HomeMy WebLinkAbout03359 ORD - 12/02/1952AN ORDINANCE AUTHORIZING CONDEMNATION PROCEEDINGS BY THE CITY OF CORPUS CHRISTI TO CONDEMN CERTAIN REAL ESTATE CONSISTING OF APPROXIMATELY 117 ACRES OF LAND, MORE OR LESS, EXTENDING TO THE NORTHWEST FROM THE PRESENT MUNICIPAL AIRPORT OF THE CITY OF CORPUS CHRISTI, TEXAS AND MORE PARTICULARLY DESCRIBED HEREIN, AND DIRECTING THE CITY ATTORNEY TO INSTITUTE PROCEEDINGS IN ORDER TO CARRY OUT THE INTENTION OF THIS ORDINANCE; SUPERSEDING AND, INSOFAR AS SAME MAY CONFLICT, REPEALING ORDINANCE NO. 3348; AND DECLARING AN EMERGENCY. WHEREAS, ON APRIL 8, 1952, BY ORDINANCE No. 32462 IT WAS DE- ! TERMINED TO BE TO THE BEST INTEREST OF THE CITY TO IMPROVE, EXTEND AND ENLARGE CLIFF MAUS MUNICIPAL AIRPORT INCLUDING THE ACQUISITION OF ADJACENT LAND THEREFOR; AND WHEREAS, IT WAS DETERMINED THAT AN OFFER BE EXTENDED TO THE PRESENT OWNERS FOR SUCH ADJACENT LAND TO PURCHASE THE SAME AT A PRICE OF ONE THOUSAND FIVE HUNDRED DOLLARS PER ACRE, AND AS AUTHORIZED BY SAID ORDINANCE SUCH FORMAL OFFER WAS MADE TO SAID OWNERS BY THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI, TEXAS; AND WHEREAS, COMMUNICATIONS AND NEGOTIATIONS, INCLUDING A FINAL OFFER MADE ON NOVEMBER 4, 1952, HAVE BEEN DULY HAD BY AND BETWEEN THE CITY MANAGER ACTING FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS, AND GUARANTY TITLE AND TRUST COMPANY, TRUSTEE, AND L. H. GROSS, 1. W. KEYS, EDWIN F. FLATO AND J. R. LOCKE, ACTING FOR AND ON BEHALF OF THE OWNERS OF SAID LAND, ALL IN ACCORDANCE WITH THE INSTRUCTIONS OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TO WHICH REFERENCE IS HEREBY MADE, AND THE • ACTION TAKEN BY THE CITY MANAGER, ON BEHALF OF THE CITY,IS HEREBY RATIFIED; AND WHEREAS, THE CITY AND THE OWNERS HAVE BEEN UNABLE TO AGREE UPON THE VALUE OF THE LAND DESIRED TO BE ACQUIRED BY THE CITY OR THE DAMAGES, AND NO AGREEMENT HAS BEEN REACHED BY WHICH AN AMICABLE CONTRACT FOR SUCH PURCHASE COULD BE MADE, AND IT IS -NOW NECESSARY THAT THE CITY EXERCISE ITS POWERS OF EMINENT DOMAIN TO ACQUIRE SUCH PROPERTY ;AND WHEREAS, IT IS NECESSARY TO MORE ACCURATELY DESCRIBE SAID LAND THAN WAS DONE IN ORDINANCE No. 3348; AND 3 ,35 q WHEREAS, FURTHER DELAY IN THE MATTER WOULD NOT BE TO THE BEST INTEREST OF THE CITY OF CORPUS CHRISTI NOR ITS INHABITANTS; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. SECTION II. THAT THIS ORDINANCE SHALL SUPERSEDE AND, INSOFAR AS IT MAY BE IN CONFLICT THEREWITH, REPEAL ORDINANCE No. 33148• SECTION 111. THAT THE PROMPT INSTITUTION OF CONDEMNATION PROCEEDINGS AND IMMEDIATE ACQUISITION OF SAID LAND SO THAT THE CONTEMPLATED AIRPORT ENLARGEMENT AND IMPROVEMENT MAY BE PROSECUTED WITH ALL DILIGENCE AND DIS- PATCH CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIR- ING THE SUSPENSION OF THE CHARTER RULE PROVIDING THAT NO ORDINANCE OR RESO- LUTION BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDI- NANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CIT COUN- CIL, AND THE MAYOR, DECLARING SUCH PUBLIC EMERGENCY AND SUCH IMPERATIVE PUBLIC NECESSITY TO EXISTS REQUESTS THAT SAID CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGES IT IS ACCORDINGLY PASSED AND APPROVED THIS THE Z'10- DAY OF DECEMBER, A.
