SPECIAL COUNCIL MEETING
JUNE 16, 1976
3:30 P.M.

Mayor Luby called the meeting to order in the Council Chamber of City Hall.
City Secretary Read called the roll and stated there was a quorum of the
Council and the necessary Charter Officers present to have a legally constituted
meeting.
City Manager Townsend presented Application #C476-2, City of Corpus Christi,
for change of zoning from "R -1B" One -family Dwelling District and Special Permit to
"B-3" Business District on Tract A (a 0.27± acre tract); and from "R -1B" One -family
Dwelling District and Special Permit to "A-2" Apartment House District on Tract B
(a 9.20+_ acre tract) both tracts being out of Lots 1 & 2, Block AR, Carroll Place
#5, located on the northwest corner of Weber Road and Holly Road. He reported that
the Planning Commission recommends that the request be denied. He announced that
in response to notificationofthe public hearing, two letters had been received in
opposition.
Chief Planner Larry Wenger presented a land use and zoning map and showed
slides of the location. .He explained that there has been a conflict over the past
few years with the owners of the existing apartment complex relative to the number
of signs on the property; that although about four signs have been removed, the'
remaining two signs are not allowable under.the present zoning; therefore, the City
has initiated the application for change of zoning to "B-3" and "A-2" in an attempt
to resolve the conflict.
Mr. John Brooke, attorney for the owners, stated he is -in favor of the
application.
No ane in 'the audience'was in oppositionrto the application.
Motion by de Ases, seconded by Gulley and passed unanimously, that the hearing
be closed.

City Manager Townsend next presented Application #C576 -3a City of Corpus
Christi, for change of zoning from "R-2" Multiple Dwelling District to "MB" One -
family Dwelling on Tract A (a 12.11+ acre tract out of Lot 7, Section 11) and
Tract B (a 9.35+ acre tract out of Lots 6 & 7, Section 11), both tracts in Bohemian
Colony Lands, located south of Saratoga Boulevard, west of Aaron Drive, and south
of Acushnet Drive. He informed the Council that the recommendation of the Planning
Commission is that it be approved; that in response to the notification of the
public hearing, four letters had been received in favor.
Chief Planner Larry Wenger presented a land use and zoning map and showed
slides of the location. He explained that the tracts have not developed into multiple -
family units, but single-family; and that the owners have no objections to its being
rezoned single family.
No one from the audience addressed the Council relative to the application.
Motion by Sample, seconded by Gulley and passed unanimously, that the hearing
be closed.
Motion by Gulley, seconded by Sample and passed unanimously, that Application
#C576-3, City of Corpus Christi, be approved.
City Manager Townsend then presented Application #C576-2, City of Corpus
Christi, for change of zoning from "R-2" Multiple Dwelling District to "R-16" One -family
Dwelling District on Tract A (Block 16, Country Club Estate #19 - 13.86 acres), and
Tract B (a 12.24 acre portion out of Tract 10, Oso Farm Tracts), located south of
Acushnet Drive and east of Sanders Drive. He reported that the recommendation of
the Planning Commission is that it be approved; and that in response to the notification
of the public hearing, six letters had been received in favor.
Chief Planner Wenger presented a land use and zoning map and showed slides
of the location. He explained that the request was initiated by the Staff since the
subdivider had restricted the lots to single-family through deed restrictions; that
it is the opinion of the Staff that the property should be downzoned prior to development
to avoid possible problems in the future; and that the property owners are in full
agreement.
No one from the audience addressed the Council relative to the Application.
Motion by Gulley, seconded by Sample and passed unanimously, that the hearing
be closed.

Motion by Gulley, seconded by Sample and passed unanimously, that Application
#C-576-2, City of Corpus Christi, be approved.
City Secretary read then presented the following ordinance pertaining to
Application #476-2 which the Council had approved; the vote was called and the
ordinance passed, as follows:
ORDINANCE NO. 13236
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING
THE ZONING MAP BY CHANGING THE ZONING ON TRACT "A" FROM "R -1B" ONE FAMILY DWELLING
DISTRICT AND SPECIAL PERMIT TO "B-3" BUSINESS DISTRICT, AND ON TRACT "B" FROM "R -1B"
ONE FAMILY DWELLING DISTRICT AND SPECIAL PERMIT TO "A-2" APARTMENT HOUSE DISTRICT,
BOTH TRACTS BEING OUT OF LOTS 1 AND 2, BLOCK AR, CARROLL PLACE #5, MORE PARTICULARLY
DESCRIBED HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE
AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by the following
vote: Luby, Tipton, de Ases, Gill, Gulley, Lozano and Sample, present and voting "Aye".
There being no further business to come before the Council at this Special
Meeting, on Motion by Tipton, seconded by Lozano and passed unanimously, the Special
Council Meeting of June 16, 1976 adjourned at 4:10 p.m.
