQUARE FOOT OF OFF- STREET PARKING SPACE BE PROVIDED FOR EACH SQUARE FOOT FLOOR SPACE BY THE ABUTTING PROPERTY OWNERS, BE CHANGED FROM "A -211, SECOND APARTMENT HOUSE DISTRICT USE TO "B -111, NEIGHBOR- HOOD BUSINESS DISTRICT USE. SECTION-3. SECTION 6. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS AN AREA LOCATED AT THE SOUTHWEST CORNER OF SOUTH ALAMEDA AND DODDRIDGE STREETS BEING DESCRIBED AS A QUARTER CIRCULE HAVING A RADIUS OF 400 FEET AND HAVING AS ITS CENTER LOCATED AT THE INTERSECTION OF THE WEST AND AND SOUTH LINES OF ALAMEDA AND DODDRIDGE STREETS RESPECTIVELY SUCH AREA ALSO BEING DESIGNATED AS "BUSINESS AREAt1 ON THE PRE- . SECTION 7. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS > AN AREA AT THE SOUTHWEST CORNER OF SOUTH ALAMEDA AND DODDRIDGE STREETS GENERALLY DEFINED BY LINES DRAWN PERPENDICULAR TO THE STREETS AT POINTS LOCATED 520 FEET AND 600 FEET RESPECTIVELY FROM THE CORNER EXCEPT FOR THAT AREA DESCRIBED IN PARAGRAPH 1 ABOVE; SUCH AREA ALSO DESCRIBED AS LOTS 1 THROUGH 13, BLOCK 3, AND 7 THROUGH 10, BLOCK 4, ON THE PRELIM NARY PLAT OF POPE PLACE, UNIT 11 DATED APRIL 12, 1952, ON FILE IN THE OFFICE OF THE ZONING AND PLAN- NING COMMISSION OF THE CITY OF CORPUS CHRISTI, BE CHANGED FROM IIR -11I ONE FAMILY DWELLING DISTRICT USE TO IIR -2II TWO FAMILY DWELL- ING DISTRICT USE. SECTION 8. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS AN AREA AT THE SOUTHEAST CORNER OF SOUTH STAPLES STREET AND WEBER ROAD FRONTING APPROXIMATELY 500 FEET ALONG THE EAST SIDE OF SOUTH STAPLES EXTENDING TO A DEPTH OF APPROXIMATELY 270 FEET SUCH AREA ALSO BEING DESIGNATED AS "BUSINESS AREA11 ON THE PRELIMINARY PLAT OF POPE PLACE, UNIT 1, DATED APRIL 12, 1952, ON FILE IN THE OFFICE OF THE ZONING AND PLANNING COMMISSION OF THE CITY OF CORPUS CHRISTI, TEXAS, BE CHANGED FROM IIR -11I, ONE FAMILY DWELLING DISTRICT USE TO I18 -III, NEIGHBORHOOD BUSINESS DISTRICT USE. SECTION 9. THAT THE ZONING OF THAT TRACT OF LAND DESCRIBED AS LOT 16, BLOCK 2, BAYVIEW ADDITION TO THE CITY OF CORPUS CHRISTI, TEXAS, BE CHANGED FROM IIA -111, FIRST APARTMENT HOUSE DISTRICT USE AND IIA -21I SECOND APART- MENT HOUSE DISTRICT USE TO IIB -311, SECONDARY BUSINESS DISTRICT USE. SECTION 10. THAT THE OFFICIAL ZONING MAP OF THE,CITY OF CORPUS CHRISTI BE AND THE SAME IS HEREBY AMENDED AS HEREIN ORDAINED. SECTION 11. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI APPROVED ON THE 4TH DAY OF MAY, 1948, AS AMENDED FROM TIME TO TIME, EX- CEPT AS HEREIN CHANGED SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 12. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED. SECTION 13. THAT THE NECESSITY OF IMMEDIATELY MAKING THE AFORESAID CHANGES FOR THE PURPOSE OF AT ALL TIMES MAINTAINING A COMPREHENSIVE ZONING ORDI- NANCE IN ACCORDANCE WITH THE RAPID GROWTH AND DEVELOPMENT OF THE CITY, SUCH ZON- ING BEING OF GREAT IMPORTANCE TO PUBLIC HEALTH, SAFETY, AND GENERAL WELFARE, CREATES AN EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR, DECLARING SUCH EM- ERGENCY AND NECESSITY,HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORD- INGLY PASSED AND APPROVED, THIS THE DAY OF EPTEMBER, A.D. 1952.
