AUTHORIZING CONDEMNATION PROCEEDINGS BY THE CITY OF CORPUS
CHRISTI TO CONDEMN CERTAIN REAL ESTATE CONSISTING OF APPROXI-
MATELY 115 ACRES OF LAND, MORE OR LESS, EXTENDING TO THE NORTH-
WEST FROM THE PRESENT MUNICIPAL AIRPORT OF THE CITY OF CORPUS
CHRISTI, TEXAS, AND MORE PARTICULARLY DESCRIBED HEREIN, AND
DIRECTING THE CITY ATTORNEY TO INSTITUTE PROCEEDINGS IN ORDER
TO CARRY OUT THE INTENTION OF THIS ORDINANCE; AND DECLARING AN
EMERGENCY.
WHEREAS, ON APRIL 8, 1952, BY ORDINANCE No. 3246, IT WAS DETERMINED
TO BE TO THE BEST INTEREST OF THE CITY TO IMPROVE, EXTEND AND ENLARGE CLIFF
MAUS MUNICIPAL AIRPORT INCLUDING THE ACQUISITION OF ADJACENT LAND THEREFOR;
AND
WHEREAS, IT WAS DETERMINED THAT AN OFFER BE EXTENDED TO THE PRESENT
OWNERS FOR SUCH ADJACENT LAND TO PURCHASE THE SAME AT A PRICE OF ONE THOUS-
AND FIVE HUNDRED DOLLARS PER ACRE, AND AS AUTHORIZED BY SAID ORDINANCE SUCH
FORMAL OFFER WAS MADE TO SAID OWNERS BY THE CITY MANAGER OF THE CITY OF
CORPUS CHRISTI, TEXA51 AND
WHEREAS, COMMUNICATIONS AND NEGOTIATIONS, INCLUDING A FINAL OFFER
MADE ON NOVEMBER 4, 1952, HAVE BEEN DULY HAD BY AND BETWEEN THE CITY MANAGER
ACTING FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS, AND GUARANTY
TITLE AND TRUST COMPANY, TRUSTEE, AND L. H. GROSS, JUDGE I. W. KEYS, EDWIN F.
FLATO AND J. R. LOCKE, ACTING FOR AND ON BEHALF OF THE OWNERS OF SAID LAND,
ALL IN ACCORDANCE WITH THE INSTRUCTIONS OF THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS, TO WHICH REFERENCE IS HEREBY MADE, AND THE ACTION
TAKEN BY THE CITY MANAGER ON BEHALF OF THE CITY IS HEREBY RATIFIED, FROM

WHICH NEGOTIATIONS NO AGREEMENT HAS BEEN REACHED BY WHICH AN AMICABLE CON-
TRACT FOR SUCH'PURCHASE COULD BE MADE, AND IT IS NOW NECESSARY THAT THE CITY
EXERCISE ITS POWERS OF EMINENT DOMAIN TO ACQUIRE SUCH PROPERTY; AND
WHEREAS, FURTHER DELAY IN THE MATTER WOULD NOT BE TO THE BEST INTEREST
OF THE CITY OF CORPUS CHRISTI NOR ITS INHABITANTS; ^
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. IN CONFORMITY WITH THE PREMISES, AND IN ACCORDANCE WITH
CERTAIN PROVISIONS OF THE CITY CHARTER, THE CITY OF CORPUS CHRISTI, TEXAS,
DOES HEREBY ORDER THE CONDEMNATION OF CERTAIN REAL ESTATE IN NUECES COUNTY, G

BRING an irregular tract of land lying in parts of Lots 13, 14, 15 and 16 of
the J. C. Russell Farm Lots, and more particularly described as follows:
BBOINM3G at a point in the northwest boundary line of Old Brownsville Road,
said point of beginning bears north 43 deg. 05 nine S, a distance of 750.37
feet from the intersection of the extended center line of the existing south-
east northwest ruawty of Cliff Haas Municipal Airport; Old Brownsville Road;

BEING a strip of land 80 feet in width lying 40 feet each side of the
following described center line and passing through parts of Lots 13, 16
and 17 of J• C. Russell Farm Lotst
BEGINNING at a point in the intersection of Morgan Street Extension (Old
Brownsville Road) and Airport Road, said point of beginning bears north
43 deg. 05 mine $, a distance of 1636.96 feet from the intersection of
extended center wine of the southeast northwest rummy and the center line
of Old Brownsville Road and its extension;
Thence along the center line of an 80-foot right -of-wW with
a curve to the right with a radius of 750 feet and subtending a central
angle 58 dog. 23 min* with a center line of curve a distance of 764#22 feet
to the P. To of said curve;
Thence north 45 deg. 06 min. wrest with the center line of an
80 -foot right- ofwap* a distance of 2390.20 feet to the P. C'• of a 5- degree
curve to the left with a central angle of 45 degrees with a radius of
1146.28 feet, said center 11ne being 1279936 feet northeast of and parallel
to the center line extended of the southeast northwest runwW of Cliff Maus
Municipal Airport;
Thence with a,curve to the left along the center line of an
80 -foot right -of-Ws said curve being a 5- degree curve to the left with
the central angle of 45 degrees, a tangent of 474.80 feet and a radius of
1146.28 feet, a distance along center line of said curve of 900.29 feet to'
the P.T. of said curve;
Thence south 89 dog. 54 min. west along the center line of an
80-foot right -wf -say, a distance of 1525#20 feet more or less to the center
line of an existing county road lying between Lots 12 and 13 of the J. co
Russell Farm Lots and containing 10.25 acres of land more or leas+

AND THE CITY ATTORNEY'IS HEREBY AUTHORIZED AND DIRECTED, TO IN-
STITUTE CONDEMNATION PROCEEDINGS AGAINST SAID PROPERTY AND THE GUARANTY
TITLE & TRUST COMPANY, TRUSTEE,AND ALL OTHER PERSONS HAVING A LEGAL
INTEREST THEREIN, AND TO PROCEED WITH SAID CONDEMNATION SUIT TO ITS
CONCLUSION, WITH THE INTENTION IN MIND OF OBTAINING FEE SIMPLE TITLE
IN AND TO SAID PROPERTY FOR THE PURPOSE OF USING THE SAME FOR SAID
AIRPORT ENLARGEMENT AND IMPROVEMENT. '
SECTION 11. THAT THE PROMPT INSTITUTION OF CONDEMNATION PRO-
° CEEDINGS AND IMMEDIATE ACQUISITION OF SAID LAND SO THAT THE CONTEMPLATED
AIRPORT ENLARGEMENT AND IMPROVEMENT MAY BE PROSECUTED WITH ALL DILIGENCE
AND DISPATCH CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE PROVIDING THAT NO ORDINANCE
OR RESOLUTION BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT
SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF
THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH PUBLIC EMERGENCY
AND SUCH IMPERATIVE PUBLIC NECESSITY TO EXIST, REQUESTS THAT SAID CHARTER
RULE BE SUSPENDED, AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL ,
FORCE AND EFFECT, FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY ORDAINED.

GENTLEMEN:
FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE-
GOING ORDINANCE OR RESOLUTION, A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC
NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT
NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS IN-
TRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE
SEVERAL MEETINGS OF THE CITY COUNCIL. I, THEREFORE, HEREBY REQUEST THAT
YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINAL-
LY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE CITY COUN-
CIL.
