AN ORDINANCE , — -
AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE
CITY OF CORPUS CHRISTI TO ACQUIRE FOR AND ON BEHALF
OF THE CITY FROM THE FEDERAL GOVERNMENT APPROXIMATE-
LY 4.23 ACRES OF LAND OUT OF THE CERTAIN 9.68 ACRES
OUT OF THE NORTHEAST PORTION OF LOT 1 IN SECTION G
PAISLEY'S SUBDIVISION OF THE HOFFMAN TRACT, NUECES
COUNTY, TEXAS, THE SITE OF A VETERANS HOUSING PROJECT
DESIGNATED AS LAND: EHT: TEX 41065, AND 92 HOUSING UNITS
LOCATED ON SAID LAND KNOWN AS VETERANS HOUSING PROJECT
TEX- v - 41769, BEING ADJACENT TO LA ARMADA III.LOCATED
AT 2800 BLOCK OF AYERS STREET, CORPUS CHRISTI, TEXAS;
SAID HOUSING UNITS TO BE SOLD AS SALVAGE BY THE CITY AND
THE LAND TO BE DEVELOPED AS A PUBLIC PARK AND PLAYGROUND,
SUCH PURCHASE BEING MADE IN•ACCORDANCE WITH THE OPTION
CONTAINED "IN'THE AGREEMENT REFERRED TO IN ORDINANCE NO. 2961;
APPROPRIATING FROM NO., 291 IMPROVEMENT BONDS 1952 CONSTRUCTION
FUND (PARK IMPROVEMENTS AND CONSTRUCTION) THE SUM OF FOUR
THOUSAND FIVE HUNDRED ($4,500) DOLLARS TO BE PAID AS THE
PURCHASE PRICE FOR SAID LAND AND FOR EXPENSES INCIDENT TO
SAID ACQUISITION; AUTHORIZING AND DIRECTING THE CITY MANAGER
TO DO ALL THINGS NECESSARY AND REQUISITE TO SUCH ACQUISI-
TION AND TO EXECUTE ALL INSTRUMENTS INCIDENT THERETO; AND
DECLARING'AN EMERGENCY.
WHEREAS, IN ACCORDANCE WITH THE OPTION CONTAINED IN THE AGREE-
MENT AUTHORIZED TO BE EXECUTED IN ORDINANCE No. 2961, IT HAS BEEN RECOM-
MENDED BY THE PARK AND RECREATION BOARD AT ITS REGULAR MEETING FRIDAY,
.DECEMBER 5, 1952, THAT'SUCH OPTION BE EXERCISED AND THAT SAID CITY OF
',CORPUS CHRISTI PURCHASE FROM THE U. S. GOVERNMENT APPROXIMATELY 4.23
,ACRES OF LAND OUT OF A CERTAIN 9.68 ACRE TRACT O t UT OF THE NORTHEAST
PORTION OF LOT 1, SECTION G, PAISLEY'S SUBDIVISION OF THE HOFFMAN TRACT,
NUECES COUNTY, TEXAS, THE SITE OF A VETERANS - HOUSING PROJECT, AND BEING
DESIGNATED AS LAND EHT: TEX'41o65, AND.THE 92 HOUSING UNITS LOCATED ON
SAID LAND KNOWN AS VETERANS HOUSING.PROJECT TEX- V- 41769] SAID 4 ACRES
OF LAND BEING ADJACENT To LA ARMADA III LOCATED IN THE 2800 BLOCK OF
AYERS STREET IN THE CITY OF CORPUS CHRISTI, TEXAS; AND
WHEREAS, IT HAS BEEN PROPOSED THAT SAID HOUSING UNITS LOCATED
ON SAID LAND BE DISMANTLED AND SOLD AS SALVAGE BY THE CITY AND THAT THE
LAND BE DEVELOPED AS 'A PUBLIC PARK AND PLAYGROUND; AND

WHEREAS, THERE ARE SUFFICIENT FUNDS AVAILABLE IN THE UNAPPROPRIAT-
ED FUNDS IN NO. 291 IMPROVEMENTS BONDS 1952 CONSTRUCTION FUND (PARK .I.M-
,PROVEMENTS AND CONSTRUCTION) WITH WHICH TO PURCHASE SAID LAND;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:

SECTION 1. THAT THE CITY MANAGER BED AND HE IS HEREBY AUTHORIZED
AND DIRECTED FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TEXAS TO

ACQUIRE FROM•THE UNITED STATES GOVERNMENT APPROXIMATELY .23 ACRES OF
LAND DESCRIBED AS FOLLOWS: _
ALL THAT AREA DESIGNATED AS PARK AREA AND BEING THE WEST
4.23 ACRES OUT OF THAT CERTAIN 9.68 ACRES OF LAND OUT OF
THE NORTHEAST PORTION OF LOT 1, SECTION G, PAISLEY'S SUB-
DIVISION OF THE HOFFMAN TRACT IN NUECES COUNTY, TEXAS,
WHICH 9.68 ACRE TRACT OF LAND IS DESCRIBED AS FOLLOWS,

Fieldnotes of a survey of 9.68 acres of land out of the northeast
portion of Lot 1 in Section G of Paisley's Subdivision of the Hoffman Tract.
Said survey is situated in Nueces County, Tawas, about two and one -half
miles southwest from the County Courthouse and embraces the one -half
miles southwest from the County Courthouse and embraces the remaining
portion of said Lot 1 after deducting the southwest 30.00 acres thereof
and further deducting a strip 40.00 feet wide along the southeast margin
comprising part of the right of wady of a public road known as Ayers Street.
Beginning at the point of intersection of the northwest boundary line
` of Ayers Street, an 80 -foot public road, also ]mown as the Chapman Ranch
Road, with the northeast boundary line of Lot 1 in Section G and southwest
boundary line of Lot 16 in Section L. both in Paisleys Subdivision of the
Hoffman Tract, for the east corner of this survey, whence a point, the
common corner of Sections G, H, A and L in said Paisleys Subdivision
of the Hoffman Tract, bears S. 610 42 *E. 1+.0.00 feet and a drillhole in
concrete pavement slab bears S.6101+.21E. 39.67 feet, -
Thence S.280201W., with said northwest boundary line of Ayers Street
and parallel with and 40.00 feet northwesterly, measured at right angles,
from the southeast boundary line of said Lot 1, 329.58 feet to a point
for the south corner of this survey, whence the point of intersection of
said northwest boundary line of Ayers Street with the southwest boundary
line of said Lot 1 bears S.28020I W. 990.00 feet, -
Thence N.61040140W„ paralled with said southwest boundary line of
Lot 1, 1280.00 feet to a point in the northwest boundary line of said
Lot 1 and southeast boundary line of Lot 2 in said Section G, for the
vest corner of this survey, whence the west corner of said Lot 1 bears

Thence N.280201E., with said northwest boundary line of Lot 1 and
southeast boundary line of Lot 2, 329.09 feet to a point, the north corner
of said Lot 1 and a common corner also of said Lot 2 in Section G and
Lots 15 and 16 in said Section L, for the north corner of this survey, -
Thence 3.61 042 +E.; with. said northeast boundary line of Lot 1 in
Section G and southwest boundary line of Lot 16 in Section L. 1280.00

FOR SAME AND $270 TO COVER EXPENSES INCIDENT THERETO, A TOTAL OF $4,500;
FOR THE PURPOSE OF PROVIDING A PUBLIC PARK AND PLAYGROUND IN THE CITY
OF CORPUS CHRISTI, TEXAS.
SECTION 2. THAT THERE BE AND THERE IS HEREBY APPROPRIATED FROM
NO. 291 IMPROVEMENT BONDS 11952 CONSTRUCTION FUND (PARK IMPROVEMENTS AND
CONSTRUCTION) THE SUM OF $4,500, $4,230 OF WHICH IS TO BE PAID AS THE
PURCHASE PRICE OF THE LAND DESCRIBED IN SECTION I HEREOF AND $270 OF
WHICH IS HEREBY APPROPRIATED TO COVER EXPENSES INCIDENT TO SUCH AC-
QUISITION.
SECTION 3. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED

AND DIRECTED TO DO ALL THINGS NECESSARY AND REQUISITE TO SUCH ACQUISITION
AND TO EXECUTE ALL INSTRUMENTS INCIDENT THERETO.
SECTION 4. THAT THE NECESSITY OF EXERCISING THE OPTION CONTAINED
IN THE AGREEMENT MENTIONED HEREINBEFO'RE AND OF PROVIDING ADEQUATE LAND
SITES FOR PUBLIC PARK AND PLAYGROUND IN ACCORD WITH THE PUBLIC PARK SYSTEM
PROGRAM AS A PART OF THE PERMANENT PARK IMPROVEMENTS OF THE CITY OF CORPUS
CHRISTI) TEXAS, CREATES APUBLIC EMERGENCY AND`AN IMPERATIVE PUBLIC NECES-
SITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR
RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND
THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS
OF THE CITY COUNCIL, AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND
NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE
AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF IT'S INTRODUCTION
AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
IT IS ACCORDINGLY PASSED AND APPROVED, THIS THE -ZW/*AY OF DECEMBERS A.

Gentlemen:
For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
hereby request that you suspend said Charter rule or requirement and pass this
ordinance finally on the date it is introduced, or at the present meeting of
the City Council,
